Box 1737 Southern Pines, North Carolina 28388 RE: Franklin County Water System Improvements Dear Mr. McGougan: MAY 2 8 1999 Thank you for your May 12, 1999 letter to the U.S. Fish and Wildlife Service (Service)- requesting. our review of the above- referenced project in Franklin County, North Carolina. These comments are provided in accordance with provisions of Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531- 1543) (Act.). Based on the documented occurrence of the federally-endangered dwarf-wedge mussel in Cedar Creek and Crooked Creek. in Franklin County; and a recent site visit by a Service biologist, we have determined that a mussel survey should be conducted at the two proposed stream crossing sites (Cedar Creek/SR 1105 & Crooked Creek on Hwy 98), covering 100 meters upstream, and 400 meters downstream of the crossing. In addition, the applicant must implement the following measures.to insure protection for all aquatic resources occurring downstream: 1) Installation of instream silt curtain weighted at the bottom, and stringent bank erosion control. If tree removal is required, stumps and roots should remain intact for bank stabilization; 2) Instream construction activities should be initiated only during low flow conditions that permit the effective deployment of the silt curtain; 3) Before stream crossings are to begin, the contractor should notify the Service within one week of the construction initiation date. The Service would like the opportunity to inspect the installation of the silt curtain and check any possible changes in stream flow conditions when scheduling allows. Since freshwater mussels are highly susceptible to sedimentation, the Service generally recommends avoidance of instream construction work when possible in order to minimize adverse impacts. Your efforts in reducing erosion and sedimentation associated with this project will be beneficial to water quality and all aquatic species in this area. We have enclosed a list of consultants who currently hold state and federal mussel collecting permits. We look forward to the results of this survey upon completion. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This Certification allows you to use National Permit Number 12 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
