A. Property Ownership Documentation:
1. In accordance. with 15A NCAC 02T .0504, the Permittee must be the property owner of the parcel
containing the wastewater treatment and disposal system or an agreement between the Permittee
And the property owner shall be established. The current Permittee of this facility is TDM Farms
Inc. and the property owner is William T. Herring. Please do one of the following:
a. Request the Permittee be changed to. William T. Herring by filling out a Non -Discharge
Permit Ownership/Name Change Form (NDPONC 06-16); or
b. Submit an agreement between William T: Herring and TDM Farms, Inc. to lease the
property that is _written, notarized, and signed by both parties, indicating the intended
use of the property, accompanied by a plat or survey map. Lease agreements shall
adhere to the requirements of 15A NCAC 02L .0107.
2. The facultative lagoon at this facility is required to be a minimum of 50 feet away from any property
line in accordance with the setbacks listed in 15A NCAC 02H .02190)(5) when this facility was
originally permitted. It does not appear that the facultative lagoon is located at least 50 feet from
the southern property line shared with Greg Allen Best. Please do -one of the following:
a. Confirm that the lagoon high-water line is a minimum of 50 feet from the, property
line; or
b. Submit a Non -Discharge Wastewater System Waiver (NDWSW 02-19) signed by
Greg. Allen Best allowing the storage and treatment lagoon to be located less than the
required 50 feet from the property line.

monthly pH violations are the most prominent and. they arethe result of the facility not spraying Weekly.
Based on the number of trailers washed on average_(one or two -per day, no more than 10 per 6 day week),
the facility only spray irrigates a couple of times per month to maintain 2'+ of freeboard.
Provide input to help the.permit writer evaluate any requests for reduced monitoring, if applicable.

parts of this application are not completed, this application may be returned to me as incomplete. I further certify that the Applicant or
any parent, subsidiary, or other affiliate of the Applicant has not been convicted of an environmental crime, has not abandoned a
wastewater facility without proper closure, does not have an outstanding civil penalty where all appeals have been exhausted or
