Stevens, Director 1 ?• NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES October 7, 1999 Wake County WQC 401 Project # 990764 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules Kenneth Close Camp Branch Associates 426 Fincastle Drive Raleigh NC 27607 Dear Mr. Close: You have our approval, in accordance with the attached conditions, to place fill material in 507 linear feet of streams and 0.1285 acres of wetlands for the purpose of constructing road and utility crossings at West Lake Road/Jamison Park Site, as you described in your application dated July 22 and August 26, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3108. These Certifications allow you to use Nationwide Permit Numbers 12 and 26 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that stormwater shall be directed to sheetflow at non-erosive velocities through the protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Division of Water Quality - DEHNR Attn: Mr. John Dorney 4401 Reedy Creek Road Raleigh, NC 27607 Dear Sirs: The purpose of this letter is to request the use Nationwide Permits 26 and 12 and confirmation of compliance with the Neuse River Buffer Regulations for the construction of the proposed Jamison Park Subdivision located on the west side of Westlake Road (S.R. 1387) approximately 0.65 miles north of its intersection with Optimist Farm Road (S.R. 1390) (see site vicinity map)(UTM Coordinates; Zone 17, 3949500 N, 702200 E). Proposed impacts to waters for the construction of the residential subdivision will total 0.1285 acres and 507 Lf. (263 LE of significant channel) for the construction of three road crossings and five sewer line crossings to gain access to home lots on the western portion of the property. Of the 263 linear feet of impacts to the significant channel, five sewer line crossings make up 133 linear feet (covered under Nationwide Permit 12) and one road crossing consists of 80 Lf, of pipe and 50 Lf of dissipater pad (covered under Nationwide Permit 26). Previous impacts to wetlands contained on property (permitted by Corps Action I.D. # 199920110) totaled 0.329 acres and there were no impacts to channels. Construction of the subdivision will comply with the general conditions stated within Nationwide Permits 26 and 12. S&EC, Inc. believes that no wetland or stream mitigation will be required for this project because the road crossing of the significant channel is less than 150 linear feet ( within the limits of Nationwide Permit 26) and the sewer line crossings covered under Nationwide Permit 12 typically do not require mitigation. For this application the total permanent impacts under Nationwide Permit 26 equal 0.0580 acres and the total linear feet of impacts to streams potentially containing "importance" to significant aquatic function is less than 150 feet. The total amount of impacts under Nationwide Permit 12 equal 0.0705 acres an to 1 linear feet of impacts to streams containing "importance" to significant aquatic function 133 eet. If for some reason wetland mitigation is required, our client proposes payment into the North na Wetland Restoration Fund. The surface waters subject to the Neuse River Buffer regulations (15A NCAC 213 .0233) outside of the large floodplain, were determined on November 23, 1998 by Mr. Danny Smith and Mr. Charles Brown of the NC Division of Water Quality (DWQ). S&EC, Inc. believes that no mitigatiommill be required for Neuse River Buffer impacts because 148 linear feet or less of the riparian buffer lll tc]isturbed per stream (i.e. below the 150 linear footage threshold required for road crossings) d loss thair 1/3 of an acre per stream. The proposed impacts due to perpendicular sewer line cross' all less than 40, linear feet per crossing. With the exception of perpendicular crossings, the "line only enters buffer zone 2 six times with a combined impact of 0.182. With the exception of, r?pendicular crossings, no impacts to Zone 1 are proposed The proposed impacts are allowed un r the current Neuse River Buffer regulations without requiring a variance from the Environmental Ma went Commission arid without buffer mitigation.
