IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built-upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwa ter management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

General
Trinity Avenue Presbyterian Church in Durham, N.C., proposes to place fill material in
330 feet of stream for the purpose of installing a box culvert and expanding the existing
Church. The project was approved on July 28, 1999, for 401 Quality Certification. The
project has been previously assigned DWQ Project #990726.
A storm water sand filter will be constructed to treat storm water runoff from the new
church addition and from the new parking lot. The below ground filter will be located
between the new addition and Trinity Avenue. The filter has been placed below ground
due to site limitations and the desire to limit visual impacts on the site. Two large access
hatched have been provided for maintenance.
Desisn
The sand filter has been designed based on guidelines included in the April 1999 revision
of the "Storm Water Best Management Practices" by NCDENR. The sand filter is
designed to remove 85% of Total Suspended Solids. The filter will not be effective at
removing total dissolved solids or nitrate-nitrogen. The sand filter is designed to treat the
runoff from the first inch of rainfall from a storm.
There is a drainage area of 0.52 acres to the filter. The drainage area has a composite "C"
value of 0.83 (0.19 acres at 0. 8, 0.14 acres at 0.9, 0.02 acres at 0.4, 0.10 acres at 0. 8, and
0.07 acres at 0.95).
The filter is required to have storage equal to the runoff from a one-inch storm. The
required storage by the rational method is 0.52 acres X 0.83 X 43,560 sf/acre X 1" X
1'/12" = 1567 cf. The overflow weir in the filter is located 2.25' above the top of the
sand. The provided storage is 2.25' X 12' X 60.5' = 1634 cf.
The drainage area to the sand filter is comprised of 0.31 acres of impervious surface and
0.21 acres of pervious surface. The percent impervious (I) is 60%. The runoff coefficien
(Rv) is equal to 0.05 + 0.009*60 = 0.59. The runoff volume calculated by the "Simple
Method" is equal to 1 inch rainfall * 0.59 in/in * lft/12in * 0.52 acres * 43560 sf/acre =
1114 cubic feet. The runoff volume calculated by the "Simple Method" is less than the
volume calculated by the Rational Method.
The sediment chamber and the sand filter both have a surface area of 360 sf (12' X 30').
Both chambers are 18" deep and have a volume of 540 cf.
Maintenance
The sand filter must be inspected at least once a year after a storm to determine if the
filter bed is passing the runoff as expected. Maintenance should be performed when
storms of approximately one inch are passing through the filter with in 24 hours.
Maintenance for the filter consists of removing the first 2 or 3 inches of discolored sand
and replacing it with new sand. The sediment chamber should be cleaned out at the same
time maintenance is performed on the sand chamber.
Two large access hatches are provided to facilitate maintenance operations. One hatch is
over the sediment chamber, and the other is over the sand chamber. Should it be
necessary to gain full access to the sand filter, the top slab can be removed.

SAND FILTER OPERATION AND MAINTENANCE AGREEMENT
At least once a year inspect the filter after a runoff-producing storm. Maintenance is
required to be performed when storms of approximately one (1) inch are not passing
through the filter in a 24-hour period.
2. Remove the top 2"-3" of discolored sand from the top of the filter and replace it with new
sand when maintenance is required.
3. Pump and clean the sediment chamber each time that maintenance is performed on the
sand filter. When the sediment chamber is cleaned, it should be returned to the original
design dimensions.
4. Inspect the outlet structure at least monthly for blockages and deterioration. Remove any
blockages and maintain the structure as originally designed.

You have our approval, in accordance with the attached conditions and those listed below, to place rill material in 330 feet
stream for the purpose of expanding an existing church (Trinity Avenue Presbyterian Church), as you described in your
application dated 6 July 1998. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of
Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In, addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to), Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
I. An additional condition is that a final, written storm plan including a wet detention basin must be
approved by DWQ before wetland (or stream) impacts occur. Also before any building is occupied at
the subject site the stormwater treatment facilities shall be constructed and operational and the
stormwater management plan be implemented.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-744 7. This certification and
its conditions are final and binding unless you ask for a hearing.

Dear John:
Enclosed is an application for a 401 Certification for Trinity Avenue Presbyterian Church,
Durham, Durham County, North Carolina. Trinity Avenue Presbyterian Church proposes to place 330
feet of an unnamed, intermittent tributary of Ellerbe Creek in a culvert in order to allow expansion of
the existing church facilities. The stream also is an existing health and safety hazard (see below). The
U.S. Army Corps of Engineers has authorized this project under Nationwide Permit No. 26 (8 June
1999).
The USGS topographic quadrangle and Durham County Soil Survey show no intermittent and
perennial stream at this location. Therefore, we believe that the new Neuse River Buffer Rule does not
apply.
Most of the stream channel is culverted beneath Durham except for this section between Trinity
and Minerva Avenues. The channel bisects the church property. A fenced playground is located
immediately adjacent to a section of the creek. A child could scale the fence and, because the bank
beyond the fence is very steep, fall in the creek and be swept into the culvert. Water in the creek is
urban stormwater runoff and judging from odor, is mixed with sewage. The channel has a granite
bottom and no jurisdictional wetlands border it.
Based upon the meeting between Mr. Jim Petrea, representing the Church, and you on 14 June
1999, the Church proposes to conduct onsite stormwater management to treat runoff from the new
impervious surfaces created by this project. A stormwater management plan using best management
practices will be submitted for DWQ approval.

Still do not like allowing people to culvert
streams. That being said... although this piece
does not show up on either of the maps, it is at
least marginally perennial. The sad aspect is
that it is hammered by the city of Durham as it
passes underneath of it. The biological integrity
is barely there. Several univalve mollusca
(snails), a few hydropsychides (caddisflies),
and oligochaetes (worms). At best, a poor
assemblage of extremely tolerant species. Would
be nice to be able to mitigate but stormwater
would work also. Whatever

On April 8, I met with you at the subject site and conducted a site visit. This project is referenced by the
Raleigh Regional Office as NBRRO 99-091. It was determined that the unnamed tributary to Ellerbe Creek
is an intermittent stream and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters
Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code
T15A:02B.0233 (NCAC 0233).
The line delineating the forested vegetation varies from non-existent to thirty feet in width. Please be
reminded that the riparian buffer is protected in two zones totaling fifty feet of protection where forest
vegetation exists. In accordance with the Rule, sheet flow from stormwater must be maintained, to the
maximum extent practical, through dispersing concentrated flow and/or re-establishment of vegetation to
maintain the efficacy of the riparian area.

The Division of Water Quality has reviewed your submittal for a 404/401 Permit for culverting of 330
feet of stream at Trinity Avenue Presbyterian Church in Orange County. Your application was not complete since
seven copies of the joint application form and a check for 475.00 for the certification fee were not included. Finally a
variance form the N.C. Environmental Management commission will be needed to allow this project. Please contact
Mr. Pete Colwell of my staff at 919-733-1786 in this regard. Please provide information regarding the location of
your project. This information is needed by DWQ in order for us to decide whether this project is approvable.
Please respond with three weeks of the date of this letter by sending us the appropriate information. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
I can be reached at 919-733-1786 if you have any questions. Until this information is received, I will
request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, the project will be placed

Enclosed is an application made pursuant to compliance w? -tlie'Neiise River Buffer (NRB)
Rules for a project in Durham, Durham County, North Carolina. Trinity Avenue Presbyterian Church
proposes to place 330 feet of an unnamed, intermittent tributary of Ellerbe Creek in a culvert in order
to allow expansion of the existing church facilities. The stream also is an existing health and safety
hazard (see below).
The USGS topographic quadrangle and Durham County Soil Survey show no stream at this
location. Most of the channel is culverted beneath Durham except for this section between Trinity and
Minerva Avenues. The channel bisects the church property. A fenced playground is located
immediately adjacent to a section of the creek. A child could scale the fence and, because the bank
beyond the fence is very steep, fall in the creek and be swept into the culvert. Water in the creek is
stormwater runoff and judging from odor, is mixed with sewage. The channel has a granite bottom
and no jurisdictional wetlands border it.
Mr. Steve Mitchell (DWQ) visited the property on 8 April 1999. He felt that the Neuse River
Buffer (NRB) Rules applied and we agreed on a line delineating the "forest" vegetation. Most of the
vegetation is non-native (mostly Asiatic) and several sizeable areas have no vegetation adjacent to the
channel. Mr. Mitchell indicated that a 401 Water Quality Certification would not be required. He
suggested that a wet stormwater basin would be required to offset unavoidable impacts to forest
vegetation. However, a stormwater pond is not possible due to the small size of the property. Such a
pond would also create a safety hazard.
He indicated that the Church could propose to pay, a compensatory mitigation fee to DWQ in
lieu of pursuing a waiver of the NRB Rules (approximately $1.00 / sq. ft.). The NRB Rule area,
including the stream channel, is 11,560 sq. ft. Therefore, Trinity Church proposes to mitigate the
impact via payment of $11,560.00 to the State of North Carolina.

It is our hope that we can find a solution that allows our church to meet some very critical
building expansion mquirements, alleviate a safety hazard for our children, and to support the
environmental obligations of our community. Since this is such a small unpipcd section of a
larger city storm water system with minimal natural vegetation, we believe the impact to the
Neuse River can be affect. Of the options we were presented with, mitigation appears to be the
most reasonable.
Like many urban churches the options for expansion on the existing campus are limited.
However, it is the mission of our church not to move away from our community of ministry;

proposal will be challenging to our budget, but if required we will find a means to satisfy that

Dear John:
Enclosed is an application for a 401 Certification for Trinity Avenue Presbyterian Church,
Durham, Durham County, North Carolina. Trinity Avenue Presbyterian Church proposes to place 330
feet of an unnamed, intermittent tributary of Ellerbe Creek in a culvert in order to allow expansion of
the existing church facilities. The stream also is an existing health and safety hazard (see below). The
U.S. Army Corps of Engineers has authorized this project under Nationwide Permit No. 26 (8 June
1999).
The USGS topographic quadrangle and Durham County Soil Survey show no intermittent and
perennial stream at this location. Therefore, we believe that the new Neuse River Buffer Rule does not
apply.
Most of the stream channel is culverted beneath Durham except for this section between Trinity
and Minerva Avenues. The channel bisects the church property. A fenced playground is located
immediately adjacent to a section of the creek. A child could scale the fence and, because the bank
beyond the fence is very steep, fall in the creek and be swept into the culvert. Water in the creek is
urban stormwater runoff and judging from odor, is mixed with sewage. The channel has a
bottom and no jurisdictional wetlands border it.
Based upon the meeting between Mr. Jim Petrea, representing the Church, and yo 4 Jurie
1999, the Church proposes to conduct onsite stormwater management to treat runoff fro nev?y
impervious surfaces created by this project. A stormwater management plan using best gernt a

The Wetlands Unit staff reviewed the stormwater management plans for the subject project and determined
that additional information is necessary to complete the technical review process. The required additional
information is as follows:
Requirement for a Wet Detention Basin
The 401 Water Quality Certification issued July 28, 1999 specified that a wet detention basin be used to
treat the stormwater from the subject site. The plans propose a sand filter. In our meeting with the
applicant/applicants representatives on June 14, 1999 options discussed for stormwater management
included bioretention, a wet detention basin, or an extended detention wetland. As such, any of these will
be acceptable. However the sand filter is not acceptable.
Drainage Area
The drainage area to be treated must include all of the new impervious area or an equivalent amount of
existing and new impervious area.
Division Wetlands Unit staff will strive to complete a final technical review within 10 working days of

Remarks:
Todd, attached is the boring report for Trinity Avenue Presbyterian Church. Bore B-5 appears to be
the closest to the proposed location of the bioretention area/sand filter. Partially weathered rock was
encountered 3.5 feet below ground level and auger refusal at 3.8 feet. The approximate ground
elevation at that point is 346. The top surface of the proposed bioretention area is 343.6. It looks
like a couple of feet of rock would have to be removed to make the bioretention area. Let me know
if you need any more information.

Please find attached a Stormwater Plan for a grass Swale and pocket wetland at Trinity Avenue
Presbyterian Church. The plan includes a revised original and one copy of pages 2 and 3 the
Stormwater Management Application Form, a revised narrative of the stormwater
treatment/management plan, and two sets of the revised grading plan and planting plan for the
project.
We have eliminated the sand filter from the Storm Water Plan and have included a grass Swale and
pocket wetland. The revised Stormwater Management Application Form pages, narrative and
grading plan reflect these changes.
The grass swale and pocket wetland treat storm water runoff from on-site and off-site impervious
areas. Grass swales are proposed along the Church's south property line and between the proposed
building and parking lot. The grass swales will convey_stor_rttwater from an offsite parking lot and
from roof leaders to the pocket wetland. e new parking o rains tot the pocket wetland.

General
Trinity Avenue Presbyterian Church in Durham, N.C., proposes to place fill material in
330 feet of stream for the purpose of installing a box culvert and expanding the existing
Church. The project was approved on July 28, 1999, for 401 Quality Certification. The
project has been previously assigned DWQ Project #990726.
The Church proposes to build grass swales and a pocket wetland to treat stormwater
runoff from the new church addition and from the new parking lot. The grass swale is
located in front of the proposed fellowship addition. The pocket wetland is located
between the proposed fellowship addition and Trinity Avenue.
The expansion and renovations by the Church will create 19,452 sf of additional
impervious area on the site. The dry detention basin will treat 12,186 sf of the new
impervious area and 7,320 sf of an existing off site parking lot south of the proposed
construction.
Design
The grass swale and the pocket wetland have been designed based on guidelines included
in the April 1999 revision of the "Storm Water Best Management Practices" by
NCDENR. The trapezoidal grass swale is over 100 feet long. The swale has 4:1 side
slopes, a variable width bottom, and a slope that varies from 2% to 4%. The pocket
wetland has been sized to capture the runoff from a 1" storm and release it over a period
of 66 hours.
The bottom width of the grass swale and its longitudinal slope increases along its length.
The velocity of the two year peak flow was checked to verify that it is less than 2 ft/sec.
The analysis checked a section with a 10' bottom width and a slope of 4%. The 2 year
peak flow was calculated by the rational method. The calculation is as follows: Q = CIA
= 0.75 X 5.76 in/hr X 0.42 acres = 1.81 cfs. The velocity in the channel was calculated to
be 1.94 ft/sec.
The grass swale is required to have a minimum length of 100 feet per acre of drainage
area. The total drainage area to the pocket wetland is 0.80 acre. The grass swale is over
100 feet long,
The pocket wetland is sized to capture the runoff from a 1" rainfall and release it over a
period of 2 - 3 days. The "simple method" was used to determine the amount of runoff
from a 1" rainfall. The drainage area to the basin is 33,616 sf. The drainage area is 58%
impervious. Rv = .05 + .009I = .05 +.009 *. 5 8 = 0.57 in/in. Volume = 1" * 0.57 in/in * 1
ft/12 in * 33,616 sf = 1597 cf. The provided storage in the pocket wetland was calculated
by the average end area method. The provided storage is 1633 cf between elevation
344.0 and the permanent pool elevation of 342.3.
The outlet structure for the pocket wetland is a raised cover catch basin with a weir
elevation of 344.0. A reverse siphon draw-down tube is constructed of 4" flanged ductile
iron pipe. A plate with a'/z" diameter orifice will be installed between two of the flanges
to act as the restriction.
Maintenance
The grass swale will be mowed at least twice annually to a maximum height of six
inches. At least once annually, excess sediment will be removed from the swale to
maintain original contours and grading. At least once annually, erosion will be repaired
and the swale will be regraded to ensure that the runoff flows evenly in a thin sheet. The
vegetation will be inspected at least once annually and will be revegetated to maintain a
dense growth of vegetation.
The pocket wetland must be inspected annually after a rain event to ensure that it is
operating as designed. The outlet structure should be inspected to insure that it is not
clogged, nor that it has been damage to allow too rapid a release of water. The banks and
areas around the inlet and outlet should be inspected for erosion. The amount of
sediment accumulation should be noted and removed as necessary. Debris should be
removed from the basin whenever it accumulates, or at least twice annually.

additions to the exlstlny Trinity Avenue Presbyterian Church located in Durliani, Nol-tli
Carolina. Subsurface conditions at the site were investigated by perfornling 9 soil test
honn?'s at the approxitllate locations indicated on the attached site plan. The test borings
werc located in the. Feld by measuring distances and estimating right ankles froth
adjacent roadways and structures. As such, the indicated boring locations should lie
considered as approxitllatc. The test boring depths range from approximately 2 to 10 feet
below existing ground surface and all borings wore sampled at selected intervals using
standard penetration test procedures designated in ASTM D-15$6. This report presents
the findings of the. investigation and our recommendations For site grading and foundation
support hased on these findings.
SITE AND PROJECT DESCRIPTION
The proposed project site is located at the southeast corner of the intersection of
'Crinity Avenue and (sregsott Street in Durham, North Carolina. The project will involve
an addition to the east side of the existing Trinity Avenue Presbyterian Church. The
addition will extend out across an existing creek, which will be piped under the proposed
building through a box culvert, and on into a vacant lot located fl,rthor towards the cast.
No detailed inforniation concerning structural loads was av4tilahle at this time; however,
we anticipate that MaXIrnUm c01311111 loads will not exceed 100 kips. We understand that
finished floor elevation for the structure will be sot at approximately elevation 350 which
will require the majority of the pad to bo filled with the exception of ilic far eastern
comer where son)e cut will be required.
SUBSURFACE CONDITIONS
A generalized suhsurtace profile prepared ti-onl the test boring data is attached to
this report as Figure 2 to -graphically illustrate subsurface conditions encountered at this

site. Nlore detailed descriptions of the conditions encountered in the individual test
boring ry locations are then presented on the attached test boring; records.
The subsurface profile encountered at this site is somewhat variable in the upper
few Feet. Some Of' the borings encountered near surface topsoil while other borings
encountered till materials. The deepest till sections were encountered in those borings
located along the east side of the existing building and appear likely to be associated with
hacktill trom the existing basement level. Underlying the topsoil and near surface fill
and alluvium, the borings encountered residual soils typically comprised of sandy and
silty clays and silty sands. With increasing depth the soils typically transitioned to
partially weathered rock (pwr). Penetration resistances within the near surface fill and
alluvium were relatively low generally in the range of 4 to 8 blows per foot (bpt).
Penetration resistance within the underlying residual silts, clays and sands were generally
higher ranging From 10 to 34 bpf. Penetration resistances within the pairtially weathered
rock were in excess of 100 bpf. The depth to partially weathered rocs: varied from as
shallow as 1.5 feet at boring 134 to as deep as 10 feet in boning B-2. t lovvever, the pwr
was generally in the range of 3 to 5 feet in depth. Auger ref isal was encountered on
Much more. competent rock at relatively shallow depths. Auger refusal depths ranged
from as shallow as 2 feet in boring B-8 to as much as 10 Feet in horings B-2 and B•9.
However, the majority of the borings encountered auger refusal at depths of
approximately 3 to 5 feet below existing ground surface.
Croundwater was not encountered in the majority of the borings at the time of
boring completion. An exception was at borings B-Z and B-9, which w?erc; the only
horings that penetrated below depths of approximately 5 to 6 feet. Groundwater in those
borings ranged from approximately 8.5 to 9 feet below existing ground surface.
However, due to the tine grained near surface soils, the site is conducive to the
development of a temporarily higher perched groundwater condition following periods of
inclement weather. Additionally, regional groundwater levels will tluetuatc with
seasonal and climatic changes and may he diftcrent at other tinges.
RECOMMENDATIONS
The following recommendations are based on a review of the attached test boring
records, our understanding of the proposed construction, and past expcricrice with similar
projects and subsurface conditions. If structural loads will be significantly heavier than
those anticipated, we would appreciate all opportunity to review and comment upon the
recommendations of this report so that they may be confiniVd. extended, or modified as
necessary. Additionally, if subsurface conditions adverse to those indicated by this report
arc encountered during construction, those conditions should be reported to its for review
and comment.
Site Gradfij (:onsiderations. The soils It existing; grade arc n-toisture sensitive;
and will be difficult to compact during the typically wetter wither months of December
through April or May. To avoid delays during site grading operations, we recommend
that earth work activities be scheduled aftcr May and prior to December it'possibte, in
order to facilitate site grading work.

Sitc grading should begin with the removal of all vegetation and topsoil from
those areas designated for construction of tf}e proposed building additions. Following
swipping of the topsoil we recomrttcnd that the areas to receive till or areas which will be
constructed at grade be proofrolied with a partially loaded dumptruck to identify areas
necessitating additional repair. We anticipate that some near surface repairs will likely be
rctluired in the lower lying portions of the site close to the creek where alluvial soils were
encountered. These soils can be repaired in the upper several fact to provide suitable
support for it slab. However, there are some alluvial soils which will require deeper
undercutting beneath fOLItidations to provide suitable support. The need for additional
repair beneath toundations is discussed in a subsequent report section. We recommend
that the near surface soils requiring repair prior to fill placement or for slab support, be
evaluated in the field by an engineer at the time of grading operations. 'T'ile need for
repairs beneath slab areas can be limited by grading the site during periods of dry
weather.
It appears that earth work on the site will not be balanced from on-site cuts. As
such, the majority of the fill materials required to achieve finished floor elevatiotl will
need to be imported from off-site. We recommend that all fill materials consist of siity
and clayey sands or low plasticity elatys and silts with unified soil classifications of SM,
SC, CL and 1AL. All fill material placed oil the: site should be compacted to a minimurti
of 955% of the standard proctor maximum city density except ill the final foot beneath
pavements and floor slabs where this requirement should be increased to 98`/> of the
standard proctor maximum dry density. We recomnlcrid that field density tests be
perfortttcci during the compaction operations to verify that the required degree of
compaction is being achieved.
Qn the fat- eastern portion of the site, it appears that some cutting will Occur. In
this area partially weathered rock was encountered at depths as shallow as 1.5 feet below
existing ground surface with auger ref isaal qn harder rock being encountered at a depth of
2 feet below grade. As such, we anticipate that difficult excavation will be encountered.
It is possible that some of the materials can be ripped with a large dozer such as a UX
pulling a single tooth ripper. However, because of the hardness of the materials it is
likely that some light blasting will be required if excavations must extend below tile;
auger refusal level indicated on the boring logs. We recommend that a unit price he
established in the contract for rock removal if required.
Foundation Support Considerations. The proposed stnlcaturc may he supported on
shallow spread footings and/or continuous wall footitlg foutxlatiotis designed for a
itttiximum allowing bearing pressure of 3,000 psf, bearing oh approved subgradcs. It
should be noted that some soft till materials and alluvium were encountered in the
vicinities of borings B-2 and B4, drilled immediately adjacent to the existillg church. As
such, we anticipate that footings will need to be undercut through those SORCr rnaltcrials
to firm bearing residual soils or partially weathered rock, if encountered first. The
foundations can be excavated neat line to the firttter soils and theta be backfilled to design
bearing elevation with uniformly graded washed No. 57 or No. 67 stone. An engineer
will need to be on site during the undercut operations to approve subgrades immediately
prior to stone placetttcnt. The stone should be placed in maximurn lifts of 2 to 3 feet and
be tamped with a backhoe bucket to achieve some degree of consolidation. Additionally,

once tits stone has been brought to final grade we recommend that the stonclbe tamped
utilizing a vibratory sled or similar type of compaction device to thoroughly consolidate
the stone prior to concrete placement. We anticipate that undercut to as much 0 to 8 feet
could Occur in some areas adjacent to the existing stnucture.
On the eastern portion of the property we anticipate that the foundations will
encounter partially weathered rock above the bearing elevation. As such, difficulties may
be encountered excavating footings in this area. Auger refusal was encountered at a
depth oft feet in boring B-8 indicating presence of very hard rock. We recommend that
consideration be given to excavating footings with a large track mounted backhoc
equipped with a narrow bucket with rock teeth to allow soiree penetration into this
material, However, even with this type of equipment, there may be some areas where
refusal with the backhoe is encountered and some other techniques such as it veneer rock
saw may need to be considered.
We recommend that all column and wall footings have minirnutn dimcnsions of
24 and 16 inches, respectively, and all footings should bear at least 18 inches below
finished grade for frost protection. We recommend all footing excavations he inspected
by a geotechnical engineer to verify that subgrade soils have adequate. strength to support
the anticipated loads. 011Ce foundations have been repaired as previously discussed, we
anticipate that total settlements will not exceed i inch with differential settlements of
approximately !% that magnitude.
Box Cuivert Construction. It is our understanding that a 6 x 6 box culvert will he
extended beneath the proposed additions to handle water from the existing creek. Since
the box will extend under the building, we recommend that certain precautions be taken
to prevent an adverse impact to the proposed structure. We recommend that the box be
adequately reinforced to handle structural loads associated with any foundations which
may hear directly over the pipe. Additionally, we recommend that all joints on the box
culvert be properly wrapped with nonwoven geotextile fabric to prevent any migration of
fines into the box should any joint movement of the pipe ever occur. Since additional
load from the building will he supported over the pipe, it is important that the pipe he
properly bedded on firm materials. C-;eoTechnologies recommends that the channel in
which the pipe will he placed be excavated (town to firm material to prevent future
settlement of the box culvert. A mud mat could then be placed on the undercut subgrade
to achieve design invert elevation for the culvert if desired. Unifornily graded wash stone
can be placed beneath the. culvert-, however, that would likely result in excessive
underflow of the box culvert unless the stone is limited to the middle portion of the
culvert and a mud mat is placed under at least 10 linear feel at both ends. We
recommend that all till materials placed along the sides of the box culvert be carefully
compacted at least 95% of the standard proctor maximum dry density to- prevent
settlement of soils adjacent to the box culvert site. Additionally, all fill materials placed
above the pipe should he compacted to at least 95% of the standard proctor maximum dry
density. The box should be adequately sized to support compaction equipment which
will be necessary to achieve the required levels of compaction.

SUMMARY
In summary, subsurface conditions at the site appear suitable for the proposed
construction. Because of the shallow partially weathered rock which was encountered on
the eastern portion of the site, some difficult excavation play be encountered during
grading operations. We recommend that provisions be included within the. contract to
establish a unit rate fbr rock removal if required. Additionally, sonle undercutting
beneath foundations will be required on the western portion of the proposed additions
where some soft fill and alluvial soils exist which are associated with the adjacent
building foundation and/or nearby creek. Once footings are properly repaired, they can
he designed to support a hearing pressure of 3000 lbs. per square foot. Some repair may
also be required beneath the proposed box culvert to provide a stiff subgrade for
placement of the box so that the box will not settle when subjected to the loads of the
building which will be constructed over the top of the pipe.

The Wetlands Unit staff reviewed the stormwater management plans for the subject project and determined
that additional information is necessary to complete the technical review process. The required additional
information is as follows:
Requirement for a Wet Detention Basin
The 401 Water Quality Certification issued July 28, 1999 specified that a wet detention basin be used to
treat the stormwater from the subject site. The plans propose a sand filter. In our meeting with the
applicant/applicants representatives on June 14, 1999 options discussed for stormwater management
included bioretention, a wet detention basin, or an extended detention wetland. As such, any of these will
be acceptable. However the sand filter is not acceptable.
Drainage Area
The drainage area to be treated must include all of the new impervious area or an equivalent amount of
existing and new impervious area.

II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices manual
(N.C. Department of Environment, Health and Natural Resources, November 1995) and Administrative Code
Section: 15 A NCAC 2H .1008. Initial in the space provided to indicate the following design requirements have

A minimum 30-foot vegetative filter is provided at the outlet.
A site specific operation and maintenance (O&M) plan is provided.
A vegetation management/mowing schedule is provided in the O&M plan.
Semi-annual inspections are specified in the O&M plan.
A debris check is specified in the O&M plan to be performed after every storm event.
A specific sediment clean-out benchmark is listed (elevation or depth) in O&M plan.

Please find attached a Storm Water Plan for a sand filter at Trinity Avenue Presbyterian
Church. The plan includes an original and one copy of the Stormwater Management
Application Form, the permit application processing fee of $420, a narrative of the
stormwater treatment/management, the sand filter maintenance agreement, and two sets of
plans for the project.
The Storm Water Plan was required as a condition of the 401 Qualtiy Certification. A
copy of the 401 Quality Certification approval letter and application are also attached.
The 401 Certification was requested to allow the Church to place 330 feet of unnamed,
intermittent tributary of Ellerbe Creek in a culvert to allow expansion of the existing
church facilities. The sand filter will treat stormwater runoff from the new Church
addition and new parking lot.

The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
hnpervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into. the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
