You have our approval, in accordance with the attached conditions, to place fill material in 0.01 acres of wetlands or
waters for the purpose of installing a waterline, as you described in your application dated August 25, 1999. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101.
This Certification allows you to use National Permit Number 12 when the Corps of Engineers issues it. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control," Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
-This approval is only valid for the purpose and design that you described in your application. If you change your- ---
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447; Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

16-Inch Cross-Town Finished Water Transmission Main
The proposed new 16-inch water transmission main right-of-way (ROW) passes along
established roadways within the city of Sanford, but does cross two creeks and one
tributary. This assessment, performed on March 10, 1999, reports the findings. on these
crossings.
Little Buffalo Creek at Weatherspoon St.
The main leaves mowed ROW in front of the Municipal Complex on Weatherspoon St.
and crosses Little Buffalo Creek, just below the bridge on the north side. There is no
floodplain on the east side of the creek. At this point, Little Buffalo Creek is 6-8 feet wide
and 6-18" inches deep with a rocky substrate. The creek has-an unnatural brownish-black
color and the stream has significant urban trash in it. No fish were seen at this crossing and
the only macroinvertebrates observed were a few roundworms. Crossing the creek, the
main passes through a floodplain for about 60 ft. The dominant trees are Honey locust
(Geditsia triacanthos) and Black willow (Salix nigra) 10" dbh, with Sweetgum
(Liquidambar styraciflua) 2" dbh and a large clump of Multiflora rose (Rosa multiflora).
The floodplain is generally open, with little ground cover. The main then passes under the
railroad in to an open floodplain covered with maintained Fescue grass. It then passes up
an old access road to Weatherspoon St. The access road cuts through an urban, disturbed
forest.
Big Buffalo Creek and Tributary at Spring Lane
The main is passing along the south side of Spring Lane, after crossing US HWY 1. It
crosses the tributary in front of the Riverbirch Corner Shopping Center. The area serves
as the open, maintained space for the center. The lawn is mowed to the edge of the
tributary. The tributary is 6-8 ft. wide and 18-30 inches deep. Two woody species occur
on the bank, a River birch (Betula nigra) 12" dbh and a Red maple (Acer rubrum) 8" dbh.
Next the main crosses Big Buffalo Creek. The creek forms the western boundary of the
shopping center, with businesses on the other side of the creek. Again the creek is
maintained to the edge on both sides. Only one woody species, a Black willow 6" dbh, is
present. The creek is 6-10 ft. wide, 6-18 inches deep with a sandy bottom. There is a
well-developed terrace on the west side of the creek, providing a shelf for temporary
flooding. The terrace is populated with grasses.
With this urban project, the effect on the biological systems is minimal, since the area is

Rosemont-McIver Park National Register Historic District on Weatherspoon
between Horner and Gulf Street.
The proposed project will have no effect on the historic district if no structures or
mature plantings are disturbed.

Preservation Act and the Advisory Council on Historic Preservation's Regulations for

Black & Veatch is assisting the City of Sanford in the preparation of drawings,
construction specifications, and permitting documents for its Phase I cross-town finished
water transmission main. On behalf of the City, Black & Veatch is forwarding a
completed Pre-Construction Notification Application with supporting documentation and
fee check.
The project involves construction of approximately 7,225 linear feet of 16-inch
water main within the rights-of-way of the following city streets and state highways:
• North Eleventh Street (City)
• Weatherspoon Street (SR 1560)
• Hawkins Avenue (US 1 Business)
The proposed pipeline will expand the City's water transmission system. The proposed
16-inch finished water transmission main will cross jurisdictional waters in one location.
