After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This Certification allows you to use National Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Mr. Hobbs is requesting 308 sq. ft. of wetland fill for a lot located at 694 Ocean Boulevard West, Holden Beach, NC. The lot is 92' wide by 81' deep (7452 sq. ft). The front property line borders the road and coastal marsh covers 2337 sq. ft. of the lot along the back property line. As you may remember from your site visit, a 658 sq. ft. area of 404 wetland is located on the eastern half of this lot, entering from the eastern property line. A 25' building setback from the road and 5' building setbacks from each side property line are required by the town. The combination of marsh and building setbacks necessitate the request for wetland fill in order to make the lot a suitable home site. The original lot was half the current size described above. In an effort to provide more upland area, Mr. Hobbs bought and combined an adjacent tract which was platted as a road that had never been built. However, the spider design septic system (which has been approved) requires most of the additional upland provided. The system will require a 46x 32' area adjacent to the front and western property boundaries. This leaves an awkward, triangular shaped upland area between the septic system and coastal marsh. The area tapers from 32' to 12' deep and makes placing a house on the western side of the property impracticable. Less marsh is found on the eastern portion of the lot, however the 25' front building setback still confines placement of the.1ouse. Given the marsh, the septic system, and the setbacks, house construction be poi sible if the house is placed partially over the 404 wetland area.
