Dear Mr. Zarzecki:
W " On May 11, 1999, I met with you at the subject property to conduct a site visit for the above
referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 99-104.
As a result,it was determined that there are two features present on the property. One feature is at
least intermittent and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters
Management Strategy;Protection and Maintenance of Existing Riparian Areas,Administrative Code
` T15A:02B.0233 (NCAC 0233). The other feature associated with this project is an
t ephemeral/stormwater channel and, as such, is not subject to protection under this Rule.
These two features are depicted on the map received by this Office on May 15, 1999. Due to the
. °: intermittent stream being subject to protection,the grading lines and subsequent sedimentation and
ro erosion control will have to be modified. This letter only addresses the applicability of the Neuse
R
Buffer Rules.
