C. 27603 RALEIGH REGIONAL OFFICE 0_? /rouz Rules- Subject: Neuse River Basin Riparian:°Buffi NBRRO 99-053 Y Wake Forest Plaza Apartments WAYNE MCDEVITT Wake County SECRETARY Dear Mr. Slack: In response to your letter dated July 2, 1999, I offer the following; The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233) states, Temporary roads that disturb less than or equal to 2,500 square feet provided that vegetation is restored within 6 (six) months are an exempted activity. Temporary roads that disturb greater than 2,500 square feet provided that vegetation is restored within 6 (six) months are an allowed activity with DWQ concurrence. If this road/creek crossing is part of a silviculture activity, it is an exempt activity if the crossing is designed, constructed and maintained in accordance with 15 A NCAC 11.0203.
