401 Water Quality Certification
Bent Creek Subdivision
Union County
This Office has conducted an evaluation of a channel proposed to be impacted
during the construction of the subject development. The channel is listed on the current
USGS map as an unnamed tributary to North Fork Crooked Creek. The proposed
subdivision's grading an erosion control plan denotes the channel as beginning on the
northwest corner of the site and eventually passing under the proposed Hemby
Commons Parkway before entering the main segment of North Fork Crooked Creek.
Based on our review, it was determined that the channel did not have sufficient
characteristics for it to be considered as a stream channel nor were any evidence of the
indicator organisms typically noted for 401 mitigation purposes (fish, crayfish, etc.).
Therefore, issuance of a 401 Water Quality Certification and/or stream channel
mitigation will not be necessary for the proposed channel impact. However, please note
that it is the responsibility of the Army Corps Of Engineers (ACOE) to determine
whether or not the channel to be impacted is indeed a stream for which they will claim
jurisdiction. Representatives of the ACOE have also reviewed your photo
documentation of the channel and it's associated characteristics.
