It is possible that the reason for my not having received this correspondence from your office could be attributed to our local post office delivery service. However, the fact remains that I have not received the letter and this impedes our progress with this project. Both my. father and I have left messages for you regarding this matter, as you were out of the office. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) minor permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. Appropriate sediment and erosion control practices that equal or exceed those outlined in the most recent edition of the Page 1 of 3 http://h2o.ehnr.state.nc.us/Wetlands/GENCERT.291 09/14/1999 GENCERT.291 at h2o.ehnr.state.nc.us "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in freshwater streams and rivers; 25 NTUs in all saltwater classes, and all lakes and reservoirs); 4. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 5. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 6. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 7. Additional site-specific conditions may be added to projects which have applied for CAMA major permits which are proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; Violation of the conditions herein set forth by a specific project shall result in revocation of the Certification for that project and may also result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category that, in his judgement, poses a threat of significant adverse impact on water quality or remove the existing uses of the wetland or downstream waters. PROJECT SUMMARY: The applicant would like to replace 156 linear feet of existing (and recently removed) finikhead and-place riprap along 347' of shmvfine-with a five-foot base Extend-that will extended from normal water level. Margaret Fazenbker Bio Report Page 2 PROJECT SETTING The applicant's property is on West Ocean Bay Boulevard, Baum Bay Harbor Subdivision, on Colington Island, Kill Devil Hills, Dare County. The property consists of .99 acres, has an elevation of approximately 3 feet above normal water level (NWL) and is inside a man-made canal system off Colington Creek. Vegetation on the property is composed of pine, live oak, ornamental shrubs, flowers, and lawn grass. The canal system within Baum Bay Harbor surrounds the applicant's property, forming a small peninsula. Development on the property is for private residential use only and includes a dwelling, shed, a driveway, septic system and pump house- Erosion around the shoreline is noted on the application as approximately 3 feet per year. The property has 933.96' of shoreline with approximately 150' of existing dilapidated bulkhead and 430.66' of existing riprap. A 31' section of bulkhead was recently removed due to its state of disrepair and safety u issues, and is now unprotected. Colington Creek and it tributaries are classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SC (fish propagation). Additional review indicates that there are no known archeological sites or geological formations associated with the applicant's property. PROJECT-DESCRIPTION The applicant would like to construct 126' of replacement bulkhead along the eastern side of the driveway (including a 31' section that was recently removed), and a 30' section adjacent to the existing boat ramp on the western side of the drive- The bulkheads are to be constructed an average of two feet watermark of normal water level (NWL) where depth range from six inches to eight inches. The total area of shallow water bottom that will be filled with the new bulkhead is 312 square feet and will include 34 cubic yards of fill dirt. The applicant is proposing riprap along 347.3' of shoreline, of that 322.3' is unprotected and 25' is minimally protected by a dilapidated bulkhead. Ms. Fazenbaker plans to replace the 25' section of the dilapidated bulkhead with riprap. Along the waterward toe of the proposed riprap water depths average one foot below NWL. Approximately 1,737 square feet will be fills with concrete riprap and resulting in the placement of approximately 97 cubic yards of material. No submerged aquatic vegetation is within the proposed alignment of the riprap or bulkhead. ANTICIPATED BWACTS The development being proposed will result in the following: • Temporary upland disturbance may occur from the placement of the riprap material and the movement of heavy equipment. • Placement of concrete riprap will result in the loss of 1,$49 square feet of shallow water bottom and Estuarine Water. • Approximately 32 cubic yards of riprap material and six cubic yards of dirt fill will be placed below normal water level. • Temporary localized turbidity can be expected siuring the installation of the bulkhead and the placement of the riprap material. • Increased habitats will be created by the placement of riprap along the applicant's property. • Land Use Plan Consistency will be provided in a separate letter by John Thayer.
