You have our approval, to fill, grade and re-vegetate, as you described in your application dated
August 3, 1999 for the Raleigh Board of Realtors. After reviewing your application, we have decided that
this project is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River buffer

[THIS IS NOT A PERMIT REQUEST. NO HAPACTS WILL OCCUR TO JURISDICTIONAL
WETLANDS. NO IMPACTS REQUIRING NOTIFICATION TO THE NCDWQ WILL OCCUR TO
THE NEUSE RIVER RIPARIAN BUFFERS.]
The purpose of this letter is to notify you of my client's intent to fill/grade and re-vegetate within Zone 2
of the Neuse River Buffers for the site known as the RALEIGH BOARD OF REALTORS site located on
Endeavor Way, Cary, NC (see attached USGS site vicinity map and grading plans). We are of the
understanding that the proposed activity does not require NCDWQ staff review or written notification, but
unfortunately the Town of Cary is requiring written confirmation that this activity is "exempt" from the
Neuse River Riparian Buffer regulations.
Mr. Steve Mitchell of the NCDWQ has reviewed the site and determined the extent of the 50 foot Neuse
River Riparian Buffers as indicated on the attached grading plans (see attached confirmation letter).
Please review the attached grading plans and note that no grading will occur within Zone 1 of the buffers.
The grading activity within Zone 2 will be re vegetated and will provide diffuse flow of stormwater and
the health of existing vegetation in Zone 1 will not be compromised and the disturbed areas will be
stabilized Once you have reviewed the attached information, please send written confirmation that this
activity is exempt from the Neuse River Riparian Buffer regulations to myself and possibly the Town of
Cary Planning Department. (We believe that by notifying the Town of Cary Planning Department of this
exemption it will eliminate the need for future reviews such as this, which can be costly for the owner and
time consuming for your staff.)
Included are: (1) USGS Site Vicinity Map, (2) Grading Plans and (3) Mr. Mitchell's confirmation letter.
Please call if you have questions or require further information. Please contact S&EC, Inc. if you choose
to visit the site so that someone may accompany you.
