Bennett, Jr. Town Manager Town of Fuquay-Varina 1300 East Academy St. Fuquay - Varina, N.C. 27526 Dear Mr. Bennett: You have our approval, in accordance with the attached conditions, to place fill material in 1.038 acres of wetlands or waters for the purpose of constructing the Fuquay - Varina 16 "Forcemain Sanitary Sewer as you described in your application dated 20 June 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3108. These Certifications allow you to use Nation%yide Permit Numbers 12 and 26 when the Corps of Engineers issues these. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The proposed 16" Forcemain Sanitary Sewer line starts at a proposed pump station site located approximately 800 feet east of NC55, approximately A 2000 feet south of NCSR 2765 and north of an unnamed intermittent stream. The line runs west along '04 the north side of the unnamed intermittent stream to NC55, heads north along the east side of NC55, N j` moves northeast away from NC55 crossing over NC42 and US401, runs northeast along the north side o rC US401, crosses Terrible Creek and connects to an existing man-hole approximately 120 feet north of ` `/?CJ Terrible Creek (see attached USGS site vicinity map). The purpose of the proposed line is to connect the proposed pump station to the existing Town of Fuquay-Varina Sanitary Sewer System. Construction of the line will comply with the general conditions stated within Nationwide Permit #12 & 26. It is the understanding of S&EC, Inc. that notification to the NC Division of Water Quality for a Qcertification or compliance with the Neuse River Buffer rules (15A NCAC 2B .0233) is not currently required if all of the general conditions of Nationwide Permit #12 are followed We have notified the NCDWQ due to impacts proposed within Impact 2 where the use of Nationwide Permit # 26 is req The construction of the line within this area will comply with all of the general conditions of NW12 except for crossing the stream perpendicular and impact closer than 10 feet (see details described within the PCN). Placement of the line. within- this area was located from recommendations made by 1VIr. Steve Mitchell of the NCDWQ. Please notify our officeif any changes to this interpretation occur. We do not believe that any wetland mitigation will be required to perform the proposed activities. We do not believe that any Neuse River Buffer mitigation will be required (since not mitigation is listed within the current Neuse River Buffer regulations). Description of proposed work including discussion of type of mechanical equipment to be used (attach plans 8 1/2" x 11" drawings only): The construction of the 16" forcemain sanitary sewer will begin by installing an 16" pipe along the proposed route between the proposed pump station and existing man-hole (see attached USGS site vicinity map). The line will be connected to the existing manhole. The installation of the proposed line will comply with all of the general conditions stated within Nationwide Permit # 12, except in Impact 2 where the line will not cross perpendicular to the intermittent stream and will be closer than 10 feet. Nationwide Permit # 26 is proposed within this area. 13. Purpose of proposed work: To connect the proposed pump station site to the existing Town of Fuquay Varina sanitary sewer system. 14. State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): Impacts to wetlands and waters have been minimized to the greatest extent practicable. A preliminary "walk-through" of sections of the line was conducted with SBEC, Inc. and Mr. Steve Mitchell of the NCDWQ in an effort to position the line in the most environmentally sensitive location. The forcemain will be kept to the existing NCDOT r.o.w. except for the cross-country section between NC55 and US401. No wetlands or streams will be impacted within this cross-country section of line. The forcemain will comply with all of the general conditions of Nationwide Permit # 12 except within Impact 2. The stream channel within this area has been altered and currently runs within an existing powerline r.o.w. on the east side of NC55. The line within this section will comply with all of the general conditions of Nationwide Permit # 12 except for crossing the creek perpendicular and running parallel within 10 feet. Therefore, this section of the line will need to be permitted under Nationwide Permit # 26 and will comply with all of the general conditions of that permit. Neuse River Buffers - The proposed forcemain has been placed outside of the 50-foot buffers were possible. The line will impact the buffers with stream crossings in Impacts 2, 3 Si 4. The line will impact small sections of Zone 2 of the buffers within Impacts 1 & 2. The placement of the line within Impact 2 has been reviewed by Mr. Mitchell. As per Mr. Mitchell's recommendations the line within this area will be kept to the existing maintain powerline r.o.w., except for some minor impacts to adjacent vegetation required to minimize direct impacts to the stream channel. 15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project. The proposed gravity sanitary sewer line starts at a propostV forcemain along the north side of US401approximately 3,300 feet northeast of NC55, runs north cross country along the east side of a pond and intermittent stream and connects to an existing man-hole located on the south side of Terrible Creek east of NCSR 1404 (see attached USGS site vicinity map). The purpose of the proposed line is to connect to the existing Town of Fuquay-Varina Sanitary Sewer System. Construction of the line will comply with the general conditions stated within Nationwide Permit #12. We have notified the NCDWQ due to minor impacts proposed to Zone 2 of the Neuse River 50-thot Buffers. Since this is not a required notification under the 401-wetland review process, we believe that this notification does not require a NCDWQ permit application fee.
