Separately, I indicated that I thought we would be developing the Acorn Hill Creek preservation site separately from
Folly Swamp but would confirm.
I do confirm that it will be done separately but using the same UBMI (so separate Prospectus, mitigation plan, etc.).
So please feel free to send the post -comment period Prospectus letter for Folly Swamp.
We'll pull together a pre -Prospectus for the Acorn Hill site and look to get on the IRT's schedule to see it in January.

I spoke with Chris Roessler of WILDLANDS today. He mentioned that you all might be going back out on Wednesday,
December 4th to look at the streams again. I was curious why you would, as I understand that they are conceding to
calling Jordan Branch and Pollo Branch (headwaters of Greene Branch) as wetland ditches/swales and not streams. And,
I thought after our site visit that all the others (Folly Swamp, Morgan Branch, Greene Branch (up to weir), Barker Branch
& Powell Branch) were considered streams.
Is there another reason (NCSAM, etc.) that you're wanting to go back out at this point? Just curious, as Chris thought it
wouldn't hurt for me to attend.
My goal is to just complete the PJD. I've revised the WoTUS sketch map and PJD based on your field verification. Our
current plan is to include the stream calls along with the wetlands all in one PJD request.
The only thing I was waiting on was the identification of an alternate spoils area to replace the Gates Poultry Farm Inc
Spoil Area as they agreed not to pursue that area given the potential wetlands we found during our site visit (this was
the disturbed area near the ponds). To that end, they've identified areas around Folly Swamp near Jordan Branch as
depicted in yellow polygons on the attached map and excerpt below. The primary area is the cotton field by the vacant
trailer. However, they don't think that area is big enough and have identified additional areas as well. Obviously, they
would like to keep the spoils as close to the excavation area as possible, which this map represents. But, they would also
like to confirm that the agricultural field the north of the clear cut is also non -jurisdictional and any portion of it could be
used if needed for spoils. Please review the attached map and let me know if you feel a need to visit these areas or can
desk top the verification based on our site visit.

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.
PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all
waters and wetlands on the property will be treated as if they are jurisdictional "waters of
the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is
"preliminary" in the sense that an approved JD can be requested at any time. PJDs do
not expire.

An Approved Jurisdictional Determination (AJD) is a determination that
jurisdictional "waters of the United States" or "navigable waters of the United

Rivers and Harbors Act. Approved JDs are sufficient as the basis for permit

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be" waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following

The Division of Water Resources (DWR) has determined that the streams listed above and included
on the attached map have been located on the most recent published NRCS Soil Survey of GATES
County, North Carolina and/or the most recent copy of the USGS Topographic map at a 1:24,000 scale
and evaluated for applicability to the Water Quality Standards. Each stream that is checked "Not
Subject" has been determined to not be at least intermittent or not present on the property. Streams
that are checked "Subject" have been located on the property and possess characteristics that qualify
them to be at least intermittent streams. There may be other streams or features located on the
property that do not appear on the maps referenced above but may be considered jurisdictional
according to the US Army Corps of Engineers and subject to the Clean Water Act.
