Dear Mr. Radman:
You have our approval, in accordance with the attached conditions, to place fill material in 0.21 acres of wetlands or
waters for the purpose of a residential subdivision, as you described in your application dated August 10, 1999. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108.
This Certification allows you to use National Permit Number 26 when the Corps of Engineers issues it. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

The purpose of this letter is to provide a complimentary notification of my client's intent to use
Nationwide Permit 26 for the construction of the proposed Stone Hill Estates Phase VI located on the
southwest corner of Freeman Road (NCSR 1840) and Mineral Springs Road (NCSR 1815) north of
Highway 98, Durham, Durham County, North Carolina UM Coordinates Zone 17, 3985200 N, 0696500
E). Proposed impacts to wetlands will total 0.21 acres. Construction of the subdivision will comply with
all of the general conditions stated within Nationwide Permit 26.
S&EC, Inc. believes that no mitigation will be required for this project. The total permanent impacts
under Nationwide Permit # 26 equal 0.21 acres (i.e., less than 1 acre) and the total linear feet of impacts
to streams potentially containing "importance" to significant aquatic function equal zero feet. If for some
reason wetland mitigation is required, our client proposes payment into the North Carolina Wetland
Restoration Fund
NO IMPACTS REQUIRING NOTIFICATION TO THE NCDWQ WILL OCCUR TO THE NEUSE
RIVER BUFFERS THAT EXTEND ONTO THE PROPERTY. The extent of the buffers as indicated on
the attached plans were verified by Mr. Danny Smith of the NC Division of Water Quality on 12/29/97,
but Mr. Smith has not yet sent written confirmation of his determinations.
Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form,
(3) USGS Site Vicinity Map, (3) Construction Plans, (4) Wetland Delineation Forms and (5) a check for
$200.00 to cover the permit application fee.

to visit the site so that someone may accompany you.

across the beaver impounded creek south of this project. This project is being proposed on a separate parcel
of land, is owned by a separate group and has no connective roads or amenities. Therefore, we believe that
this project is a separate and complete project and should not count towards the impacts previously
permitted under the community to the south.
