DWQ has no objections to the project plans to add one dock, remove three slips and add
23 new slips. DWQ believes that the total number of slips should be limited so as not to result in
closure of these shellfish waters. Also a pump out facility should be constructed with proper
signage at this facility.

SUBJECT: COMMENTS & RECOMMENDATIONS - CAMA MAJOR PERMIT -
ROSE CRAFT MARINA, CARTERET COUNTY
DATE: June 3, 1999
I would recommend that the number of slips allowed by Rose Craft Marina be limited to
23 additional or 39 total slips. I also offer the following comments and
recommendations:
1. Prior to occupancy of any new slips authorized under this permit, a marina
pumpout sewage disposal facility will be installed and operable, and, maintained
for the life of the marina.
.2. The marina will display a sign showing the location of the location of the onsite
pumpout facility, including other appropriate waste disposal information, at the
entrance and exit from the main piers.
3. No sewage, whether treated or untreated, shall be discharged at any time from
boats using the marina. Any sewage discharge at the facility shall be considered
a violation of this permit for which the permittee is responsible. This prohibition
shall be applied and enforced throughout the entire existence of the permitted
structure.
4 This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the
permit application. No other structures, whether floating or stationary, may
become a permanent part of this marina without permit modification. No non-
water dependent uses of structures may be conducted on, in, or over public trust
waters without permit modification.
.5. The piers, mooring pilings and associated structures shall have a minimum
setback distance of 15' between any parts of the structure and the adjacent
property lines as extended perpendicular to the channel into the water at the
points where they intersect the shoreline.

6. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
7. NOTE: The permittee and/or his contractor is urged to meet with DCM & COE
prior to project initiation.
8. NOTE: Future development on the permittee's property may require a
modification of this permit. Contact a representative of this Division at (252) 808-
2808 prior to commencement of any such activity for this determination.

remove 3 side to slips and add 23 new perpendicular slips.

9. NARRATIVE DESCRIPTION:
Proiect Setting:
The applicant's property is located at 240 Bay View Drive adjacent to Westmouth Bay in the
community of Harkers Island, Carteret County. The property is approx. 7 acres in size, with
approx. 80% being Coastal Wetlands, vegetated mainly with `Juncus roemerianus'. There is an
existing marina basin which measures approx. 500' long x 150' wide with an entrance channel
measuring approx. 800' long x 30' wide x -6'. The center line of the entrance channel splits the
property between the applicant and Mrs. Lucita Mooney. The channel and basin were excavated
prior CAMA regulations and has been maintained several times since it was originally dug (see
Major CAMA Permit #170-73). The South side of the marina was bulkheaded several years ago.
The north side is bordered by Coastal Wetlands and has never been bulkheaded. The high
ground portion of the property is approx. 3-5' above Mean Sea Level. Historically the property
has been used for a boat building facility and a marine railways. The boat building portion of
the operation has closed but the owner still operates a marine railway where he hauls boats for
repairs, sanding and painting. The applicant has 19 boat slips he rents out and Mrs. Mooney was
permitted for 11 slips (see Major CAMA Permit #100-95), but only 9 slips were built. The
applicant recently filled an area of Coastal Wetlands and a Notice of Violation was issued to him.
The applicant restored the area to the saistifaction of this office and installed a retaining wall to
prevent any material from reentering adjacent waters or wetlands. Waters at the project site have
been classified as SA and are closed to the harvesting of shellfish. Water depths inside the basin
average a minus 8' deep at Mean Low Water.
Proiect Description:
The applicant is proposing to replace the docks along the east side of the basin and add a new
dock measuring approx. 380' long x 5' wide running parallel with the shore on the north side.
Mr. Rose plans too remove the 3 side to docking and replace them with perpendicular slips.
Approx. 27 new mooring pilings would be placed 20' beyond the new pier allowing for an
additional 23 boat slips. The typical slip would measure 20' long x 20' wide. The typical boat
would be 22'-40' in length.
Anticipated Impacts:
Approximately 12,500 sq. ft. of Estuarine Waters and Public Trust Areas would be usurped by
the construction of the piers and boat slips. The piers would shade approx. 2,500 sq. ft. of
Estuarine Waters and Public Trust Areas. Some increases in turbidity would be expected during
the construction phase of the project, however one would expect this to be minium and very
temporary in nature with no long term detrimental effects to the habitat. The shellfish sanitation
office has indicated that 50 would be the total number of slips allowed in the basin without
increasing the closure area. Including the 3 slips Mr. Rose plans to remove, this would limit the
Rose property to 23 additional or 39 total slips. All of the proposed docks would be at least 15'
from any riparian property lines. Both riparian property owners have written letters objecting to
the proposed project. No further improvements including bulkheading or excavation is being
proposed at the present time.

N - 76° 36' 26" W; thence across the River to a point on the west shore at 340
4749" N - 76° 37' 14" W.
(b) Marshallberg Boat. Harbor - All those waters within the harbor at
Marshallberg and extending beyond the dockage facilities 275 feet.
(c) N.C. Shellfish Enterprises - All those waters within the docking facilities
at N.C. Shellfish Enterprises and extending beyond the dockage facilities 275
feet.
(d) Taylor's Boat Docks and Railway - All those waters within the canal at
Taylor's Boat Docks and Railway and extending beyond the docking
facilities 200 feet.
