Dear Mr. And Ms. Burch:
You have our approval, in accordance with the attached conditions, to place fill material in 0.21 acres of water for the
purpose of developim, a commercial shopping center at US 70 and Turkey Creek, as you described in your application dated
May 17, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification number 3108. This Certificate allows you to use Nationwide Permit Number 26 when the Corps of Engineers
issue:; it. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .033). In addition, you should get any
other federal, state or local permit before you go ahead with your project including (but not limited to) Sediment and Erosion,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must noti fy us and send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying wit all conditions. If total wetland fills for this
project ,now, or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2I-I
.0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certification. This approval shall
expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining juridictional wetlands and waters or
areas within 50 feet cif all streams and ponds to notify the state in order to assure compliance for future wetland and/or
water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever comes first).
2. An additional condition is that stormwater shall be directed to sheetflow at nonerosive velocities through the protected
stream buffers.
3. A final, written stormwater plan including a wet detention hasin must be approved by DWQ before wetland (or stream)
impacts occur. Also before any building is occupied at the subject site, the approved stormwater treatment facilities shall
he corstnucted and operational and the approved stormwater management plan shall be implemented.
If you do not accept any of the conditions of this Certification, you may ask for an adjudicatory hearing. You must
act. within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 1508 of the North Carolina General Statues to the Office of Administrative Hearings, PO Box 27447, Raleigh, NC
2761 1-7447. This Certification and its conditions are final and binding unless you ask for hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

your application dated 27 May 1999. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of
Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.

The purpose of this letter is to re ues lltion of Nationwide Permit 26 for 0.21
acres. The project is located in ke S LCT 'key Creek and south of Highway
70 near Raleigh, NC (see Site Vicinity Map).
All impacts will result from the fill of jurisdictional waters for parking and retail
buildings commercial development (see Site Plan). The project has been completely
redesigned (copies of previous plans are available upon request) and to minimize impacts
to streams and avoid Neuse Buffers. A site behind the proposed development will be
utilized as a wet detention stormwater basins (see Vicinity Map). The dimensions and
other specific information regarding the stormwater basins can be obtained from Russ
Briggs at the Rose Group (919 829-0555).
Wetland acreage impacts as proposed are below the DWQ 1 acre mitigation threshold.
The i c 00' of DWQ "insi nificant" Cor s unimportant stream is included in the
acreage impact and no mitigation should be require or this work.

it.

Staff biologists with the Wildlife Resources Commission have completed a review of the
subject application to assess impacts on wildlife and fishery resources in the area. Our comments
arb provided in accordance with provisions of the Cleats Water Act of 1977 (33 U.S.C. 466 et
