Cobey, Jr., Secretary Director February 20, 1990 Mr. Robert Hyatt Town Manager Town of Clayton P.O.Bos 879 Clayton, North Carolina 27520 Subject: Town of Clayton WWTP Total Phosphorus Effluent Limit NPDES Permit No. NCO025453 Dear Mr. Hyatt: The Technical Support Branch has received your letter dated January 30, 1990 to Dr. George Everett requesting information on the total phosphorus limitation of the subject facility. Let me take this opportunity to commend the Town for its foresight in planning for future wastewater treatment needs. According to the current "Nutrient Sensitive Waters" designation of the Neuse River Basin, the Town of Clayton is required to meet a 2 mg/1 total phosphorus quarterly average effluent limitation in their wastewater treatment plant (WWTP) by January 28, 1993. However, 15 NCAC 2B.0211(b) (3) (A) states that the Division of Environmental Management (DEM) may further limit the total phosphorus loading of the discharge if, " in the opinion of the Director, the surface waters experience or the discharge would result in growths of microscopic or macroscopic vegetation such that the standards established pursuant to this Rule (i.e. a Chlorophyll a water quality standard of 40 ug/1) would be violated or the best usage of the waters would be impaired." When the subject NPDES permit expires on August 1•, 1992, the Town may be required to meet a more stringent total phosphorus limitation than the 2 mg/1 basinwide target total phosphorus limitation. The Town of Clayton WWTP discharges into Little Creek, approximately 6.0 miles before its confluence with Swift Creek. At a distance of approximately 2.0 miles below the Clayton outfall, the stream widens into a pond 0.3 miles long and 400 ft wide. In the past, DEM has handled several discharges in situations where a domestic wastewater outfall is located upstream from water impoundments, similar to the situation experienced by the Town of Clayton. Our experience indicates that the discharge of nutrient-laden wastewater (i.e. domestic wastewater) in the headwaters of a lake or a pond results in excessive algal growth in the receiving water impoundment. In several of these cases, a total phosphorus limit of 0.5 mg/l has been applied. The Division has tentative plans to conduct a field study this summer to evaluate the impact of Clayton's wastewater discharge on the receiving surface water quality. The study is necessary to determine the nutrient limitation to be required in the subject NPDES permit upon renewal. The results of the study should be available by the end of this year, although this will depend on receiving laboratory results from the U.S. Environmental Protection Agency in a timely manner. Although, DEM cannot provide the Town of Clayton with the exact total phosphorus limitation to be required in the next permit cycle at this time, I anticipate that it will be below the mandatory basinwide 2 mg/l concentration now in effect.
