Due to the location of the on site streams and wetland, opportunities to avoid these areas were limited. Impacts to site surface waters associated with the proposed development were limited through site selection, location, design, & location/orientation of the proposed lots and access routes. The single road crossing is required by the City of Belmont and the crossing location is dictated by the location of the existing road connection on Rachel Anne Drive. The road crossing has been narrowed to the minimal allowable width per City of Belmont requirements. Construction techniques will implement approved erosion control methods to avoid/minimize impacts to onsite/adjacent offsite receiving conveyances. Stabilizing riprap below the crossing has been designed to meet Belmont's requirements. One sidewalk has been removed and the other has been pushed as close to the road as possible. Wherever possible, 2:1 slopes are used. The required sewerline crossing will be made by directional boring to avoid additional impacts. Gaffney July 10, 2019 Amberley Subdivision – Threatened / Endangered / Protected Species Evaluation 2 GENERAL LANDSCAPE DESCRIPTION: The Amberley Subdivision Site (+/- 83 acres) is located just northwest of Nixon Road, west of South New Hope Road, and just east of the South Fork Catawba River, in Gaston County, North Carolina. It can be found on the Belmont, NC USGS Topographic Quadrangle Map; latitude is 35.2211 N, longitude is -81.0509 W. The site is primarily covered with pine dominated woodlands on the uplands grading into mixed hardwoods on lower slopes and drainages; dirt roads and trails; and is disturbed throughout. The topography is gently to moderately sloped with the elevation ranging from 600 to 710 ft. (Figure 1). Figure 1: Amberley Subdivision – Threatened / Endangered / Protected Species Evaluation 3 METHODOLOGY: The US Fish and Wildlife Service website http://www.fws.gov/endangered/ was referenced to determine the occurrence of Threatened, Endangered and Protected species for Gaston County North Carolina, the results of which are listed below (Table 1). Maps and aerial photographs were assembled, and the site was investigated during the week of July 1, 2019. Now most occurrences are limited to roadsides, woodland and field edges, and utility rights-of-way (ROW). •Dwarf-flowered Heartleaf (Hexastylis naniflora), listed as Federally Threatened, grows in acidic soils along bluffs and adjacent slopes, in boggy areas next to streams and creek heads, and along the slopes of nearby hillsides and ravines. Three animal species with federal protection are listed as potentially occurring in Gaston County: •Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabits forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers, where there are suitable fish populations and tall trees for nesting and roosting. •Bog Turtle (Glyptemys muhlenburgii), Bog turtles live in the mud, grass and sphagnum moss of bogs, swamps, and marshy meadows. These wetlands are usually fed by cool springs flowing slowly over the land, creating the wet, muddy soil needed by the turtles. •Northern Long-eared Bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non-reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. Amberley Subdivision – Threatened / Endangered / Protected Species Evaluation 5 RESULTS: The site is primarily covered with pine dominated woodlands on the uplands grading into mixed hardwoods on lower slopes and drainages. There are dirt roads and trails and much of the site is disturbed. There is a power line right of way traversing northwest – southeast through the western half of the site. The uplands are covered with Pine (Pinus spp.) dominated stands with successional hardwoods mixed within the canopy and subcanopy, and grades into a hardwood dominated forest on the slopes and drainages. Some of the largest trees are over 2 ft. in diameter, with the average diameter at breast height (DBH) at 10”. Canopy trees include Loblolly Pine (Pinus taeda), Virginia Pine (P. virginiana), Shortleaf Pine (P. echinata), Sweetgum (Liquidambar styraciflua), Yellow Poplar (Liriodendron tulipifera), American Beech (Fagus grandifolia), White Oak (Quercus alba), Northern Red Oak (Q. rubra), Southern Red Oak (Q. falcata), Black Oak (Q. velutina), Willow Oak (Q. phellos), Post Oak (Q. stellata), Mockernut Hickory (C. tomentosa), and Pignut Hickory (C. glabra). The subcanopy contains Sourwood (Oxydendrum arboreum), Ironwood (Carpinus caroliniana), American Holly (Ilex opaca), Red Maple (Acer rubrum), Eastern Red Cedar (Juniperus virginiana), Flowering Dogwood (Cornus florida), Hackberry (Celtis laevigata), Redbud (Cercis canadensis), Red Mulberry (Morus rubra), Black Gum (Nyssa sylvatica), Winged Elm (Ulmus alata), and Black Cherry (Prunus serotina). More mesic areas also feature Big-leaf Magnolia (Magnolia macrophylla) and Chalk Maple (Acer leucoderme).The shrub layer is dominated by Autumn Olive (Elaeagnus umbellata); other species present include Spicebush (Lindera benzoin), Blueberry (Vaccinium sp.), Paw Paw (Asimina triloba) and Chinese Privet (Ligustrum sinense). Vines present are Catbrier (Smilax spp.), Japanese Honeysuckle (Lonicera japonica), Crossvine (Bignoinia capreolata), Trumpet Creeper (Campsis radicans), Virginia Creeper (Parthenocissus quinquefolia), Muscadine (Vitis rotundifolia), Bay Star-vine (Schizandra glabra) and Poison Ivy (Toxicodendron radicans). The herb layer is sparse on the drier uplands and slopes, becoming denser on the lower slopes and drainages, and includes Christmas Fern (Polystichum acrostichoides), Crane-fly Orchid (Tipularia discolor), Little Heartleaf (Hexastylis minor), Spotted Wintergreen (Chimaphila maculata), Grapefern (Botrychium sp.), and Japanese Stiltgrass (Microstegium vimineum). The assemblage of plants growing in the transitional edges of the woods, , disturbed dirt roadsides and power line rights of way includes Broomsedge (Andropogon virginicus), Plume Grass (Erianthus contortus), Johnson Grass (Sorghum halepense), Indian Grass (Sorghastrum nutans), Japanese Stiltgrass (Microstegium vimineum), Love Grass (Eragrostis sp.), Gamma Grass (Tripsacum dactyloides), Purple Top (Tridens flavus), Panic Grass (Panicum sp.), Sericea Lespedeza (Lespedeza cuneata), Dog Fennel (Eupatorium capillifolium), Ragweed (Ambrosia artemisiifolia), Curly Dock (Rumex crispus), Goldenrod (Solidago sp.), Blackberry (Rubus sp.), Chinese Privet (Ligustrum sinense), Amberley Subdivision – Threatened / Endangered / Protected Species Evaluation 6 Winged Sumac (Rhus copallina), Japanese Honeysuckle (Lonicera japonica), Brazilian Verbena (Verbena brasiliensis), Rabbit Tobacco (Gnapthalium obtusifolium), St. John’s Wort (Hypericum sp.), Tickseed (Bidens sp.), and Poke Weed (Phytolacca americana). The north and western facing slopes above the unnamed tributary on the northern perimeter of the site are a part of an identified Natural Heritage site as described in the Gaston County Natural Heritage Inventory, December 2000. This area was noted for its species diversity and the presence of regionally unusual or rare plants, namely Big Leaf Magnolia (Magnolia macrophylla), and Bay Star-vine (Schizandra glabra) . Threatened & Endangered/Protected Species Results • All potential habitats for Schweinitz’s Sunflower and Dwarf-flowered Heartleaf were closely examined and these species were not observed. • No Bald Eagles were seen nor were any nesting sites observed. • The site has no suitable habitat for Bog Turtles. No individuals were observed during the survey nor would any be expected on-site. • Comparing the site location to the USFWS Asheville office’s website (http://www.fws.gov/asheville/htmls/project_review/NLEB_in_WNC.html) it appears that the site meets the “exempt” criteria which requires no further action under section 7 of the Endangered Species Act for the northern long eared bat. RECOMMENDATIONS: Based on the site investigation and the review of available data, WEPG did not identify any protected species occurring on the subject property.
