After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). Pointe West Subdivision Page Two 9. Project Descrin ion The project site is a 13.2 acre tract, with an elevation of approximately four feet above mean high water located at 1030 Ocean View Blvd West in Holden Beach, Brunswick County. The property is bordered on the northern side by a large expanse of coastal wetlands (Spartina alternijlora, Juncus roemerianus) that extend several hundred feet to the AIWW. Other wetland species (Cladium jamaicense, Distichlis spicata, Salicornia spp., Spartina patens) also exist along the upland border of the property. There are two narrow highground spits that extend from the northside border of the property toward the Aiww. All of the highground area associated with the two spits are identified as common area by the applicant. Two isolated upland islands also exist on the tract between the AIWW and platted lots on which no development is proposed. The southern and eastem boundaries of the property are bordered by private property owners and Captain's Villas Home Owners Association. The western side of the property is bordered by B & W Subdivision. The barrier island type geographical features have resulted in the property being located within the Division of Coastal Management's estuarine shoreline area of environmental concern (AEC) and the ocean hazard VE zone AEC even though none of the property is ocean front. The estuarine waters adjacent to the site are classified as SA waters by the Division of Water Quality. The shellfish closure line actually separates the property whereas the eastern end of the property is closed to shellfishing and the wester end is open to shellfishing. The estuarine waters are not designated Primary Nursery Area by the Division of Marine Fisheries. Although in the Ocean Hazard VE zone, none of the lots fall within the Ocean Erodible Area. Therefore, all lots are outside of the Ocean Hazard setbacks. The land use classification for the tract from the Holden Beach Land Use Plan is Limited Transition. The only manmade features presently existing on the tract are a sewer disposal field and an unpaved access road. Lots 3,4 and 5 contain the existing sewer disposal field which will not serve the proposed development but will continue to serve the adjacent Captain's Villas Homeowners Association. The applicant is aware that lots 3,4, and 5 will not be available for development as long as they are being used as a sewer disposal field but has included those lots for potential future development pending installation of a municipal sewer line. Because the project will disturb more than an acre of land, the applicant is required to sit'bmit a sedimentation and erosion plan to the Division of Land Resources. The plan was submitted and approved on May 21, 1999 and assigned number 990439 BR. The applicant will also be required to obtain stormwater certification from the Division of Environmental Management. The stormwater application has been submitted and as of this date is still pending approval. The applicant proposes individual sewer disposal fields for each lot as their method of sewage disposal which is also pending approval. The applicant proposes to utilize the Town of Holden Beach drinking water supply source. Pointe West Subdivision Page Three The applicant proposes to construct 34 single family residences on thirty-four lots with associated paved roads on the 13.2 acre tract. Lots will range in size from 0.17 to 0.74 acres. Although the lots are not directly on Ocean View Blvd West, the subdivision will be accessed from Ocean View Blvd West via a lot that joins the subdivision and the street. The subdivision will then span parallel to Ocean View Blvd West with lots on both sides of the proposed road. The road terminates at both ends in cul-de-sacs. Lots 9-24 are on the northside of the proposed road and border the AIWW. However, all the lots are separated from the AIWW proper by a large expanse of coastal wetlands that extend several hundred feet before reaching the AIWW. The shoreline length along the northside border of lots 9-24 is approximately 1300 feet along the AIWW. As stated earlier, the coastal wetlands contain two highground spits that extend from the highground toward the AIWW. These spits extend from lots 21-23 and appear to prevent lots 21 and 22 from directly bordering the AIWW and also from having water access. A 4.75 acre dike also exists between the waterfront lots and the AIWW. The dike basically blocks several waterfront lots from access to the AIWW. Other upland islands (apparently old spoil sites from the dredging of the AIWW) within the large expanse of coastal wetlands may also prevent other lots from having water access to the AIWW. A small tidal creek which branches from the AIWW and meanders through the coastal wetlands between the waterfront lots and the AIWW may also prevent some lots from access to the AIWW. Most, if not all of the lots appear to be blocked from access to the AIWW. Although the applicant is showing ownership, there is no proposed development on the spits, dike or upland spoil islands. The applicant has submitted plats that show the coastal wetland delineation and the 404 jurisdictional wetland delineation. The applicant is proposing no development nor fill within those areas. However, there are several isolated pockets of wetlands that have been designated as non jurisdictional wetlands by the US Army Corps of Engineers. The applicant proposes to place fill in these non jurisdictional 404 wetlands in order to raise lots and roadway and to provide a better base for buildings. The amount of non- jurisdictional 404 wetland area proposed to be filled is approximately 49,062 sq. ft. io. Anticipated impacts The project as proposed will involve the transformation of a barrier island type environment to a residential single family subdivision. The filling of 49,062 sq. ft. of isolated non jurisdictional wetlands will have some impacts but should not impact jurisdictional federal 404 wetlands nor coastal wetlands. The applicant is requesting no fill nor excavation within jurisdictional federal or coastal wetlands. All of the lots have received building envelopes that are platted outside of federal and coastal wetlands and all construction is proposed within the building envelopes. However, portions of several lots have coastal and/or federal wetlands present. Therefore, it is likely that requests for fill in wetlands will be made by future purchasers of the lots as they attempt to landscape their yards. The applicant has also not requested any individual nor community piers or any other type of water dependent structure. This action will also likely result in requests by individual waterfront lot purchasers to obtain piers and docks if it is found that any of the lots have access to the AIWW. The presence of the spits, dike, tidal creek and upland spoil islands within the large expanse of coastal wetlands between the waterfront lots and the AIWW will Pointe West Subdivision Page Four prevent several, if not all, lots from having water access and probably create controversy as to which lots will have water access. Consultation with the Division of Water Quality (DWQ) has revealed that an assigned percent of impervious coverage will be applied to all lots within the development. But, areas within 75 feet of mean high water will still be limited to 30% impervious coverage or DWQ's assigned figure, whichever is less, unless the applicant installs an approved engineered stormwater system. The purpose of this project site is for the construction of 34 buildable lots with roadway for the construction of 34 homes for family occupancy, the project white will be used as residential building space. During construction daily operations are to entail the earliest construction of swales and sediment basins with the installation of silt fencing around the limits of construction, to minimize the impact of erosion and sediment runoff beyond the project site. Roadway to be graded with the installation of public utilities. Upon final grading, the areas will be stabilized with vegetative measures per Federal and State Regulations, to minimize any runoff of erosion sediments. When all utilities have been installed and The street finish graded. The streets will be paved. Homes will be constructed and landscape installed. When project site has been completed and all erosion and sediment runoff has ceased, the erosion control measures will be removed.
