Dear Mr. Pruitt:
You have our approval, in accordance with the attached conditions, to place fill material in 291 linear feet of streams
for the purpose of constructing a road crossings at Audrey Drive Extension in Gastonia as you described in your
application dated October 6, 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3102. This Certification allows you to use National Permit Number 14 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
-Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

As requested please find enclosed a copy of the City of Gastonia's revised construction plans for Audrey
Dr. extension.
This Project is part of a 35 million dollar bond referendum approved by the Citizens of Gastonia in May,
1990. The Project was requested by the School Board and the PTA of Gardner Park Elementary School to
help them with their school bus traffic. It was subsequently approved by the Citizens Transportation
Advisory Board on March 2, 1993. This project along with a NCDOT thoroughfare that is about 700 feet
west, will allow the school to separate their bus traffic from their vehicular drop off traffic. The NCDOT
thoroughfare is scheduled to begin construction in the next couple of months.
Subsequent to our September 9, 1999 meeting with Mr. Charley Schwartz, we revised our design foot print
to less than 150 feet on each stream ( 149 feet on D4 and 142 feet on D4-1, FEMA tributaries). To
accomplish this we have included provisions to place one foot of rip rap in the invert through out the length
of both culverts, this will be in lieu of the previous rip rap aprons. These revisions have been modeled using
HEC 2 and submitted to FEMA for their approval for a CLOMR.
We feel with these changes, the project now falls under NATIONWIDE Permit No.. 3 Please advise of
your concurrence. Quick response is requested due to the need to complete this project or to May, 2000.

Dear Mr. Crew:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 332
linear feet of streams at Audrey Drive and Realty Court in Gaston County for road crossings. Insufficient
evidence is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are
made as described below, we will have to move toward denial of your 401 Certification as required by 15A
NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your roads with less than 150 feet if impact (culverting and rip
rap) on each channel? Any documentation such as maps and narrative that you can supply to address
alternative designs for your project may be helpful in our review of your 401 Certification. Also this project
will require compensatory mitigation as described in 15A NCAC 2H .0506(h). Your mitigation proposal is
insufficient because none was proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Charley Schwartz Mooresville Regional Office at 919 North Main Street
Mooresville NC 28115. If we do not hear from you-in three weeks, we will assume that you no longer want
to pursue this project and we will consider the project as withdrawn. I can be reached at 919-733-9646 if

Comments:
Charley Schwartz visited the proposed road crossing on September 9, 1999_ As initially designed-
the road would cross two stream channels that merge within 200 feet below the crossing location. It
is not po ibl to move the road crossing downstream to the sinQuiar channe l as there are residential
houses surrounding the site. The road is necessary to allow better traffic flo w to and from the high
school that is located within 1/4 mile of the imposed crossing.
The preliminary road plans specified that the road would impact 332 linea r feet of one channel
and 214 linear feet of the second channel Fish and/or crawfish were indenti fied within each channel
makjng the channels mitigatable if impacts exceed 150' on either. Mr. Schw artz stated to the City's
re?presentatiyes that the stream im an cts appeared large compared to similar ejects and that
rnftagaflon costs would he high (525 feet)- The city said that it would reevalu
- ate the road crossings
