Toxicity Testing Requirement The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in: 1. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *February 1987) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 82% (defined as treatment two in the North Carolina procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be performed within thirty days from issuance of this permit. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Additionally, DEM Form AT-1 (original) is to be sent to the following address: Technical Services Branch North Carolina Division of Environmental Management PO Box 27687 Raleigh, North Carolina 27611-7687 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine must be -measured and reported if employed for disinfection of the waste s-tream. Should any test data from this monitoring requirement or tests performed by tie -North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be reopened and modified to include alternate monitoring requirements or limitations. Note: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting. Failure to submit suit results will constitute a failure of permit conditio J. The permittee shall conduct a test for priority pollutants annually at the effluent from the treatment plant. The discharge shall be evaluated for all volatile fractions, acid fractions, base/neutral fractions, and pesticide fractions listed in Table II of Appendix D. of 40 CFR Part 122 and all metals, cyanide, and phenols listed in Table III of Appendix D. of 40 CFR Part 122. The permittee shall test the effluent for any pollutants listed in Tables IV and V of Appendix D. of 40 CFR Part 122, if a specific pollutant is believed to be present in the discharge. In addition to the above testing requirements, other significant levels of synthetic organic chemicals must be identified. For the purpose of implementing this requirement, the largest 10 percent of the GC/MS peaks other than the priority pollutants shall be identified. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate .�etesting(within 30 days of initial monitoring event). In accordance with the established schedules, the complete/final plans and specifications should be submitted by May 1, Winston-Salem 1993 in order to be reviewed and approved in time to meet the Binding 919/896-7007 Commitment Date of Ju• 1y 31, 1993. If the Binding Commitment Date is not met, the loan funding will be withheld. The 10% and 50% In -Progress Reviews of the plan documents are required in order to obtain the following: 1. Every effort must be taken to prevent bid overruns, since a project is not to receive loan funding in excess of that established on the priority list for the project. It is the Recipient's sole responsibility to see that the project is designed in such a manner as to stay within the established funding limit. If bids exceed the loan amount, the Recipient must pay the additional amount; or redesign and rebid the project to get within the funded amount. If a JOC/SOC schedule is involved and is not extendable, then Recipient must proceed with award of bid(s) or be subject to the fine amount stipulated in order; and possible loss of loan funds. 2. A timely submittal of final plans, specifications and supporting documents which are final and complete in all respects, including: a. In complete compliance with Loan conditions, the 201 Facilities Plan, and any contingencies imposed on the design by the environmental review. b. Compliance with EPA and State regulatory requirements. 3. Clear, precise and complete plan documents for the Biddability/Constructibility review, for which a review period or thirty (30) days.is required. 4. Prompt resolution of other Agency review comments which could result in lengthy delays in plan processing and approval. 5. Mutual understanding and effort by all parties to coordinate and maintain processing of project plan documents to meet target dates designated for State funding. If a new or revised NPDES Permit is required for the subject facilities, it is imperative that you take this action immediately by making application to Mr. Arthur Mouberry, Regional Supervisor, Division of Environmental Management, Raleigh Regional Office. Your Project plans cannot be approved until a Permit has been issued. Please note that the processing and issuance of a Permit will normally take six (6) months, but can take as much as nine (9) months. Page 3 The Recipient and consultant engineer must adhere to the schedules for obtaining the NPDES Permit, complying with JOC/SOC and submission of final plans and specifications in order that all other established schedules can be met. If the Binding Commitment date is not met, the Loan funding will be withheld. Everett, Ph.D Director May 8, 1992 Subject: Speculative NPDES Permit Limitations Town of Clayton WWTP NPDES Permit No. NCO025453 Johnston County Wilmington Dear Mr. Hyatt: 919/395-3900 The North Carolina Division of Environmental Management (DEM) is in receipt of Winston-Salem your letter dated February 21, 1992, requesting speculative NPDES permit limitations for 919/896-7007 proposed expansions of the subject WWTP to 1.6 MGD and 1.95 MGD. This letter is to confirm the preliminary findings presented to you by telephone on March 31, 1992 by Mr. Trevor Clements of my staff. The Town of Clayton WWTP currently discharges into Little Creek which is characterized at the discharge site by the following streamflow statistics: S7Q10 = 0 cfs, W7Q10 = 0.25 cfs, 30Q2 = 0.49 cfs and QA = 6.9 cfs. The headwaters of a pond are located approximately 2.5 miles downstream from the WWTP discharge. The pond has a surface area of approximately 13.0 acres. Since the subject facility discharges into a stream with a 7Q10=O cfs and a 30Q2 >0 cfs, the Town of Clayton will be required to meet, upon expansion, the following summer (winter) oxygen consuming effluent limitations: BOD5 = 5(10) mg/l, and DO = 6 mg/l as per NCAC Title 15, Subchapter 213, Section .0206 (d) (1). Also, based on current Division procedures, a summer (winter) 1(1.8) mg/1 NH3-N limitation will be required to protect the stream from ammonia toxicity. In addition, a Total Residual Chlorine limitation of 17 ug/1 will be required. These limits would not change if industrial wastewater were added. As discussed in our letter dated September 27, 1991, it has been DEM's experience that - the discharge of nutrient -laden wastewater in the headwaters of a lake or pond contributes to excessive algal growth in the receiving impoundment In 1990, DEM conducted a study which indicated nutrient enrichment in the receiving pond and a high probability of more severe algal Pollution Prevention Pays P.O. The study concluded that these chemical and physical factors are present in the pond during the summer months. This algal growth is associated with eutrophic conditions which impair the best usage of the waterbody as defined by 15 NCAC 2B .0101 (c). �/ Therefore, based on 15 NCAC 2B .0211 (b) (3) (A), a summer 0.5 m total phosphorus gll P sP (TP) limitation will be required upon expansion. However, our calculations'indicate that the 0.5 mg/1 TP limitation will exceed our current 0.1 mg/l TP target in the pond. In light of this, the comprehensive instream monitoring requirements outlined to you in our September 27, 1991 letter will be included in the NPDFS permit. The data will be used by DEM to assess the impact of the discharge in the receiving waters and to determine whether additional expansions will be allowed in the future, or whether further TP limitations are necessary. Current DEM procedures require that facility expansions which result in an instream waste concentration (IWC) greater than 33% include an Environmental Analysis (EA) as part of the NPDES application process. Since the IWC of the subject facility is 100%, the Town of Clayton will be asked to comply with this requirement prior to processing the NPDES application. The EA should evaluate all discharge alternatives including, but not limited to, non -discharge disposal systems, connection to the City of Raleigh, connection to a regional plant and advanced tertiary limitations (i.e. described above) at its existing discharge location. The EA should note that future expansions at the current site may not be allowed based on the response of the pond to the increased loading. Relocation of the discharge downstream from the pond has been suggested in the past by this office; however, current information indicates the presence of a second pond approximately 2.0 miles downstream from the first pond below the discharge. Therefore, any consideration for relocation of the outfall should be directed to larger, free flowing waters. For your information, new or expanding direct discharges to the Neuse River are also receiving BODS and NH3-N limits of 5 mg/1 and 2 mg/1 respectively. A cost evaluation should be included in the analysis to determine the most environmentally sound of the economically feasible alternatives. The evaluation of alternatives should be conducted in accordance with DEM guidelines. I recommend that you contact Mr. Don Safrit of my staff for guidance on the evaluation of alternatives.
