HAROLD CLARK OF WESTERN SAND CORPORATION, 559 COWEE SCHOOL ROAD, FRANKLIN, NORTH CAROLINA 28646 has applied for a Department of the Army (DA) permit TO UNDERTAKE COMMERCIAL SAND DREDGING IN THE LITTLE TENNESSEE RIVER (LAKE EMORY) AT APPROXIMATELY RIVERMILE 113.5 UPSTREAM OF THE LAKE EMORY DAM in Franklin, Macon County, North Carolina. (Note: Lake Emory Dam and lake bottom are owned by Duke Energy, operating as Nantahala Power. It will be necessary that the permit applicant finalize a lease agreement with Nantahala Power in order to conduct any dredging operations at the proposed location). The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show the excavation of approximately 500 tons per operating day of commercial sand from the main channel area within Lake Emory. The channel length through the proposed dredge area extends approximately 3,500 linear feet upstream of the Lake Emory Dam. Information provided by the applicant indicates there may be upwards of approximately 1,300,000 cubic yards of commercial sand available within the proposed dredging area. A 10-inch hydraulic dredge with a 235 horsepower diesel engine will be used to excavate/mine sand to a maximum depth of approximately twenty feet. Dredged material will be pumped to a one acre processing and storage site off of Clyde Downs Road. The material will be separated and graded by use of an 80 foot long specially designed sluice box. Liquid effluent from the sluice box will be directed to a 20 foot wide and 50 foot long sediment retention basin. Water from the basin will be discharged into Lake Emory through a 24-inch diameter overflow pipe into additional piping that will be temporarily placed in the bed of a small intermittent tributary to Lake Emory. The applicant proposes to construct a 2-foot high clay berm around the plant site to direct all surface flows to the retention basin. In addition, a 25-foot wide undisturbed vegetated buffer will be left in place between the upland plant/storage site and the lake. A dredge access channel approximately 100 feet in length, 40 to 50 feet wide, and 10 feet in depth will be dredged from the material processing and storage site to adjoining deep water near the Lake Emory Channel. The purpose of the project is to mine commercial sand to be marketed for road and other construction activities. The applicant indicates the project will restore water and sediment storage capacity upstream of the dam and improve aquatic habitat. Project plans showing the proposed work are included with this public notice. States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. . The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Water Quality (NCDWQ) plans to take final action in the issuance of the Clean Water Act certification on or after September 23, 1999. Stevens, Director NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES August 8, 1999 Macon County DWQ Project # 990829 Approval of 401 Water Quality Certification Harold Clark 559 Cowee School Road Franklin, NC 28734 Dear Mr. Clark: You have our approval, in accordance with the attached conditions, to place fill material for the purpose of stockpiling, as you described in your application dated July 21, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification number 3103. This Certificate allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permit before you go ahead with your project including (but not limited to) Sediment and Erosion, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying wit all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this Certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statues to the Office of Administrative Hearings, PO Box 27447, Raleigh, NC 276 1 1-7447. This Certification and its conditions are final and binding unless you ask for hearing. - This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
