Re: Year 1 Monitoring Credit Release associated with the Tar River Headwaters Stream

Mr. Rich Mogensen
Mogensen Mitigation, LLC
Post Office Box 690429
Charlotte, North Carolina 28277
Dear Mr. Mogensen:
This correspondence is in reference to the Tar River Headwaters Mitigation Bank, located off
Bunnie Huff Road, approximately 23 miles northeast of Oxford, in Person County, North
Carolina. The site includes unnamed tributaries that flow into the Tar River Cataloging Unit
(03020101). The purpose of this letter is to confirm the Year 1 monitoring credit release, which
also includes Year 1 adaptive management plan.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Tar River Headwaters Stream
Mitigation Bank, approved on January 27, 2017; the site -specific Tar River Headwaters Stream
Mitigation Bank, approved on February 13, 2017; the Year 1 Monitoring Report dated November
2018; and the Adaptive Management Plan dated September 2019, ten percent (10%) of the
mitigation site's total restoration and enhancement credits shall be available for sale provided the
first year monitoring report, and adaptive management plan, demonstrates interim performance
standards are being met.
By copy of this correspondence, we confirm that you have satisfied the above requirements for
the Year 1 Monitoring credit release; and 196.5 stream mitigation units (SMUs) constituting 10%
of the mitigation bank site's total restoration and enhancement credits are now available for sale.
To date, 40 percent (786 SMUs) of the total credits (1965 SMUs) have been released. Our records
indicate that 589.5 SMUs associated with this mitigation site have been debited as of November
22, 2019. Therefore, the current total amount of credits available for sale is 196.5 SMUs.
Thank you for your interest in restoring and protecting waters of the United States. If you have
questions regarding this letter, please contact Samantha Dailey, Raleigh Regulatory Field Office at
