you deri 'iplication dated May I, 1998. After reviewing your application, we have decided
that it» s fill ?+ered'$y General Water Quahty'Certification Number 3108. This certification allows you
t6vse, de Permit Number 26 when the Corps of Engineers issues it. In addition, you should get
} s other f ral, state or local permits before, you go ahead with your project including (but not limited
t to)diment'and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is
_thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation maybe required as described in 15A NCAC 2H.0506
(h) (6) and,). For this approval to be valid you must follow the conditions listed in the attached
certification' and any:additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands
and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within
30 days of the date of this letter or the issuance o4 the 404 Permit (whichever is later).
2. No more than 150 feet of stream shall,-be culverted.
3. A tree planting and steam relocation plan shall be submitted to DWQ for written approval before stream
impacts occur. This plan shall utilize bigenan?ering techniques

lte ring. You musract wrt ,60 days of the date that you receive this letter. To ask for a hearing, send a
wntt etition which conf60ms to'Chapter 150B of the North Carolina General Statutes to the Office of
Adr*strative Hearings P40; Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Resources Commission (NCWRC) have reviewed'•the subject
4,? application with respect to anticipated project impacts on
aquatic habitats Our comments- are`provided,;.,in accordance
with certain provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, asamended; 16 U.S.C. 661 et
seq.), and section 401(b) of the Clean: Water Act of 1977 (as
amended), and North-,!Carolina. General Statutes (G.S. 113-131
et seq.).
"?.n. The.project involves the planned construction of the
Itampton Hills Subdivision, a residential housing development
with access--road near Thomasville in Davidson County. The
applicant proposes to relocate 487 feet of a small stream,
reduce stream :,length by 47 feet, and pipe the remaining 440
feet of stream for the construction of three residential
Iots and,:access road.
This project is located on-the watershed of Rich Fork
Creek, a tributary to Abbotts Creek and High Rock Lake.
White bass ascend Rich Fork Creek each Spring to spawn.
Anglers fish for white bass approkimately 5 miles downstream
of the project site. As proposed, the project will result
in the loss of wetlands that are important to maintaining
good water quality. We are concerned that stream
sedimentati_o and chemical runoff from the site may increase
without. e stormwater management and sedimentation
controh "asures to minimize wetland impacts are

Wd1will not object to the issuance of this permit if
the project is modified to reduce the length of stream to be
piped 440 feet to 60 feet and limited to the access road
crossing site.
However, if you decide to issue a 401 certification for
this project,- we strongly recommend that stream mitigation
be required at,.the maximum ratio allowed. We do not believe
that development of residential lots is adequate
justificatib'" for the destruction of 487 feet of
biologically productive stream channel.
