Dear Mr. Gardner:
You have our approval, to construct a home on lots 62B, 63B and 64B, Joe Louis Park Subdivision
in Raleigh as you described in your application approved for a variance form the Neuse River buffer rules as
approved by the Water Quality Committee of the NC Environmental Management Commission on October
13, 1999. After reviewing your application, we have decided that this project is covered by the Neuse
River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, NC 276 1 1-7447. This approval and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River buffer

before the October Water Quality Committee. Mr. Garner wants to build a one story single
family home on three lots (each 30 by 1.00 feet and platted in the 1940's!) in southeast
Raleigh. He has met with Todd and I and will preserve the buffer as much as possible and
direct stormwater from the home to sheet flow across the lawn and remaining buffer. Todd
and I support the variance due to hardship. I need your comments by October 4" so I can
develop a staff position for the WQC meeting on October 13. Thankx

Demonstration of Need for a Variance
.TE: The valiance provision of the Neuse Riparian Area Rule allows the Environmental Management
Commission to grant a variance to an affected party when the following conditions apply on a given project:
(a) practical difficulties or hardships would result from strict application of the rule:
(b) such difficulties or hardships result from conditios which are peculiar to the property involved; and
(c) the general purpose and intent of the Rule would be preserved, water quality would be protected and
substantial justice would be done if the variance were granted.
This part of the application is to explain how the project meets criteria (a) and (b).
Attach a detailed description (2-3 pages) explaining the following:
• The practical difficulties or hardships that would result from strict application of the Rule.
• How these difficulties or hardships result from conditions that are unique to the property
involved.
• Why reconfiguring and/or reducing the built-upon area to preserve a greater portion of the
riparian area is not feasible on this project. If economic hardship is the major
consideration, then include a specific explanation of the economic hardship and the
proportion of the hardship to the entire value of the project.
Part 3: Water Quality Protection
NOTE: This part of the application is to explain how the project meets criterion (c): the general purpose and
intent of the Rule would be preserved, water quality would be protected and substantial justice would be done if
the variance were granted.
