Dear Mr. Athanas:
On April 22, 1999, 1 met with you onsite to conduct a site visit of the property
involved in the above referenced project. It was determined as a result of the site visit
that there is a creek and a pond present on this property. Middle Creek located to the
east and north of the property is subject to the Neuse River Basin: Nutrient Sensitive
Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233).
The pond has been constructed in uplands and has no visible outlet to surface waters
of the State and therefore is not subject to buffer protection. The plat map received
by this Office for this housing subdivision delineates the protected buffer.
