PROJECT SUMMARY: The applicant proposes to expand an existing private docking facility to serve the new Avalon Oaks South Subdivision Avalon Oaks South Subdivision Page Two 9. PROJECT DESCRIPTION: The project site encompasses approximately 1.19 acres and is located ~~I~f~,~~ al~,n .~\~ ~~ . i>~ ~ ;~, _ ~_~~: `, ~: Grove Road and Myrtle Grove Sound, in Wilmington, New Hanover County. 1~~ locate tli~~ ~~r;~,~~~r,.,_ take College road south from Wilmington towards Carolina Beach. Turn left onto Piner road at the intersection of S. College Road and NC Hwy 421, and follow until you reach a stop sign at Myrtle Grove Road. Turn right onto Myrtle Grove Road and travel south approximately 0.75 mi. until you reach Avalon Oaks West Subdivision, which would be located on the left. Continue traveling east until you reach a gravel driveway. Turn right onto the gravel driveway until it terminates into the property of interest, which would be on the left. The proposed project area is bordered to the north by the Windy Hills Subdivision. To the east lies the Atlantic Intracoastal Waterway (AIWW) and Myrtle Grove Sound. Residential properties border the site to the south and west. The applicant currently maintains atwo- story residence on the property and an open area of high ground located on the southern ~ortiun ~~I~ ~h~~ applicant's property, which would be the project site for the subdivision. The understory vegetation at the project site has been mowed and the remaining highground vegetation includes mature hardwood and other woody species, which include: Loblolly and Long-leaf Pine, Oak, Sweet Gum, Red Maple, Magnolia, Wild Cherry and Red Cedar. The highground area transitions to an area of Federal §404 Wetlands, which have been delineated by the consultant and pending approval by the US Army Corps of Engineers. The high coastal marsh vegetation includes: Black Needle Rush (Juncos roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Salt Meadow Grass (~artina patens). The low marsh vegetation is primarily Smooth Cordgrass (Spartina alterniflora) and Glasswort (Salieornia, spp.). Adjacent to the property on the southern portion shoreline. there is a border of coastal marsh, approximately 300' in width by 300'deep. Located between this area ot~ coastal many ,u~~i tl~~~ AIWW is an isolated highground island, which is a location of private single-family residence. The applicant also maintains a private community dock waterward of his residence, which was authorized under CAMA Major Permit No. 150-96. The access pier extends towards the AIWW for a distance of approximately 700', by 6' in width. The structure spans approximately 600' of marsh. Over open water, the pier turns gradually 90° towards the south for a distance of approximately 30'. The pier then terminates into a gazebo 14' in length by 14' in width. Two floating docks, approximately 28' in length by 4' in width, are located waterward of the gazebo and access pier, which are accessed by gangway ramps. The floating docks run perpendicular to the shoreline. There is an existing boatlift, 20' in length by 12' in width, located on the north side of the northern most floating dock. There are three mooring pilings located on the southern side of the southern most floating dock. The application states the existing docking facility currently accommodates four vessels. However, the existing boatlift has a double bunk cradle, which would allow for two vessels to utilize the boatlift. The width of the AIWW in the area of the project site is approximately 660' from marsh edge to marsh edge. The application states that the depths at the terminal end of the docking system range from approximately -2.0' to -3.0' @. Mean Low Water (MLW) (See Sheet 9). The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The waters of the ICWW in the vicinity of the project site are classified as Outstanding Resource Waters (ORW) b~~ the NC Division of Water Quality. The area is designated as a Primary Nursery Are" h~ th~~ N( Division of Marine Fisheries, and is OPEN to the tal<ing of shellfish. Avalon Qaks South Subdivision y Pale Three PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility to serve the new Avalon Oal<s South Subdivision. The subdivision plan includes three individual lots and expansion of an existing private pier and docking system. The new pier would continue through the gazebo for an additional 67' by 6' in width towards the south. Two additional floating docks, 28' in length by 4' in width, would be installed. These floating docks would be oriented in the same aligmllent as the existing floating docks. Three boatlifts, 30' in length by 14' in width, would be installed between two proposed floating docks and the existing floating dock. The application states that the expanded existing docking facility would accommodate a total of seven vessels .(See Sheet 11). The 1.19 acre tract would be divided into three, approximately 0.40 acre lots (2.5 units/acre), averaging 17, 409 sq. ft. The applicant proposes to provide a 6' wide pedestrian easement to the community dock across his property and a 10' wide access easement along the north side of Lot C for the proposed three- lot subdivision. The applicant also proposes a paved 30' access and utility easement to the proposed lots, which would extend from the unpaved road from the Avalon West Subdivision. Two stormwater infiltration ponds would be located on the northern side of the proposed 30' access easement, which would partially be located within the 575' ORW AEC (See Sheet 7). 10. ANTICIPATED IMPACTS: The proposed expansion of the existing docking facility with floating docks and boatlifts would incorporate approximately 1,484 sq. ft. of Estuarine Waters and Public Trust Areas. The proposed expansion would extend approximately 150' into a waterbody that measures approximately 660' across, which would conform to the 1/4 width rule and would not extend beyond the established pier head length. As proposed, the applicant's proposal would not encroach into the 80-foot setback from the AIWW. According to the site drawings, the three lots (A, B and C), and portions of the 30' access easement and stormwater infiltration ponds are located within 575' from normal high water (NHW'). It is assumed that these three lots will be developed, however there should be no long term impacts associated with the development of these lots. The applicant has indicated that approximately 11.0 % of the Outstanding Resource Water (ORW) shoreline will be covered by built upon area. The application states that a State stormwater Management Plan has been submitted to the N.C. Division of Water Quality, which is currently under review (SW8061218). The application also states that a Sedimentation and Erosion Control Plan has been submitted to New Hanover County on 10/13/06. Submitted by: Robb Mairs llate: 3/1/07 Office: Wilmington Project Narrative CAMA Major Permit Avalon Oaks South New Hanover County Applicant Bruce Jackson requests a CAMA Major permit for development of a residential subdivision and expansion of a private dock for residents of the proposed subdivision. The planned Avalon Oaks South subdivision is located off Avalon Ave. in New Hanover County, abuts Atlantic Intracoastal Waterway, AIWW, and totals 1.19- acres in size. The subdivision will contain 3single-family lots of approximately 0.40 acres each. Portions of all lots and a portion of the access road will be located within the 575' ORW AEC. Individual lots will be sold such that the impervious cover within the AEC will not exceed 25%, and stormwater will be maintained at low density. Waters of the AIWW at this location have been classified ORW by the NC Environmental Management Commission, PNA by the NC Marine Fisheries Commission, and are presently open to shellfishing. The applicant's personal property is located adjacent to the proposed subdivision and currently contains a house and pier with four boat slips. The applicant proposes to expand the existing pier with three additional slips and deed them with the individual subdivision lots. A 6' wide pedestrian easement across Mr. Jackson's property and a 10' wide access easement along the north side of Lot C will give residents access to the pier. Proposed upland development includes the grading of individual lots, paving of the access drive, installation of utilities, and creation of two infiltration ponds. The road will be partially located within the AEC and will add 2,370 ft2 to the impervious cover within the AEC. Individual lots will be held to a maximum impervious cover of 4,000 ft2 under stormwater permitting. Total impervious cover in the AEC not exceed 14,370 ft2 or 11.0%.
