Dear Mr. Dinicola
This letter is in response to your application, dated June 7, 2019 to repair the existing gates. No other
construction activities are planned. According to the North Carolina Dam Inventory Database, Hampton
Lake Dam (State ID No. JACKS- 002) is a concrete arch dam that impounds High Hampton Lake in Jackson
County, North Carolina. The purpose of the reservoir is recreation. The drawings submitted to us are
acceptable. The work proposed is exclusively for maintenance to preserve and ensure long term service of
the structure and gates. The objective of this project is to replace the existing outlet flow structure with a
new outlet system that will provide the capability of controlling normal flows, drawing down the lake without
the need for a siphon, and maintaining the required minimum cold -water base flow drawn from the lower
portion of the water column. Please proceed to conduct the repairs as proposed.
1. Project construction shall be supervised by Mr. Walt Dinicola, PE. Mr. Dinicola shall be responsible for
field observation of construction as necessary to ensure compliance with approved plans.
2. During construction, the Division of Energy, Mineral and Land Resources may require progress
reports as are deemed necessary.
3. A minimum flow of 1 cubic ft. per second must be released from the dam site at all times, even
during construction.
4. In accordance with GS 143-215.29 and 15A NCAC 02K .0203, .0212, .0215, and .0216, within 30
days of completion of the project, Mr. Dinicola shall inspect the completed work and upon finding that
the work has been done as specified, minimum stream flow requirements have been satisfied, and
the dam is safe, shall file with the Division of Energy, Mineral and Land Resources two sets of record
drawings and a certificate stating that the work has been completed in accordance with approved
plans, specifications and other requirements.

S. Prior 6issuance of final written consent for use of this dam pursuant to these modifications, the
requirements of Session Law 2014-12Z Section 8, as revised by Session Law 2015-7 must be met.
Session Law 2015-7 requires all owners of high and intermediate hazard dams to submit an annually
updated Emergency Action Plan (EAP) to the NC Department of Environment and Natural Resources
and the NC Department of Public Safety. More details regarding this requirement may be found

6. All trees and/or brush less than six inches in diameter at breast height should be removed either by
excavation or putting flush to the ground. All trees larger than six inches In diameter at breast height
should be removed as well but requires an engineering plan to be submitted to Dam Safety for review
and approval before removing them. FEMA 534 "Technical Manual for Dam Owners, Impacts of
Plants on Ear#ban Dams" should be used as guidance.
7. No water shall be Impounded behind the dam until final approval for operation of this dam is issued
by the Division of Energy, Mineral and Land Resources. Also, draining of the lake shall be performed
in such a manner as to preclude off -site sedimentation.
8. An operation and maintenance (0&M) plan are required for all high hazard dams. The 0&M plan
should address routine maintenance, frequency of plezometer readings, frequency of Inspections by
the owner or the owner's representative, and annual operation of the bottom drain to ensure that it Is
functional. The 0&M plan must be received prior to issuance of final written consent for use of this
dam pursuant to these repairs.
9. This approval does not convey the right to access the private property of others. Any required access
to perform the approved work must be secured prior to initiation of construction activities.
10. You must notify Mr. Stan Aiken, PE, Regional Supervisor, Land Quality Section, at 2090 US HWY 10,
Swananoa, NC 28778 or 828-296-4610 within ten days before the start of construction.
Water control activities may be required to complete the approved repairs may Involve the diversion and
discharge waters to discharge points. The Army Corps of Engineers and Division of Water Resource should
be contacted if additional permits are required. In any case, sediments must be prevented from entering
the water; of the State or flowing into neighboring properties. Also, the erosion and sediment corrtrol
program having jurisdiction should be contacted to determine plan approval requirements.
