After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written storm plan including a wet detention basin must be approved by DWQ before wetland (or stream) impacts occur. Also before any building is occupied at the subject site the stormwater treatment facilities shall be constructed and operational and the stormwater management plan be implemented. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 2H .0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. You have one month from the date of this Certification to make this payment. The proposed project lies to the south of the Cambell-Gray property along NC 68. The proposed work, which is not associated with, or a part of Piedmont Triad International Airport, includes construction of an office building, associated parking, stormwater improvements, and landscaped areas. The project has been reviewed and approved by the City of Greensboro planning department. Based on the project's location and type of development we feel that this project will have no adverse effects on the Cambell-Gray Farm property. Thank you again for your letter. The channel work, piping and renovation of the existing stormwater facility are required for the following reasons: 1. Initial channelization of the stream in the late 1970's and construction of the stormwater facility created slopes adjacent to the channel and pond greater than 2:1. These slopes have continually eroded and are beginning to slump into the stream. 2. As part of the initial subdivision the channel and stormwater pond were designed to only control volume discharge. 3. The design of the slopes and pond has contributed to the sediment buildup in the pond and a reduction in its volume storage. 4. The existing pipes in the channel are failing and in need of repair. Water is currently flowing under them. 5. The existing pipe outlets have no velocity control measures and continue to erode. 6. The existing steep slopes must be graded to provide flatter surfaces to stabilize the site and for access to and development of the site. To minimize the impacts and improve on the existing channel and stormwater conditions the following is proposed: 1. Eliminate the steep man made slopes adjacent to the channel. 2. Provide velocity control to the system through outlet controls and flatter pipe gradient. The three sections of the existing pipe in the stream have no outlet controls. 3. Renovation of the existing stormwater basin based on BMP's to provide control for the site and up stream runoff 4. Pay a mitigation fee to the N.C. Wetland Fund to mitigate the 266 linear feet of channel which is being piped 18d. The stormwater management plan will be based on BMP's for quality and quantity control. An on-site investigation of the project area was conducted on June 14, 1999. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661.667d). Friendship Airport Development has proposed to pipe and fill approximately 266 linear feet of stream and renovate an existing 0.2-acre stormwater pond in order to build an office building with associated parking and access. This project will impact a perennial stream and 0.2 acres of wetlands in northwest Greensboro, The stream, wetland and existing stormwater pond provide habitat for several fish and wildlife species. At least three species of fish, including sunfish, and several species of frogs, crayfish, and birds are known to use these waters. We have no objections to the proposed renovation and expansion of the stormwater pond; however, we do have reservations concerning tbepiping of the upstream section. This stream is providing benefits to both aquatic and terrestrial Ufe that will be lost when the stream is put in a pipe. High, flashy flows during storm events are characteristic of Greensboro's urban streams due to excessive piping, curb and gutter and other impervious surfaces. The piping of the stream proposed in this project could exacerbate water quality problems in downstream areas and contribute to a decline in aquatic habitat. This stream is part of the water supply for the City of Greensboro and probably should have been protected by a forested buffer. We offt observe Strom bank erosion in urban settings, especially where forested riparian areas. are replaced with grasses. It is our understanding that then habeen problems finding suitable stream mitigation sites in the Greensboro area TherefoMV? , we ser atins about loss of er quality functions and aquatic habitat being rethe impacted watershed by contributions to the NC Wetland Fund. We request that efforts be made to modify this project to keep the creek m an open channel. Consider movin#2 the office building to the southern portion of the property and putting parking lots in the remauung areas around the stream. Parlung decks may also be helpful in reducing the footprint of the project. Stream banks would need to be restored and stabilized with trees and woody shrubs. Because there is a demand for stream restoration mitigation in the Greensboro area, the applicant should be able to get assistance with stream restoration. If the permit is issued for the project as proposed, we request that a 4-6-foot wide littoral shelf be constructed along the edge of the expanded stormwater pond to help mitigate some of the lost wetland functions and aquatic habitat associated with the 0.2 acres of wetland impact. We also request that native herbaceous aquatic plants be established in this littoral zone and that a buffer of native trees and shrubs be established along the remaining wetland and stormwater pond. There appears to be sufficient space for an approximately 50-foot wide buffer along one side of the pond. Along the highway side, the forested buffer should be as wide as space will allow.
