I have attached a drawing that shows the dimensions and area of the stone at the toe of the sea wall. As for your second comment, there is currently a wooden wall in place that we are replacing. There is a lot of activity in this area with kids when camp is in session. Concrete is certainly more desirable than a wooden walk. We did work with Stan to add some trees for additional shading of the area to minimize water temperature increase. To be honest, it is such a small amount of surface area there is no way that the temperature of the lake will increase by any measurable amount due to this project We believe the additional shading is the best solution. I have two additional comments. • Please provide the dimensions and square footage of the proposed rip rap that will be placed at the toe of the proposed sea wall. The Division is concerned how the proposed concrete sidewalk and concrete pad may potentially impact surface water quality in Lake Lure (Class B; Tr). The concrete sidewalk and pad will add impervious surface at the lake's edge within the Trout Buffer and will contribute stormwater runoff directly to Lake Lure that may pose a risk of increasing water temperatures. The use of pervious materials along walkways and in the rope swing area, such as a wooden boardwalk or mulch, would be preferable to the use of concrete as a means to maintain surface water quality in Lake Lure. Would project objectives still be met with the use of pervious materials along the walkway and at the rope swing pad adjacent to Lake Lure? The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please clarify whether the proposed concrete seawall will replace the existing bulkhead in the same footprint or if there will be any extension of land and resultant fill into Lake Lure. The Proposed Seawall will replace the existing wooden bulkhead footprint with no extension of land or fill into lake Lure. 2. What is the extent and purpose of the proposed use of sandbags in the lake (location, linear feet, etc.) at the toe of the seawall? Please provide a justification for using sand bags at the base of the proposed concrete seawall. Duke Energy Shoreline Management Guidelines (attached) recommend using Class B rip rap or larger. If sand bags must be used, please provide a sheer strength analysis. Please see current revision of drawing, references to permanent sandbags have been replaced with specification of 6" to 9' nominal size rounded stone for protection of the seawall in swim areas. 3. The detail drawing indicates rounded stone will be used at the toe of the seawall in some locations (Retaining Wall Detail 135). What is the extent and location of this impact? Please indicate what size stone is being proposed and if it will be comparable in size to Class B rip rap. If stone is to be of smaller size of Class B Rip Rap, please provide a sheer strength analysis. The stone size specified is comparable to class B riprap. Rounded stone is specified in the swim areas to reduce the potential for injuries to swimmers, which would be expected to be higher with specification of sharper and more angular riprap stones. 4. Per Water Quality Certification 4145, Rip -rap shall be installed waterward of bulkheads to ensure protection of aquatic habitat. 15A NCAC 02H .0506(b)(4). Please revise the drawing and application to include appropriately sized rip rap along the extent of the proposed seawall. The drawing has been revised to show rounded stone of comparable size to class B riprap in lieu of rip rap in the swim areas, full extent of the proposed seawalls. Provide information regarding the extent of impacts associated with applying rip rap to the shoreline at the waterslide. Include information as to the rip rap footprint both above and below the full pond level (ex. Above: 35' x a'; Below: 35' x b'). Riprap at slide area to be approximately 35' L x 2' W (70 sf) below full pond level, and approximately 40' W x 8' L (320 sf) above the full pond level. 6. All rip -rap should be installed over a toed in filter fabric to prevent soil erosion behind the stabilized area. Please revise your plans to include filter fabric. [15A NCAC 02H .0507 (c)] The drawing has been revised to show toed in filter fabric in riprap and rounded stone areas. Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 45 calendar days of receipt of this email, the DWR will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
