Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill material in 0.19 acres of wetlands or
waters for the purpose of a residential area, piers and boat ramps, as you described in your application dated June 21,
1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3099. This Certification allows you to use General Permit Number 030 when the Corps of Engineers issues it.
In addition, you should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Please find attache t is let even (7) copies of a Department of the Army General Permit
request packet ( No. 198 030) and cover letter addressed to Mr. Allen Davis of the U.S. Army
Corps of Engine mington field office. The purpose of this letter is to request Section 401
concurrence for this general permit. The proposed action includes the construction of four group
piers and a boat ramp on the shoreline of Badin Lake (Narrows Reservoir) adjacent to the Heron Bay
residential development in Montgomery County. Impacts associated with the proposed action
include approximately 0.01 acre of fill for pier pilings and the boat ramp and approximately 0.18
acre of shading by piers.
It is assumed that the proposed action will be considered by the N.C. Division of Water Quality
(DWQ) to require a "Minor Water Quality Certification", and as such requires a fee payment of
$200.00. Please find attached to this letter a check made payable to the N.C. Division of Water
Quality in the amount of $200.00.
The property is under development by a Charlotte-based company called KEJ Marketing, Inc. My

Dear Allen:
The purpose of this letter is to notify you about Section 404 jurisdictional impacts at a residential
development referred to as Heron Bay on Badin Lake (Narrows Reservoir) in Montgomery County,
NC. You and I spoke of this project on site on August 4, 1998. The proposed activities resulting
in wetlands impacts include the construction of four group piers and a boat ramp. Wetlands impacts
associated with proposed construction include approximately 0.01 acre of fill for pier pilings and the
boat ramp and approximately 0.18 acre of shading by piers. You and I discussed this project on the
telephone back in May 1999. It is my understanding that the proposed activities are covered by
Department of the Army General Permit No. 198200030 and its associated Section 401 general
certification.

The approximately 362-acre Heron Bay residential development is situated adjacent to the north
shore of Badin Lake (Narrows Reservoir) in Montgomery County, NC. The development property
is located approximately, 3.0 miles south of the southern intersection of N.C. Highway 49 and N.C.
Highway 8 off of Lanes Chapel Road. (Figure 1).

Block 10.
Four group piers and a boat ramp are proposed for construction on the shoreline of Badin Lake
(Narrows Reservoir) (see Figures 3 and 4 for locations). Wetlands impacts associated with
this construction include filling and shading of aquatic-emergent vegetation (primarily water
willow [Justicia americana)). Impacts associated with proposed construction include 0.01
acre of fill for pier pilings and the boat ramp and 0.18 acre of shading by piers. The area of
fill has been limited to the minimum necessary for the proposed activities.
Block 14.
Impacted wetlands associated with the proposed project consist of aquatic-emergent
vegetation beds (primarily water willow) growing in bands along the shoreline of Badin Lake
adjacent to the Heron Bay development. These beds of willow appear to be increasing in size
and extent each year. Most of the Badin Lake shoreline adjacent to Heron Bay now supports
willow beds, resulting in difficulty avoiding this vegetation when installing shoreline
recreational facilities. Waterfront Properties and The Row Boat Company, Inc. have
coordinated design of proposed facilities with Yadkin, Inc. to appropriate heights above the
lake surface and lengths from shore to result in a minimization of wetland impacts.

TECHNIQUES AND MATERIALS USED IN CONSTRUCTION:
Mooring Float Frame, the Rowboat AngleBrace System:
The AngleBrace galvanized steel truss is among the strongest steel trusses commercially
manufactured for floating docks today. This totally galvanized steel box truss uses angular
steel braces wherever round-bar braces are commonly used on other floating docks. Full
2x10 inch wooden wailers are bolted to all exposed faces of the steel to totally encapsulate the
truss and "hide" the steel truss completely. One of the largest commercial manufacturers of
floating docks in the country engineers and constructs this AngleBrace truss to Rowboat's
specifications. This steel dock frame is without peer.
TREX...the Rowboat Standard Decking: Unless a customer requests otherwise, all
Rowboat fixed piers and mooring floats come standard with the latest in premium decking
materials. TREX is an innovative wood-polymer lumber made from reclaimed grocery bags
and wood waste. Initially engineered and manufactured by Mobil Chemical, TREX is
approximately 50% wood fiber and 50% polyethylene film. Because of the wood content,

TREX has the advantage against plastic lumber of low thermal expansion/contraction, UV
stability, no voids, superior traction and paintability. The advantages over wood are
considerable and include no checking, splitting or rotting, no insect damage, splinter-free,
and no preservatives. TREX carries a full 10-year warranty against splintering, splitting,
checking, rot, decay and termite damage.
The Floatation Billets: Black encapsulated floatation billets manufactured by Formex are
used on all standard Rowboat mooring floats designed for semi-protected waters. In
unprotected or offshore waters other floatation may be specified.
The Loading Ramp: The loading ramps that are normally supplied with our commercial
docking system is aluminum frame with TREK or treated southern pine decking. This is a
totally maintenance-free, loading ramp constructed from welded tubular aluminum. These
aluminum ramps are normally stocked in a variety of sizes up to thirty (30) feet in length.
The loading ramp being specified for your dock will be aluminum with TREX decking.
The Fixed Pier. All fixed piers are constructed on wooden pilings. All lumber used in the
construction is pressure treated southern pine, treated to a minimum of .6 CCA for marine
service. Wherever a through-bolted connection is warranted, galvanized hardware is used
and is terminated with commercial-grade galvanized OGEE washers. The standard walk
treads are premium TREX composite lumber (see above) or alternative decking materials if
specified. A variety of handrails and toerails are designed to accommodate customer
preference. The decking being specified for your fixed pier will be TREX.
Telescopic Steel Pilings: Low profile, telescopic pilings are normally used to secure
marinas and floating docks. These pilings slide through a collar, which is through-bolted to
the steel in the floating dock. All pilings are hot-dipped galvanized.
EXPERIENCE AND ENVIRONMENTAL CONCERNS:
1. The Rowboat Company is experienced in working in environmentally sensitive areas throughout North
and South Carolina. Among it's most notable accomplishments are the construction of an elevated
walkway through a botanical wetlands at Sandhills Community College in Southern Pines; the review and
re-drafting of the upland dredging standard for North Carolina, through John Dorney's office in Raleigh
(DENR, wetlands chief); and the design, engineering and construction of the cleanup and total wetlands
mitigation of a large environmental spill on Lake Wylie for Kia Whittlesey, Mecklenburg County, land
development manager. In addition, Rowboat has installed five public access areas for The Duke Energy
company and is under contract to install four more. These facilities include the construction of concrete
boatramps, launch docks, and asphalt parking areas, staging areas and entrance roadways. This work
involves working on five different reservoirs from Lake James to Lake Wateree on the Catawba-Wateree
Project.
Rowboat is experienced in designing and installing these facilities. (brochure attached)
2. The placement of these proposed docks is designed to minimize adverse impact on fisheries and the water-
willow feeding grounds adjacent to the shoreline. All docks are designed to be installed in sufficiently deep
water, which will not support willow growth.
3. Only encapsulated floatation is used. No exposed Styrofoam is used.
4. Docks are framed with galvanized steel, which should inhibit rusting and enhance structural integrity for
years to come.
5. Design utilizes long, aluminum ramps, which span willow beds, rather than using shorter wooden ramps
and pilings, which might impact the willow. Using these long-span ramps also minimizes the use of CCA
treated pilings, which are normally specified for the construction of fixed piers and landings.
6. The concrete loading ramp is pre-formed and poured on land, prior to pushing it into the water. As a
result, no "fresh" or wet concrete is ever placed in the reservoir. The installation of this loading ramp will
impact a small 20-foot wide section of the willow bed during the construction phase. Care will be taken to
mitigate any loss of willow beds.
7. All floating dock construction will be performed off-site in order to minimize any adverse impact on the
Yadkin environmental, shoreline buffer. Naturally, the landbridge transitions at the water's edge will need
to be constructed from the land.

As you know, we conducted an on-water survey at the proposed Heron Bay marina
locations on March 26, 1999. The survey was performed using laser telemetry and
those normal techniques used by our company to perform this type of shoal analysis.
The operated, survey craft was supplied by Waterfront Properties. The shoreline was
staked each 60 lineal feet across the face of the shoreline at the apparent water's edge
(tree line). Water depths were vertically measured with a graduated surveying rod and
the field results were calibrated to full pond elevations. (The lake was approximately 6
inches from full pond the day we measured, so 6 inches was added to each field
measurement.) Horizontal measurements from the apparent water's edge were taken by
hand held laser and are within 1 % of accurate. The outside edge of the water willow
banks were fairly easy to see from the boat and seemed to appear at elevations of 4 1/2
to 5 feet of water (full pond elevation).
For your review and comment, we are enclosing three (3) copies of each of the three
locations in question. Our observations and notes on each location follow:
DOCK AT'LOTS 13/14: Slightly deeper water was found nearer the
property line between 12/13 than the property line between lots 13/14. Further on
toward Lot 12 the shoal turned seaward somewhat dramatically. An individual lot
owner of Lot 12 would most probably want to place his dock to his right of center. If
the marina were left where it is currently planned, the distance of the structure from the
apparent water's edge would need to increase from 68 feet to approximately 85 feet, in
order to clear the water willow bed at the property line of 13/14. The distance across
the cove at the 13/14 property line is approximately 230 feet. Water depths for boats
moored at this marina as depicted on Revision 6 of DWG 353-98-1 would vary between
6.5 and 8.5 feet when measured from full pond.
DOCK AT LOTS 27/28: Slightly deeper water was found to exist toward the
lot line between 25/26. The survey revealed good clearance on the water willow as
designed with no concerns on the 1/a rule restriction. Maximum dock length is planned

to be 120 feet. Water depth for boats moored at this marina as depicted on Revision 6
of DWG 353-98-2 would vary between 6.5 and 7.5 feet when measured from full pond.
DOCK AT LOTS 59-60: This dock appears to have been designed in plenty of
water and could be shortened somewhat, if desired. Water depths for boats moored at
this marina as depicted on Revision 5 of DWG 353-98-5 would vary between 9.5 and
10.5 feet when measured from full pond.
DOCK AT LOTS 79/80: This dock pocket was not surveyed.
WATER DEPTHS AT UWHARRIE POINT MARINA: For your information,
we measured the water depths available to those vessels berthed at the main marina
closest to the gas dock at Uwharrie Point. At the boat slip closest to the gas dock
(number 26?) the water depth is in excess of 12 feet when measured at full pond.
Midway down the marina (slip number 14?) the water depth is 9.5 feet. At the far end
(slip number 1?) there exists 6.5 feet of water when measured from full pond.

easily share this information with Tony and the other members of the Wildlife Resource
Commission. At your call, we will gladly meet with you at Heron Bay to field verify
