After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. This Certification is also covered by Nuese River Buffer Rules. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I have re-computed the " C ' value for the built-out condition which has raised the value to 0.35. Using that value the peak.flow increased to approximately. 124 cfs for*the 100-yr storm event. I calculated the required cross-sectional area in the natural stream channel and have., shown that in the drawing provided with this submittal. Depending on the natural shape of the channel, and the related wetted perimeter, the required area is approximately 32 to ' .35 sqf, However, upon placing the proposed bridge and supports in the channel, and using an improved 'W' value for the bridge section, the required area is reduced to something in the range of 18 to 21 sgft with an increase of head of a maximum of 1.2 ft. at any section. All calculations represent the use of Manning's Equation for open channel flow. As requested, stream cross-section information, at the locations of the anticipated crossings, has been provided. This information is from the information received from Jim Murphy, RLS, PE. Also, you will see that Lot 1 does directly access the public road without the use of an easement. The width of flow in natural conditions at sections 1,2 & 3 is 19', 41' & 28', respectively. The maximum increase in height of flow will occur at crossing 42 and will be only 1.2' through the bridge section. The steep grade on the channel (6 - 7%), with this small increase in head, will greatly reduce or eliminate back-water upstream. 446 East Main Street -PO.
