Johnston County SECRETARY -y - Dear Mr. Floyd: On June 28, 1999, I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 99-162. The features represented on the Johnston County Soils and the USGS maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. As a result, it was determined that there are two features present on the property. One feature is r represented on the USGS map in the middle of the field. This feature is not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The feature represented on both the Johnston County Soil and USGS Maps as a stream is subject to protection under the Neuse Riparian Buffer Rule. The map received by this Office on July 29, 1999 details the non subject feature as a wetland pocket. This letter only addresses the applicability of the Neuse Buffer Rules. Subject: Neuse River Basin Riparian Buffer Rules The Village Of Wynchester Project NBRRO 99-163 Wake County bx" , On May 18, 1999, I met with you at the site of the proposed housing development on SR 1010. At your f ; ` xt '? Wiz; request, an evaluation of the features on this property were performed to determine whether the site would X require compliance with the Neuse Riparian Buffer Rules. This feature as indicated on the attached map, received by this Office on July 265, 1999, is subject to protection under the Neuse Buffer Rules. This project is referenced by this Office as NBRRO 99-163. •x: The proposed road crossings will be subject to the protection of this Rule. It appears that the road crossing ' in between lots 31 and 32 could be shifted down to lot 34 and further minimize the impact to the buffered + area. In addition, the road crossing at lot 8 to the cul de sac at lot 9, needs to be made as perpendicularly as possible. Attached you will find a Pre Construction Notification that needs to be filed for the impact of the road crossing to occur before this phase of the development is begun. Please note, depending on the linear feet or acreage involved in this project, there may be jurisdictional wetlands or waters that may require ?_ . concurrence with the Corps of Engineers. This letter only addresses the applicability of the Neuse Buffer Rules.
