The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please provide the Division a copy of your response to the December 3, 2019 email from the U.S. Army Corps of Engineers (USACE) requesting additional information. [15A NCAC 02H .0502(c)]. 2. Please note that the City of Greensboro is the regulatory authority for the Jordan Lake Riparian Buffer Rule. Since the project includes development activities within the protected buffer that are not designated items within the Table of Uses in 15A NCAC 02B .0267, please provide a copy of the Buffer Approval from the City. The PCN indicates that this project "does not require a stormwater management plan". However, the justification for the requested impacts are for final development. You may either request approval for access to the property for another purpose (please note that avoidance and minimization is determined based on the project purpose), or update Section E. of the PCN form to indicate the project is for development. A stormwater management plan reviewed and approved by the local government is a requirement of Condition 1.5 of 401 Water Quality Certification #4139. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
