CONDITION: Deed restrictions on all lots with federal and coastal marsh.
CONDITION: No pumpout facility proposed, therefore they should prohibit boats with heads OR have
signs requiring a closed head policy. (Could we require this information be conveyed on the Deed?)
An additional BIG concern I have is that the sounding data provided in the vicinity of the pier and the
AIWW showed max depths at Normal Low Water range from -1.68 to -3.06 with the average about -2.4.
THEY WILL WANT TO DERDGE!!! Any way to prevent/diminish this inevitable request? I can't think of
anything.

9. PROJECT DESCRIPTION
The. Cape Island Subdivision. is located within the jurisdictional boundaries of OfZNorth Topsail
Beach, off of Highway 1568 in Onslow County. The property is located a? a Hi "from. Villa
Capriani. The property borders water on three sides, Mason's Creek, Alligator y, ,and Norman's Creek.
A small part of the tract is located on the ocean side of Highway 1568 and rde the Atlantic 06*. The
consulting engineer has indicated on the application that there is 49.0 acres o tr4 ;The tract is
composed of high ground, federal wetlands, coastal wetlands and intertidal beat of 61<residential:
lots are platted in the subdivision, all on the sound side of the highway. A Major C 't was applied
for and issued in 1996 that authorized infrastructure and some community amenities. Stree ties .have
been installed. A community boat ramp with access docks, a community fishing pier with bo?house
and a clubhouse with a parking lot have been constructed so far.
The present application is a major modification request to the existing permit asking for authorization to
construct a 10-slip community docking facility. The proposed community dock would be located between lots
#22 and #23 with a 10' wide access easement between the lots. The applicants have designed a 6' wide by
310' long pier. The proposed pier structure has two "T" sections. The first "T" is approximately 3' by 55'
and the larger "T" is 6' by 99' with 3 smaller fingers providing access to the boat slips. Each of the proposed
10 slips would be equipped with a 12' x 14' uncovered boat lift. Water depths, low-tide soundings, are
provided on the blueprint sheet entitled "Topographic/Location Map". The water depth ranges from -2.17 at
the dock to -5.16 near the waterway channel.
The Division. of Environmental Management has classified the surrounding waters as SA Outstanding Resource
Water (ORW). The Coastal Management Area Of Environmental Concern extends 575 feet from mean high
wager landward into the property on the estuarine side. The Division of Marine Fisheries has designated the
surrounding water as Primary Nursery Area and the Shellfish Sanitation Branch declared this area open to the
taking of shellfish. A portion of the property falls within Coastal Management's Ocean Hazard Area Of
Environmental Concern. In this area, the erosion rate is an average of 3 feet per year as determined by the
erosion rate maps of 1986. The area is classified as Limited Transition by the Town Of North Topsail Beach's
Land Use Plan.
North Topsail Water & Sewer, a private company, provides sewer service to this area. In 1996 they were
at capacity and could only grant permission for 23 lots and the clubhouse to hook to sewer. At the time of this
writing the applicant is requesting that the remainder of the lots be released for development for a total of 61
(three-bedroom) homes and the clubhouse. The Division of Water Quality, DENR, gave approval of this on
January 2, 1998 with Permit #WQ0012128.
The North Topsail Beach Land Use Plan provides a, map from the National Register of Historic Places. That
map designates this property as a recorded archaeological site which means that this area has high probability
for containing significant archaeological remains. Historically significant land is sometimes characterized by
extensive concentrations of discarded shells or shell midden found at the site. In 1996 The North Carolina
Division of Archives and History required that an archaeological assessment be conducted of the property prior
to the commencement of development. A written report was submitted describing the findings.
Cape Island subdivision has 61 lots with a potential for 35-40 private piers/docks plus the existing community
pier /gazebo and boat ramp with access docks. In accordance with the way Coastal Management's rules are
currently written, potential boat slips at private docks could number at least 80, not counting the 10-slip
community •dock being proposed. The, developer.of this subdivision, Island' Development Group, Ins. has
proposed to restrict -individual lot #s,14,15, 16,22 and 23 from building piers/docks if the community
docking facility is authorized.

Mr. Deering in reply to your request for information regarding shellfish bottom
leases in :alligator Bay in the area of Cape Island, there arc no current valid leases in this
area. However an investigation of a proposed lease was conducted in the area in
question last Fall- The applicant was advised that the shellfish density in the area
exceded the ten bushel per acre maximum density the Division allows for new leases.
The applicant has responded by modifying the proposed lease and requesting another
investigation. This investigation should be conducted in the next few weeks. if I can be
of further assistance in this matter please contact me.

Currently, the Division allows each waterfront property owner to build a pier, a dock, boatramp, boathouse
and maintain moorings for a total of two boats. The existing Major CAMA Permit has specified, due to the
high quality waters, that no Exemptions be issued for construction of pier/docks. To date no private pier/docks
have been built in this subdivision.
10. ANTICIPATED IMPA T
Potential impacts associated with this project include increased boating traffic, more and longer structures in
the public trust waters and a higher concentration of slips in one area of shoreline. Potential for cumulative
impacts should be duly noted by the Division of Marine Fisheries and Shellfish Sanitation. The Division
supports their recommendations.

23 dots and the Clubhouse. We have discussed the methods oftnodifying or refining the Major
Permit but no final determination of the method was made.

this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with -the Office of Administrative Hearings, P.O. Drawer

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
North Topsail Water &Sewer, Inc.

FOR THE
construction and operation of approximately 2,478 linear feet of 8 inch gravity sewer, a 80 GPM pump
station with duplex pumps, on-site audible and visual high water alarms, and approximately 1,575 linear
feet of4•inch force main to serve 61-three bedroom homes in Cape Island Subdivision, and the discharge
of 21,960 GPD of collected domestic wastewater into the North Topsail Water & Sewer,.Inc.'s existing
sewerage system,.pursuant to the application received October 1, 1997. and in conformity with the project
plan, specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded, shall hereby void Permit
No. WQ0012128, issued May 1,1997, and shall be subject to the following specified conditions and
limitations:

This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specif cations, and other supporting data.
This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
The facilities must be properly maintained and operated at all times.
The sewage and wastewater collected by this system shall be treated in the North Topsail Water &
Sewer, Inc. Wastewater Treatment Facility (Nbn Discharge Permit No. WQ0005849) prior to
being land applied by spray irrigation..
This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Water Quality (Division) accompanied by an application. fee, documentation from the
parties involved, and other, supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved.
Construction of the sewers, pump station(s) and force main. shall be schcduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.

and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are-preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to

Comments:
This office is concerned about the degradation of the ORW and PNA waters in this area. The water
surrounding this site is very shallow and "kicking" in of boat channels would most likely occur. This
process of "kicking" in of boat channels increases the turbidity of the water causing problems for the
Juvenile fishes and the shellfish beds that have been placed within the area.
