Dear Mr. Wilkerson:
The purpose of this letter is to confirm the initial release of credits from the Middle
Cape Fear Umbrella Mitigation Bank (Bank), associated with the Bank's site of Daniels
Creek Mitigation Site located in Broadway, Harnett County, North Carolina.
With the November 15, 2019 verification for the use of Nationwide Permit No. 27 to
construct Daniels Creek Mitigation Site, our office has confirmed the fulfillment of
Section VII(C) of the Bank's November 5, 2019 executed Umbrella Mitigation Banking
Instrument (UMBI) and as shown in Appendix 9 (Section 1.1) of the August 2019 Final
Daniels Creek Mitigation Plan. As depicted in the credit release tables (Milestones 1-
Site Establishment) in Section 1.0 of the plan, 15% of the forested wetlands and 15% of
the stream credits are being released. This release reflects 2.08 riparian (non-riverine)
wetland credits, 0.059 non -riparian wetland credits, and 1,842 linear feet of stream
credits. Total credits, broken down by wetland types, are shown in Table 25 of the
mitigation plan.
The release of additional credits will be contingent on the review of the subsequent
monitoring reports by the Interagency Review Team and our office and the construction
completion of the mitigation site. Please be reminded that all annual monitoring reports,
as stated in Section 10.1 of the final mitigation plan, must be submitted no later than
April 1 of each year. All construction "as -built" surveys of the site must be provided to
our office once their completed. Based upon the results of these surveys, mitigation
credits may be adjusted accordingly.
Also, as required in Section VII (C) of the Bank's UMBI, please be reminded that you
must initiate the construction of the initial physical and biological improvements to the
bank site, pursuant to the mitigation plan, by the end of the first full growing season,
following the initial sale of any credits from the Bank.
