Eric,
We have received a request for Major Modification from Duke, please see attached. They are asking us
to remove a condition that was intended to protect a warm water fish, but it is no longer relevant since

they shut down the coal-fired facility and built a gas -fired plant. This action caused a significant
reduction in the discharge of heated flow from 170 MGD to 0.6 MGD.
Please let me know if you have any objections or comments regarding the proposed modification.
