Riparian Area Rules. We were met on site by members of the Wayne County Economic Engineers
Development Commission and Trey Gurleson of McDavid and Associates Consulting for the Wayne County Industrial Park.
The channel in question is a modified (relocated) stream. The natural l stream shows
of Goldsboro lid
blue line on the most recent topographic map and the map prepared Y
which designates streams with blue lines. The Wayne County Soil Map designates the stream as
an intermittent stream (4-dot, unclassified). The natural channel was relocated approximately five
(5) years ago according to the representatives on site. The constructed channel banks are at a 3:1
slope ratio. The depth is 4,5 too with an 8 foot width at the bottom. The
800 feet of this channel for the purpose of g the adjacent
Industrial Park is requesting pipe

At the time of the site investigation the stream had flowing water. There were fish and bogs
present as well as other biological indicators. The relocated channel is forte orpholoi cal the

Primary Flied Indicators
Geomorphology:
I- A weak riffle pool sequence exists as a result of stabilization efforts.
2. The strcambed texture was much coarser sand than the surrounding terrain.
3. Absent.
4. This channel was straightened but the flowing water is recreating sinuosity.
5. In the bottom of the channel there is an active floodplain.
6. Absent.
7. Conservatively this was left absent but there were signs of deposited sand from an
upstream location.
8. There are signs of a bankfull bench funned under higher water conditions.
9. The bed and bank is weak because the channel is still reforming geomorphology.
10. No.
Hydrology:
1. Absent.
Biology:
' l . Small fibrous roots were apparent within the streambed. It is difficult to distinguish
whether or-not-these were the SAV's root system.
2. There were Obligates as well as SAV species rooted within the channel.
3. Periphyton was present during the site visit.
4. Absent.

2. A small grade control structure was formed with the introduction of rip-rap.
3. There were signs and slight elevations, which may indicate a natural drainage way,
but this was not interpreted as strong enough to accumulate points.

2. Frogs were seen within the channel.
3. Absent on the day of determination.

6. There was a sheen of iron oxidizing bacteria the day of determination.
7. There was an extensive crop of filamentous algae the day of the determination.
8. There were both SAVs and OBLs within the stmambed but the more conservative
point value was considered.

Jim,
I am extremely concerned about making this
arbitration call during the present adverse weather
conditions (i.e. hurricane) especially when regional staff
can't be present. Wayne Co. is an extremely sensitive
area for Neuse River Buffer calls. Consistency is
extremely important. One call that doesn't follow the
guidelines will be used against the DWQ for all future
calls. The NRCS office told me that many state, federal
and local politicians would be present on the site today
while this call is being made (at the request of Sen. John
Kerr). This call will be used to set precedence.
On Wednesday, 8/24/99, at the request of Tyndall
Lewis, Brad Shaver and I visited the site to make a field
determination of whether a relocated stream retained or
had developed enough attributes to be considered a
stream. The relocation of the solid blue line stream
(recent topo.) had taken place approx. 5 years ago. The
stream also shows up on the soil maps as well as the
Wayne County street and stream map developed by the
county. The constructed channel for the relocated stream
is approximately 8 ft. across at the bottom and the
banks are approx. 4.5 ft. high at a 3:1 slope. The
drainage from the original natural channel is forming
stream attributes in the bottom of the constructed
conveyance (similar to the Big Ditch in Goldsboro which
is a stream). After completion of the DWQ rating sheet
the channel rated 21.5 pts. which qualifies the channel
as at least an intermittent stream.
This office is concerned about rating a stream,
especially an arbitration call, in the middle of storm
conditions. If the channel fills up with storm water certain
attributes such as the man-made nick pt. creating a riffle
pool (per John Dorney on 8/25/99 we should count),
sinuosity, bed and bank, bankful bench, etc. will not be
visible due to storm water conveyance in the channel.
Other attributes such as iron oxidizing bacteria, frogs,
fish, etc. may have been washed or traveled further
downstream as a result of stormwater flow. Two of the
attributes; water in channel and >48 hours since last
known rain and water in channel during dry conditions or
growing season, can't be judged in a rain storm.
It is setting a precedent to even go out and make a

field determination under storm conditions which should
be looked at very carefully in order to maintain
consistency. The same holds true for making calls under
drought conditions. It doesn't promote protection of
sensitive waters to lose streams and buffers merely due
to rain or drought the day of the determination. The intent
of the Buffer Rules shouldn't reflect such arbitrary
conditions.

latest word - greg thorpe prevailed on me to head into the teeth of
the
storm and go to wayne county this morning. i just talked to tyndall
lewis and will be on site at 10:30 am with todd st. john. if you can
be
there that would be fine - otherwise i will let you know what i
decide.
now to call the charlotte folks. sorry for the short notice and keep
