DWQ has no objections to the project plans to construct an open water Marina at Register
Place Estates as long as a 50 foot undisturbed buffer is retained along the Atlantic Intracoastal
Waterway. However, DCM should consider further limiting the number of boat slips in these
SA-ORW (open) waters.

We.have received information concerning the above project from the State Clearinghouse.
A search of our maps and files has located the following structures of historic or architectural importance within the
general area of the Register Place Estates subdivision:
1. The Register House, a house which appears to be more than fifty years old; and
2. A circa 1920s service station and store, located on the NE side of SR 1403, 2.8 miles east of its junction with
US 17
The Register House does not appear to be individually eligible for listing in the National Register of Historic
Places. Although the service station and store were determined to be potentially eligible for listing in the National
Register in 1985, the proposed project should not have an effect on the property.
By letter of June 11, 1999 (enclosed) we recommended that a comprehensive archaeological survey of the property
be conducted. Having made a preliminary reconnaissance survey (summary enclosed), we re-confirm this
recommendation. Given the findings of the reconnaissance, we recommend that any permits issued for the project
include the following condition:
Prior to any ground disturbing activities associated with the proposed Register Place Estates, an
archaeological survey will be conducted of Lots 15-26 at the eastern end of the property, and
the results provided to the NC Division of Archives and History for their review and comment.
We would be happy to help develop a scope of work for the project. Please contact Mark Wilde-Ramsing at our

Thank you for your memorandum of May 21, 1999, concerning the above project.
We have reviewed the above permit application for a proposed twenty-six-lot family
residential subdivision with a twenty-six-slip community marina. Your agency and
the applicant should be aware that the Middle Sound region of the coast is extremely
rich in archaeological remains from the prehistoric and historic period. These include
Native American encampments, eighteenth century plantations, and nineteenth
century farmsteads. The well-drained soils, hardwood forests, and nearby marine
resources made this area attractive to local inhabitants.
There are no known recorded archaeological sites within the project boundaries.
However, the project area has never been systematically surveyed to determine the
location or significance of archaeological resources. Archaeological surveys have
located prehistoric sites 31NH286, 285, 291, and 292 in the immediate area.
We recommend that a comprehensive survey be conducted by an experienced
archaeologist to identify the presence and significance of archaeological remains that
may be damaged or destroyed by the proposed project. Potential effects on unknown
resources should be assessed prior to the initiation of construction activities.
The above comments are made pursuant to Section 106 of the National Historic

September 22, 1999
On September 22, 1999, Nathan Henry performed a field inspection of the proposed
Register Place Estates residential subdivision to determine if a Cultural Resource impact
study was warranted. The property is located off of Middle Sound Road in New Hanover
County, North Carolina.
Most of the 16,5-acre tract is heavily wooded and did not allow for more than a
cursory inspection. Nevertheless, a small portion of the acreage, on the eastern end of the
tract and abutting the intracoastal waterway is cleared, that being the site of the Register
House and two outbuildings. The house is situated on a high bluff, overlooking the
intracoastal watenvay (ICW), that immediately recedes into a Swale just inland of the
house site. On the southern boundary of the house site a small creek extends inland from
the marsh.
Thick grass and foliage cover the cleared area so an inspection of the perimeter of the
yard was made, looking for areas exposed by erosion. The eastern edge abutting the
wetlands exhibited erosion, exposing a quantity of shell. Though no significant cultural
material was found in association with the shell, it had the appearance of prehistoric
midden debris. Further evidence of prehistoric human presence was found directly behind
(westward) of the house and adjacent to the garage. The soil surrounding an uprooted tree
contained a quantity of shell and one prehistoric ceramic fragment (Hanover series, wn
impressed). Several feet away, an eroded area contained an iron nail with the appearance
of nineteenth century type manufacture. No other significant cultural artifacts were found
though bare spats throughout the yard were laden with small, weathered and broken shell,
suggesting plowed midden.
Analysis of the Lieutenant B.E. Blackford C.S.A. Map of Bruns ,ick acrd New
Hanover Counties Showing the Approaches to Wilmington, N, C. (1864) indicates two salt
works in operation in the vicinity of this property. What could be interpreted as a line of
gun emplacements are also indicated lining the southern bank of Pages Creek and
extending southward along the ICW and ending in the vicinity of this property. Since
inouth of Pages Creek faced Masons Inlet in 1864, these batteries could have been used
to deter Federal inoursions t1irough that inlet. The curious topography of the house site
definitely suggests this possibility.
Due to this project's potential for loss of important archaeological and historical
information, it is felt that a professional archaeological firm should perform a cultural
resource impact study.

Based on a review of the subject EA, the following comments should be addressed in the FONSI:
1. As is noted throughout the EA (Page 11, 16, and 19) there are no plans for dredging or excavation
associated with the open water marina option. As detailed on Page 2: "water depths in the area of the
planned community marina range from -2.5' to 3.5' mlw." It seems reasonably probable that future
requests for maintenance or other dredging/excavation activities for some or all portions of this
marina will be made to accommodate deeper draft boats (especially sailboats without swing up
keels) who wish to depart/return from the floating marina during times of low tide. The 401 will be
issued prohibiting dredging in this SA ORW water. Please elaborate on the belief that the 25 to
3.5'm1w depths will be sufficient without dredging.

Response to Division of Water Quality comments:
DWQ stated that "The 401 will be issued prohibiting dredging in this SA ORW water.
Please elaborate on the belief that 2.5' to 3.5' depths will be sufficient without dredging."
Since no dredging or filling of wetlands or waters is currently proposed in association
with this project, it is possible that no 401 Water Quality Certification is required. It is
understood that DWQ will review the project with respect to consistency with state water
quality standards.
According to current DCMrules (T SA:07H.0208), structures cannot extend beyond 114
of the waterbody width. This limitation places the proposed community marina in depths
of 2.5' to 3.5' mlw. Boats occupying the marina will not exceed 24' in length and most will
be shorter. The planned boat lifts on the landward side of the marina are narrower and
will contain the smaller boats (with less draft) occupying the facility. The smaller boats
should be able to enter and leave their slips without problem. The other boats (up to 24)
occupying the outer slips will have the deeper water to assist them. Deep draft fixed keel
sailboats are unlikely to utilize the marina due to the presence of the boat lift cradle cross
beams. Community residents who plan to moor their boats at the marina will be fully
aware of the slip sizes and depth limitations of the facility. Additionally, the planned boat
lifts can allow for the timing of boat trips to benefit navigation.
Environmental Assessment
Register Place Estates, AIWW, New Hanover County
Species of fish that inhabit the AIWW, nearby creeks and Middle Sound are both
migratory and permanently established. Some of the more common fish in the area include
spot, seatrout, croaker, pinfish, menhaden, flounders, mullets, sea robins, lizardfish, porgy,
sheepshead, black sea bass, puffer, needlefish, dogfish and bluefish. The Middle Sound
area is a popular location for fishermen due to the vast network of tidal creeks and the
proximity of Rich Inlet and the Atlantic Ocean.
Proposed Changes The construction of the planned community marina will not
require the closure of any shellfishing areas. U designed 26 Slips which are 24'
long and the occupation of these slips only by boats wit?ads _or cam
eliminates ted shellfishin area. Additionally, the
marina's pilings will provide a hard substrate for oyster attachment and growth
thereby adding to shellfish habitat area.
Marina construction will not involve dredging or impacting the bottom with the
exception of piling installation. This will avoid any substantial disturbance of any
unknown shellfish beds or bottom fishes in the area.
Impacts Considered to be insignificant
Wildlife and Their Habitat The U.S. Fish and Wildlife Service and the National
Marine Fisheries Service have provided the following list of plants and animals which are
Federally-Listed, Candidate Species and Federal Species of Concern which could be
present in the area of the proposed project:

1) This minor modification authorizes the construction of a surface water collection system
immediately north of the authorized roadway fill between stations 32+80 and 34+40 (approximate),
and the construction of a +/- 1.4 acre mitigation site between stations 12+00 and 16+00
(approximate), all as depicted in the attached workplan drawings and the 4/7/99 modification request
letter.
2) This minor modification shall be attached to the Major Modification of Permit No. 7-98, which was
issued on 9/23/98, as well as all subsequent modifications and refinements, and all documents,
including the 4/7/99 modification request letter, must be readily available on site when a Division
representative inspects the project for compliance.
3) All stipulations and conditions of the active permit remain in force under this modification unless
altered herein.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 2001
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

I. PURPOSE. The purpose of this Environmental Assessment (EA) is to provide the North
Carolina Department of Environment and Natural Resources and associated agencies with
a decision making tool to determine if the proposed Register Place Estates project in
eastern New Hanover County is of sufficient impact to the environment as to require the
preparation of an Environmental Impact Statement (EIS). If an EIS is not warranted, a
Finding of No Significant Impact (FONSI) will be issued prior to the action on a CAMA
Major Development Permit. A FONSI does not assure issuance of a CAMA permit. This
EA includes an address of agency concerns received following the April, 1999 submittal
for DENR internal division review (see appendix).
H. PERMITTING. A CAMA Major Development Permit application has been submitted
to the North Carolina Division of Coastal Management and the US Army Corps of
Engineers for review. The State review of this permit application is coordinated by DCM.
Other commenting State agencies include the Divisions of Water Quality, Land
Resources, Water Resources, Marine Fisheries, Environmental Health, Archives and
. History, Community Assistance as well as the Wildlife Resources Commission, the
Department of Administration and the Department of Transportation. Federal review is
coordinated by the Army Corps of Engineers. Commenting Federal agencies include the
Environmental Protection Agency, National Marine Fisheries Service, and the Fish and
Wildlife Service.
III. EXISTING ENVIRONMENT. The project site is located at the intersection of Middle
Sound Loop Road and Mason Landing Road approximately 2 miles east of Ogden in
eastern New Hanover County. The planned development will encompass 16.5 acres and

is currently owned by Edith M. Register. The property is to be purchased by the
developer/applicant, BG Partnership prior to construction. BG Partnership has submitted
an "offer to purchase" for the above property to the owner. Riparian landowners are
Frederick and Lorraine Butler on the south side of the property and William T. and Karen
Allison to the north side.
The tract waterfront has approximately 775 linear feet of shoreline at mean high water
which features a 200' long peninsula extending toward the AIWW. This peninsula was
formed as a result of the excavation of a finger canal on the north side under Corps of
Engineers permitting decades ago. The finger canal has since naturally filled in and has
become revegetated coastal wetland. The remaining narrow upland peninsula formed by
the original sidecasting is still present.
The waterward end of the tract rises quickly to a 26' elevation within 175' of the mean
high water line. This slope provides for an unobstructed view across the waterway to the
back side of Figure Eight Island. From the existing Register home at the top of this slope,
the topography changes little toward the western end of the property at 27' elevation some
2000' away. Soils on the tract are mapped as Lakeland, Seagate and Murville as you move
away from the water. Vegetation within the coastal wetland is dominated by Spartina
alterniflora with S. Patens, Salicornia sp., Borrichia frutescens and Distichlis spicata.
Much of the ground cover around the existing home is St. Augustine lawn grass. The
wooded western remainder of the tract contains Pinus taeda, Liquidambar styraciflua,
Acer rubrum, Pinus serotina, Myrica cerifera and Smilax sp. Trees on the property
suffered from extensive wind damage during 1996 due to hurricanes Bertha and Fran and
further damage in 1998 from hurricane Bonnie.
A hydrographic survey performed recently has shown water depths ranging from -2' mlw
near the end of the peninsula to -13' mlw in the AIWW channel. Water depths in the area
of the planned community marina range from -2.5' to -3.5' mlw. The near edge of the
AIWW channel is located approximately 285' from mean low water off the end of the
peninsula. The mean tide range in this area is roughly 3.4' with a spring tide range of 4.0.
Waters adjacent to the site are classified as SA (open) ORW by the NC Division of Water
Quality. SA waters are suitable for shellfishing for market purposes and any other usage
specified by the SB and SC classifications. Outstanding Resource Waters (ORW) are
unique and special waters of exceptional state or national recreational or ecological
significance which require special protection to maintain existing uses. The intertidal and

subtidal bottom near the project site is not classified as Primary Nursery Area by the NC
Division of Marine Fisheries.
The subject property is zoned R-20S for residential lots of 20,000 square feet or more. The
CAMA Land Use Plan classification is "conservation" and "resource protection".
Drinking water will be provided by Carolina Water and sewer service will be provided by
New Hanover County as funded by a passed bond referendum. Sewer system extension
for the Middle Sound Loop Road area is currently being engineered with construction
projected to follow in late 1999. Currently, one house with a driveway, a garage and a
shed are located on the property.
IV. NEED. BG Partnership proposes to develop the Register Place Estates subdivision to help
provide for the housing needs within this rapidly growing portion of New Hanover
County. Waterfront communities with an associated boating facility are increasingly
popular among lot buyers in this region. The planned development will serve the home
building needs of local residents and people relocating to the coastal area in association
with employment opportunities or retirement plans. The demand for boat slips is
increasing in step with population growth.

The property developer has expended time, effort and capital in the planned project and
anticipates a reasonable return on investment. The developer's financial need is to satisfy
the various investor's economic goals for a real estate venture in a growing market. The
planned project will jointly fill the need of the public by providing opportunities for
A housing and boating as well as offering needed development-related job opportunities
locally.
V. ALTERNATIVE ANALYSIS.
A. No-Build Alternative. The No-Build Alternative would leave this tract in its present state
without providing a valuable opportunity for a waterfront-based community development.
The residential and community marina components of this project would be well served
on the subject property. Available, undeveloped property along the Intracoastal Waterway
in New Hanover County with upland areas at the water's edge is increasingly difficult to
find. This condition provides for maximum amenity appreciation and direct, safe access
s to the community's boat slips. The substantial elevation of the property also offers a good
degree of protection from tidal surges associated with hurricanes which are an on-going
concern in this area.

The combination of the positive property attributes here supports plans for a well planned
residential community with waterfront amenities. The No-Build alternative would be a lost
opportunity to serve the market and the waste of a site suited for permitting and this type
of development.
B. Construction of a Development without a Marina. Without an associated marina, the
development would miss an important opportunity to provide boating access for families
r wishing to enjoy the resources of the AIWW, Middle Sound and the nearby Atlantic
Ocean. Additionally, the local economy would not have the chance to realize the inflow
of investment and development capital provided by the entire project. The combination
of a residential subdivision with a community marina would increase the values of the lots
resulting in maximum benefits to the local tax base.
The existing waterfront conditions are ideal for an open water marina requiring no
shoreline stabilization, no dredging and no wetland impacts. From the community
property, boaters can navigate directly along the AIWW which will provide for the
residents' desire to enjoy fishing, sailing and other water sports.
A centralized community marina under the auspices of the homeowners association would
offer the advantages of facility maintenance, pollution control and safety for residents. The
planned facility would eliminate the need for additional individual residential piers which
would be allowed under CAMA General Permits and would be covered by the general
and specified additional conditions of the CAMA Major Development Permit.

C. Construction of a Development with an Upland Basin Marina. Following
consideration of the construction of an upland basin community marina, the developer
decided not to pursue this alternative for several reasons:
Topographic and Spacial Limitations. In order to minimize coastal wetland
impacts, the entrance channel for an upland basin mama would need to be aligned
along the existing peninsula area. This upland peninsula averages approximately
22' wide between wetland lines (narrower near the outer end) and would restrict
boat traffic, especially in a two way situation. Additionally, the construction of a
permanent entrance channel involving the excavation of 4,600 cubic yards of
material would require stabilizing each side which would be difficult without
placing some form of bulkhead deadmen beyond the new channel limits (within
and impacting coastal wetland). Stabilizing the same entrance channel with rock

would require sloping the face of the material to the excavated bottom further
narrowing the navigable width by producing at least a 1:1 angle of repose to the
channel depth on each side. For a 5' deep channel this would reduce the width of
the channel bottom by at least 10' leaving at most a 12' wide channel bottom. This
would present an unreasonable hazard to navigation for neighborhood boaters.
Direct and indirect impacts to a significant area of Spartina alterniflora marsh
would be unavoidable with even this minimal 22' wide channel.
Excavation of the channel would extend beyond the tip of the peninsula to the -5'
mlw contour roughly 230' away. This represents an additional, avoidable impact
to benthic organism habitat and public bottom.
An upland basin within the waterward end of the tract to accommodate the same
number and sizes of boats as proposed along with the necessary bulkhead would
require creating a permanent 228'x 102' hole to a depth of -5' mlw. The excavated
area would need to be wider and longer at the surface to accommodate a sloping
bank from the bulkhead cap area up to the current ground elevation. The basin
would permanently displace approximately 20,000 cubic yards of material and a
?? much greater volume (an additional 7,000 to 8,000 cubic yards) temporarily to
provide a safe and stable working environment during installation of the bulkhead
and deadman system. The excavation of the entrance channel would involve
removing an additional 4600 cubic yards of material. To avoid wetland excavation
during construction of the surrounding bulkhead and deadman system as well as
avoiding slope excavation into neighboring property, the rectangular basin would
be positioned inland and the top slope would extend inland to the 26' elevation
contour. This would result in a 31' deep excavation and require a tremendous earth
stabilization effort utilizing a rocked 1:1 slope above the top of the bulkhead ri sing
vertically some 20'.
Loss of Buffer. It is well recognized that the presence of a vegetated buffer along
the shoreline provides a valuable function for the environment. The Coastal
Resources Commission (CRC), as part of their proposed "Coastal Shoreline"
rulemaking, is currently proposing (among other items) the preservation of
required vegetated buffers..... "The purpose of buffers is to reduce wetland and
water quality impacts by moderating the speed and effects of stormwater runoff
including stabilizing soil to prevent erosion; filtering suspended solids, bacteria
and viruses, nutrients and pollutants, and moderating water level fluctuations.

Buffers also provide and enhance essential wildlife habitat and reduce direct
human effects. Buffers also contribute to the overall scenic quality of the shoreline
0 environment." An inland basin marina would effectively remove a large portion
of the existing completely vegetated buffer area between the top of the natural 26'
slope and the shoreline. The water's edge would be pulled much closer to the
development's needed impervious surfaces for road pavement and future
homesites. The steep rocked slope to the basin's edge would offer little attenuation
or treatment of surface flows to the basin's edge. Much of the stated benefits
relating to buffer preservation would be lost contrary to the intent of the CRC.
Cost. The cost of such an upland basin project would be prohibitive and an
unreasonable burden to the developer. Additional costs over and above the
proposed project would be associated with excavating well over 30,000 cubic
yards of material and engineering then constructing a very substantial reinforced
concrete bulkhead system with an extremely high riprapped slope above it up to
the existing grade level at the inland end of the basin. Any future maintenance of
the deadman system behind the basin wall would be a major undertaking due to
the large amount of slope material and rock removal necessary. The inland wall of
the bulkhead would need to be designed to bear approximately three times the load
of retained material (compared to a flat site) due to the topography here.
An upland basin would also translate into the loss of the most valuable acreage on
the property for lot sales. Waterfront lots represent the primary profit in this type
A of residential subdivision. With the upland basin, there would be no waterfront lots
available due to the common area which would be designated around the marina
and the fewer, remaining lots would be positioned away from the best views in the
development. Estimated additional costs with an inland basin marina:

It is recognized that an upland basin marina normally costs more to construct than
an open water marina However, the estimated additional costs of constructing an
upland basin on this site with its associated high topography over constructing an
upland basin on a topographically flat site total $244,000. These additional costs
are related to additional overburden material removal and backfill, rock work for
bank stabilization, bulkhead modification in higher load-bearing areas, grading
and shaping of additional removed material and additional engineering costs.
Flushing, /Water ".. An open water siting for the proposed 26 slip system will
maintain the maximum positive aspects of tidal flushing. The floating dock system
will not inhibit the flow of beneficial ebb and flow currents past the site. Upland
marina basins can and do have a degree of water exchange reduction associated
0 with their physical nature. In general, the more narrow the entrance channel - the
greater the restriction to tidal exchange. The extremely narrow entrance channel
described above (for the avoidance of even greater significant coastal marsh and
benthic habitat destruction) would result in impacts to dissolved oxygen levels
within the basin. Open water systems offer the least restriction to complete tidal
exchange.
In January, 1990, the Department of Environment, Health and Natural Resources
Division of Environmental Management Water Quality Section issued a
publication titled North Carolina Coastal Marinas: Water Quality Assessment.
This report summarized the results of water quality surveys performed in eight
upland basin marinas along the coast and the developed Marina Dissolved Oxygen
Model. The executive summary within the report stated that "Encouraged by state
antidegradation policies, and to minimise impacts to sensitive shellfishing areas,
developers in North Carolina have recently favored marina basins from upland
areas and then connecting the basins to existing waterways via small canals or
. inlets. It is recognized that this design, hereafter referred to as a two-segment
(basin and channel) marina, tends to create localized areas with poor flushing,
which in turn may result in stagnation and an increased accumulation of pollutants
within a marina." Among the study's conclusions were:
"The most pronounced differences between marina basins and ambient
waters were in dissolved oxygen concentrations. Approximate average
basin DO reductions from ambient levels were 0 to I mg/I for basins

a
located near inlets and 1 to 2 mg/l for those located some distance from an
inlet."
"Marina configurations which promoted flushing exhibited better dissolved
oxygen conditions than those with restrictions (such as narrow entrance
channels) or stagnant areas (from off-center entrance channels, bends,
comers)."
"Sediment oxygen demand (SOD) was measured at three marinas. Rates
were higher than expected, ranging from 2.60 to 5.36 g 02/m2/day in the
marina basins."
"A simple DO model reasonably predicted field results. The model
indicated that:
a) Sediment oxygen demand (SOD) was the major influence on DO
predictions;
b) Number of boats in basin had a negligible impact on DO
predictions; and
c) Increasing the number of segments in a basin design decreased
basin DO."
The report also addressed dissolved oxygen concerns: "Effective November 1,
. 1986, the Environmental Management Commission (EMC) passed rules which
established that newly created areas of saltwater which are connected to SA waters
by approved projects will be classified as SC. The intent of this action was to
encourage the construction of marina basins in dug-out, high ground areas rather
than locating them in SA waters. It was thought that the newly created basins
would provide better environmental protection because marina effects would be
0 contained. A potential problem with this policy was that some of these basins
could develop localized DO problems." Further: "North Carolina water quality
standards state that DO shall be "not less than 5.0 mg/l, except that swamp waters,
poorly flushed tidally influenced streams or embayments, or estuarine bottom
waters may have lower values if caused by natural conditions (NCDEM 1989a)."

for many two-segment marinas to achieve because reduced water circulation favors

to be lower than in adjacent open waters."

The Marina Dissolved Oxygen Model was run for the subject Register Place
Estates upland basin alternative. Ambient water quality data was provided by the
Division of Water Quality from their monitoring station located at channel marker
123 near Howe Point which is approximately 1 mile south along the waterway
from the project site. The project site is 2.5 miles by water from Mason Inlet.
However, the inlet is heavily shoaled and Mason Creek (which connects the inlet
with the waterway) goes dry at low tide demonstrating a reduced hydraulic
influence on the area. Dimensional information used for the model which depicts
marina surface area, channel surface area and depths was taken from the drawn
upland basin alternative. The tidal range of 3.4' which was used in the model
represents the average between the 3.8' range at Masonboro Inlet and the 3.0'
range at New Topsail Inlet. The project site is roughly halfway between these
inlets for which tidal range data is available from NOAA's National Ocean
Service. The actual average tidal range at the project site is likely smaller than 3.4'
due to its position farther inland from the inlet mouths and the condition of Mason
Creek. Model runs were performed using SOD levels of 1, 2 and 3 gm/m2-day as
recommended by DWQ to produce a range of predicted DO levels for analysis
(higher SOD levels result in lower predicted DO levels). These SOD levels
represent the anticipated range by DWQ staff for a basin in this area. The state
report contained only one marina basin which was actually sampled for SOD in the
southern coastal area, Tangle Oaks Marina. The sampled SOD level was 5.4
gm/m2-day which was high and not truly representative for comparison purposes.
(Actual SOD sampling was performed at a total of three basin marinas along the
state's coastline detailed in the state report. The samples produced SOD levels of
between 2.6 and 5.4 gm/m2-day.) The following are the model DO predictions for
the upland basin alternative:

The model runs indicate a predicted failure to meet the state water quality standard
for DO of 5.0 mg/l at a point between SOD levels of 1 and 2, (less than the
minimum state-sampled basin SOD level of 2.6). The model in association with
the data contained within the state report does not indicate an optimistic outcome
for the basin's resulting DO levels and its ability to meet and maintain minimum
state standards. Discussions with DWQ's Environmental Sciences Branch on the
results of the above model runs indeed indicates a predicted denial of a 401 Water
. Quality Certification for the inland basin. Without this approval, a CAMA Major
Development Permit cannot be issued.
Groundwater Impacts. The excavation of a 31' deep hole to accommodate the
upland basin would create a cone of depression in the watertable to an unknown
distance. The effect of this lowering of the watertable and associated impacts to
0 drinking water wells, irrigation wells or jurisdictional wetlands in the area are at
present unquantifiable but need to be mentioned in this alternatives analysis.
Use Standards. State guidelines for Areas of Environmental Concern within the
Administrative Code [T15A: 07H .0208 (b) (5) (A)] detail four marina siting
scenarios in order of preference for the least damaging alternative. Further,
"marina projects shall be designed to have the highest of these four priorities that
is deemed feasible by the permit letting agency." The following are the four
marina siting priorities and how they relate to the subject property:
(I) an upland basin site requiring no alteration of wetland or estuarine habitat
and providing adequate flushing by tidal or wind generated circulation;
Upland basin access on the subject site is impossible without the alteration
of wetland and estuarine habitat. Upland basin construction is also
considered to be unfeasible for the reasons discussed in this section.
(ii) an upland basin site requiring dredging for access when the necessary
dredging and operation of the marina will not result in the significant
degradation of existing fishery, shellfish or wetland resources and the basin
design shall provide adequate flushing by tidal or wind generated water
circulation;

The basin entrance channel excavation will destroy an area of coastal
marsh 366 square feet in size and channel side stabilization will potentially
impact an area of coastal marsh totaling 7,590 square feet. The work
beyond the marsh will destroy an area of benthic habitat 5,060 square feet
in size and potentially impact an additional 2,120 square feet of
unvegetated intertidal habitat. These impacts (which are avoided with the
proposed open water siting) could be interpreted to be a significant
. degradation. Furthermore, the adequate flushing of the basin as required
for this siting alternative is in serious doubt due to the long, narrow
entrance channel and as demonstrated by the results of the DO modeling.
Upland basin construction is also considered to be unfeasible for the
reasons discussed in this section.
(iii) an open water site located outside a primary nursery area which utilizes
piers or docks rather than channels or canals to reach deeper water;
This marina siting reflects the proposed project. The site is outside a
primary nursery area and the project will utilize a pier and floating dock
system to reach deep water without dredging a channel. This marina siting
alternative is also considered to be feasible. Accordingly, the applicant
will also obtain an easement for the area of public bottom occupied by the
marina following permitting.
This preferred marina siting also avoids:
404 wetland impacts
Coastal Wetland AEC impacts
Benthic and intertidal habitat dredging impacts
Loss of existing vegetated shoreline buffer
Area groundwater impacts
Violation of state water quality standards for DO
(iv) an open water marina requiring excavation of no intertidal habitat, and no
dredging greater than the depth of the connecting channel.

The proposed project satisfies the preferred alternative (iii) above.

Consistency with Local government.
On January 4th, 1999, the New Hanover County Board of Commissioners
approved a Special Use Permit for the proposed open water community marina.
The Special Use Permit reflects an open water system with its associated lot
layout. It does not approve a basin marina with a resulting altered lot layout. An
upland basin marina has not been approved by the County.
D. The ARplicant's Preferred Alternative. The Register Place Estates development
will consist of a 26 lot single family subdivision with minimum lot sizes of 20,000
square feet and a 26 slip open water community marina. Individual lots will be
offered for sale by the developer for custom home construction purposes. All
infrastructure for the subdivision will be installed by the developer.

All upland development will utilize standard construction techniques and
procedures. A stormwater plan has been submitted to the Division of Water
Quality for review and approval prior to CAMA permit issuance as well as a
sedimentation and erosion control plan submitted to the New Hanover County
Engineering Department.
The community marina will be constructed for use by lot owners, the developers
and their guests only. No fuel sales, marine service, transient dockage or sale of
marine supplies will take place in the marina. Boat lengths will be limited to 24'
and no boats with heads or cabins will be allowed in the marina. The outside slip
pilings will be located 29' from the southern riparian line and 66 from the northern
riparian line. The waterward mooring pilings will remain 150' from the near edge
of the 90' A1WW channel. The approach to the marina's floating dock system will
be along an elevated wooden pier extending -70' beyond the rocked tip of the
peninsula and measuring 6' wide with an associated 16'x16' gazebo. A 20' long
ramp will lead down to the floating docks from the end of the pier. The floating
dock spine will be 8' wide and 185' long with 5' and 4.5' x 24' double loaded
fingers on either side. The 26 individual slips will be configured to accommodate
electrically powered boat lifts. Boat lifts are preferred by the developer due to the
open water nature of the marina and potential impacts by boat wakes and wind
generated waves during storms. Boat lifts also reduce boat maintenance including
the need to apply anti-fouling bottom paint. The total length of the community
marina waterward of the vegetation line is 137' which is less than 1/4 of the

a
distance across the waterbody. A wooden cart path will extend from the open
space between lots 18 and 19 to the upland peninsula for access to the community
marina.
VI. ENVIRONMENTAL CONSEQUENCES.
A. Changes in Land Use. The current county zoning of the tract as R-20S is suitable for the
proposed residential neighborhood in that is permits individual lots of 20,000 square feet
or more. A special use permit is required from the county for the community marina
portion of the project and has been obtained prior to action on the CAMA Major
Development application. The CAMA Land Use Plan classification for the property is
Conservation and Resource protection.
Proposed Changes. The proposed Register Place Estates development will
subdivide the property into residential lots which are compatible with local zoning.
The actual use of the tract will shift from a single home site to multiple home sites
with a community marina amenity as approved by the New Hanover County
Planning Board and Commissioners. The property is well suited for the proposed
project and will fulfil the intended use by the county zoning ordinance in addition
to remaining consistent with CAMA Land Use Plan classifications.
Impacts The proposed project will meet the long term planning objectives
established for the property and thus not negatively impact land usage.
B. Wetlands. Jurisdictional 404 wetlands were delineated on site and those boundaries
approved by the Corps of Engineers in June, 1998. The delineation was surveyed and
appears on the enclosed plat. Jurisdictional wetlands cover 5,085 square feet or 0.12 acres
and represent only 0.7% of the entire tract area. These wetlands are adjacent to the AIW W
shoreline and are dominated by Coastal Wetland AEC species adapted to regular or
occasional tidal inundation. Only the riprapped waterward tip of the upland peninsula is
not bordered by coastal marsh.
Proposed Changes The proposed project has been planned to avoid impacts to
wetland areas. There are no planned areas of wetland fill or excavation.

C. Prime or Unique Agricultural Lands. No agricultural land exists within the boundaries
of the project property.
D. Public Lands. No public lands are located above mean high water on the subject
property. An easement for areas of public bottom occupied by the proposed community
marina will be obtained following permitting as required.
E. Scenic and Recreational Areas. The Register Place Estates property overlooks the open
water of the AIWW and approximately 4,000 feet of coastal marsh across Middle Sound
to the rear of Figure Eight Island. This impressive scenic view will be an essential part of
the project's appeal to lot buyers, residents and guests. The development will serve to
enhance the appreciation of this vista.
The planned community marina will serve residents and their guests by providing a safe,
convenient boating access point from which to enjoy the many recreational opportunities
offered by the waterway, Middle Sound and the Atlantic Ocean.
Proposed Changes. The proposed project will allow for the increased opportunity
by residents and guests to take advantage of both scenic and recreational resources.
Impacts Considered to be positive.
F. Areas of Archaeological or Historic Value. No areas of archaeological or historical
significance are known to exist on the subject property.
G. Air Quality. The Wilmington Regional Office of the North Carolina Department of
Environment and Natural Resources has jurisdiction over the air quality in this location.
It has been determined that the ambient air quality for New Hanover County is in
compliance with the National Ambient Air Quality Standards.
Proposed Changes The proposed Register Place Estates project will not create
a significant adverse effect on the current air quality of New Hanover County. Any
air quality impacts from the operation of construction equipment will be short-term
and minor. Elevation of airborne pollutants should be insignificant and represent
the level of a small on-going construction site elsewhere. During the life of the
proposed project, compliance with air quality standards will be required at the
State and local level.

Impacts Considered to be insignificant.
H. Groundwater Quality. The proposed project will utilize the existing drinking water
system along Middle Sound Loop Road owned by Carolina Water thereby avoiding the
necessity of on-site drinking water well installation. No irrigation well installation is
planned. All residential waste treatment will be handled by the New Hanover County
Sewer System. No waste treatment will occur on the project property. There are no plans
for any fueling systems or buried underground storage tanks within the subdivision.
Stormwater for the neighborhood will be controlled through the use of grassed swales to
filter and treat runoff from impervious surfaces such as rooftops, streets and driveways.
The R-20S zoning serves to limit the number of future homes within the development and
a project of this nature falls under density limits with regard to stormwater. No ponds for
the purpose of treatment of stormwater will be constructed.
Proposed Changes The planned Register Place Estates project will not intercept
any known aquifer during construction or occupation. No excavation beyond the
laying of utility lines and customary site grading is proposed. Changes to
groundwater quality are not anticipated with the proposed development.
Impacts Impacts to groundwater quality are considered to be insignificant.
I. Noise Levels. The proposed project is not anticipated to elevate noise levels above general
ambient conditions.
L Water Supplies. Water to the proposed project is to be provided by Carolina Water. The
development will neither affect the ability of this system to serve its current users nor
affect existing private wells in the area.
K. Shellfish. Fish and Their Habitats. As mentioned, the waters adjacent to the project site
are classified as SA ORW and are suitable for the harvest of shellfish for human
consumption. Quantities of clams and oysters are at present unknown along the immediate
shoreline. (However, NC Marine Fisheries staff has verbally indicated the absence of a
significant resource at the marina site.)

Species of fish that inhabit the AIWW, nearby creeks and Middle Sound are both
migratory and permanently established. Some of the more common fish in the area include
spot, seatrout, croaker, pinfish, menhaden, flounders, mullets, sea robins, lizardfish, porgy,
sheepshead, black sea bass, puffer, needlefish, dogfish and bluefish. The Middle Sound
area is a popular location for fishermen due to the vast network of tidal creeks and the
proximity of Rich Inlet and the Atlantic Ocean.
Proposed Changes The construction of the planned community marina will not
require the closure of any shellfishing areas. The designed 26 slips which are 24'
long and the occupation of these slips only by boats with no heads or cabins
eliminates the necessity for a prohibited shellfishing area. Additionally, the
marina's pilings will provide a hard substrate for oyster attachment and growth
thereby adding to shellfish habitat area.
Marina construction will not involve dredging or impacting the bottom with the
exception of piling installation. This will avoid any substantial disturbance of any
unknown shellfish beds or bottom fishes in the area.

species and are listed to protect these species. These species are not
biologically endangered or threatened and are not subject to Section 7
consultation.
As with any plant or animal species, their presence and abundance is determined by the
availability of suitable habitat for existence and proliferation. The existing site and future
development project offer no suitable habitat for the listing of endangered and threatened
species.
M. Introduction of Toxic Substances. No toxic substances are to be introduced to the site
environment. No marine service, haul out or boat hull scraping and painting will take
place at the planned community marina.
Proposed Changes Site development will utilize standard and customary construction
techniques and materials without the introduction of any toxic substances to the
environment.
Impacts No introduction of toxic substances is planned with the proposed project,
therefore no impacts are anticipated.
N. Eutroahication of Receiving Waters The proposed Register Place Estates project has
been planned to avoid the elevation of nutrient levels in the adjacent waters of the AIW W.
The completed development will comply with Division of Water Quality regulations
through the approval of a stormwater management plan. A sedimentation and erosion
control plan will be approved by the Division of Land Quality to prevent erosion and the
transport of sediment off site. No eutrophication is anticipated.
V. MITIGATIVE MEASURES The developer of the Register Place Estates tract has taken
several measures during the planning process to reduce or eliminate impacts to the
environment:

residential home sites and community infrastructure away from the shoreline. The

community marina layout allows pier access to the boat slips directly off the
existing riprapped tip of the upland peninsula and avoids any dredging in benthic
or intertidal habitat and the need for shoreline stabilization work. Section 404
wetland impact has also been avoided.
The design of the planned community marina has been limited so as to avoid a
closure of open shellfishing waters.
The open water siting of the marina avoids the reduction of tidal water exchange
associated with an upland basin and the expected impacts on water quality. This
plan also provides for the preservation of the beneficial vegetated buffer near the
shoreline.
VI. FINDINGS. The proposed Register Place Estates project is not expected to significantly
affect the quality of the environment. The subject property appears to be well suited for
the residential and marina components of the development. The developer has succeeded
in planning to avoid and minimize impacts as outlined. Several positive aspects of the
project include enhancement of access to local waterways and associated estuarine
resources; the enjoyment of local scenic and recreational opportunities; and employment
opportunities for area builders and addition to the local tax base.
Since impacts to the environment are considered to be insignificant, preparation of an
Environmental Impact Statement is not warranted. If this determination is confirmed
during Departmental review, the major permit coordinator may add a Finding of No
Significant Impact (FONSI) statement to the EA prior to State Clearing House review.
Following satisfaction of the requirements of the NCEPA, the Division of Coastal
Management may take action on the CAMA Major Development Permit application.
b VII. COMPLIANCE WITH ENVIRONMENTAL REQUIREMENTS.
Federal Review of the CAMA Major Development Permit application by federal
agencies is coordinated by the Army Corps of Engineers. The Corps will review the
application for compliance with section 10 of the Rivers and Harbors Act of 1899 which
covers construction, dredging, filling and other work in navigable waters. The Corps will
also review the application for compliance with Section 404 of the Clean Water Act which
covers the discharge of dredged or fill material into any waters or wetlands.

Distribution of applications is handled by the Corps to the Environmental Protection
Agency, the National Marine Fisheries Service and the U.S. Fish and Wildlife Service for
A their review and comment. Comments from these agencies are received and considered
by the Corps prior to any permit issuance.
State. The Division of Coastal Management coordinates the review process for all relevant
state agencies. State authorizations include the Coastal Area Management Act; Dredge
0 and Fill Act; Water Quality Certification; and Easement in Public Trust Areas.
Application copies are distributed by DCM to the state agencies for comment prior to any
permit issuance.
North Carolina Environmental Policy Act. The proposed project involves the use of
public lands below mean high water and therefore requires compliance with the NCEPA.
This Environmental Assessment is being submitted as documentation for such
compliance. Based on the assessment of impacts by the proposed project, a FONSI will
be issued or preparation and review of an Environmental Impact Statement will be
required prior to permit action.
Prior to the construction of the proposed marina portion of the project, the applicant will
apply for and receive an easement in the State-owned, submerged land from the
Department of Administration State Property Office as required under NCGS 146-12(e).
0 VM. NOTIFICATION.
Riparian Landowners As required, all riparian landowners will receive copies of the
CAMA Major Permit application materials. Copies are sent by certified mail. Riparian
landowners have 30 days to submit written comments to DCM.
Public Notice. DCM will issue a notice of application for a CAMA Major Development
Permit in the local newspaper as part of their review process.
Environmental Assessment Submittal: This EA is being submitted to Mr. John Parker
of the Division of Coastal Management office in Raleigh, N.C. for circulation to
commenting state agencies.

9. PROJECT DESCRIPTION:
The project site is a 16.5 acre tract of land located at the intersection of Mason Landing Road
(NCSR 1401) and Middle Sound Loop Road (NCSR 1403) in New Hanover County. The
propertyis located adjacent to the Atlantic Intracoastal Waterway (AIWW) and is approximately
2,000 feet south of the mouth of Pages Creek. To find the property, starting in Ogden at the
intersection of US Highway 17 and Middle Sound Loop Road, one would travel east on middle
Sound Loop Road approximately 2.8 miles. The entrance to the property will be on the left at
1821 Middle Sound Loop Road. The existing gravel driveway (approximately 900' long) ends
at the Register house.
The 16.5 acre tract is approximately 350' wide by approximately 2,200' deep and has
approximately 300' of frontage on the AIWW (Middle Sound). Near the middle of the property's
waterfront is an approximately 30' wide high ground peninsula which extends an additional 230'
into the waters of Middle Sound. Moving west from the Middle Sound Shoreline, the tract rises
sharply for the next 170' to an elevation of approximately 26' above mean sea level. The
remainder of the tract is relatively flat with the exception of a drainage feature which runs
eastward along the southern property boundary for approximately 600' before entering Middle
Sound. Existing high ground development on the tract includes a single family dwelling (the
Register house), a garage and a shed. The three structures lie at the top of the slope overlooking
the AIWW. The existing house is served by a private well and septic tank. Vegetation on the tract
in the area between the existing structures and Middle Sound consists primarily of lawn grasses,
ornamental shrubs, Pecan (Carya illinoensis), Laural Oak (Quercus laurifolia), Magnolia
(Magnolia grandaflora), a few scattered Live Oaks (Quercus virginiana) and several pine species.
The remainder of the tract to the west is more heavily wooded and is dominated by Loblolly Pine
(Pinus taeda), Sweet Gum (Liquidambar styraciflua), Red Maple (Acer rubrum) and Wax Myrtle
(Myrica cerifera). The applicant states that a professional archaeological assessment has not been
done for the tract.
Extending from the edge of high ground waterward is a border of Smooth Cordgrass Marsh
(Spartina alterniflora). This marsh area is approximately 150' wide at the northern property
boundary and approximately 300' wide along the southern property boundary. Extending through
this marsh border is the high ground peninsula which terminates approximately 30' waterward of
the outer edge of marsh. The perimeter of the peninsula has been stabilized over the years with
broken concrete, asphalt and bricks. Along the slope of the peninsula is a border of Sea Ox-eye
(Borrichia frutescens). Coastal wetland species present along the slope of the peninsula include
Salt Meadow Grass (Spartina patens) and Salt Grass (Distichlis spicata). On the northern side of
the peninsula, near the high ground, the marsh area is interrupted with an area of open water
approximately 30' X 90', which is probably a remnant of past dredging events during the creation
of the peninsula.
The open water portion of the AIWW adjacent to the property measures approximately 550'
across. Existing water depths range from approximately -2.0' MLW near the end of the peninsula
to approximately -13' MLW at the near-bottom edge of the federal channel approximately 285'
to the east.

The Wilmington-New Hanover County Land Use Plan classifies the area within the 100-year
floodplain as Conservation. The remainder of the high ground area is classified as Resource
Protection. The waters of Middle Sound and the AIWW are classified SA - Outstanding Resource
Waters (ORW) by the Division of Water Quality. The area is not designated as a Primary
Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish.
The applicant is proposing the development of Register Place Estates, a 26 lot, single family,
residential subdivision. Development will include the initial grading and filling of approximately
10 acres of the tract for road construction, utility installation, and building lot preparation.
Individual lots will range in size from 20,000 to 32,000 sq. ft.. Two entrance roads, one off
Mason's Landing Road and one off Middle Sound Loop Road, and three cul-de-sacs would
provide vehicular access to the proposed building lots. No direct vehicular access to the lots
would be available from the existing public roads. The subdivision's sanitary sewer system is to
be connected to the New Hanover County system once the County has provided service to the
Middle Sound area. The applicant states that construction of the Middle Sound sewer system is
expected to begin this year. No on site sewer systems are currently proposed. Potable water
service is to be supplied by a community water system by Carolina Utilities.
The applicant also proposes the construction of a 26 slip residential marina to provide water access
for the lot owners of the subdivision. The docking system for the marina would consist of a 8'
wide x 185' long floating dock connected to (13) 4.5' x 24' and 5' x 24' floating finger piers,
each serving two boat slips. Each boat slip would contain a boat lift capable of lifting up to a 24' N?
vessel. The applicant states that only open run-about type boats, 24' in length or less, with no
cabins or heads, would be allowed at the marina. Water depths at the waterward end of the
marina would be approximately -3.3' at MLW. Access to the marina will be provided by a 6'
wide x 70' long elevated wooden pier extending from the end of the high ground peninsula.
Along the pier, at a point approximately 35' from the end of the peninsula, a 16' x 16' gazebo
is proposed. High ground access to the community marina would be by way of a 6' wide elevated
wooden cart path beginning at the common area adjacent to lot 19, then running along the
southern property boundary for lot 19, along the water frontage of lots 19 and 20 to a point
approximately 100' out onto the peninsula. The original plans (dated October 22, 1998) submitted
with this application show the cart path extending the full length of the peninsula as well as a golf
cart parking area. A revised plan (dated April 28, 1999) showing the current cart path proposal
and cross section is attached with this report.

10. ANTICIPATED IlUFACTS
The construction of the proposed roadways and utilities would disturb approximately one acre of
high ground area.. Future lot clearing/grading will disturb an additional nine acres of high ground
area. The applicant states that 5 % of the 575' ORW Estuarine Shoreline Area of Environmental
Concern (AEC) would be covered by proposed roadways and that less than 20% of the AEC
would be covered by built-upon area for future lot development. Total built-upon area within the
AEC would be less than 25 %. The applicant has submitted an application for a State Stormwater
Permit which is currently under review by the Division of Water Quality. The proposed
community marina would incorporate approximately 10,616 sq. ft. of Public Trust Area. The
structure would extend approximately 137' into a 550' wide body of water and would terminate
approximately 150' from the near-bottom edge of the federally maintained channel. Short term
increases in turbidity can be expected during piling placement.

SUBJECT: Environmental Assessment (EA) for Register Place Estates Residential Subdivision
and Community Marina, AIWW east of Ogden, New Hanover County, North
Carolina. Project Number 991.
The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. A site visit was made on May 4, 1999. Our comments are
provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661 et seq.); Section 401 of the Clean Water Act (as amended), and North
Carolina General Statutes (G. S. 113-131 et seq.).
The preferred alternative for the project is to construct a 26-lot subdivision and 26-slip
open water marina with gazebo on 16.5 acres adjacent to the AIWW. Other alternatives
examined were A. no build, B. a subdivision without a marina, and C. a subdivision with an
upland basin marina. Alternatives A. and B. were dismissed as lost opportunities to serve the
waterfi•ont real estate market. Alternative C. was not pursued because of logistical and dissolved
oxygen concerns. The property is mostly high. ground vegetated with lawn grasses around the
residence and early successional forest (wax myrtle, red maple, water oak, greenbriar, grape,
loblolly pine, magnolia, and sweet sum) landward of the residence. A fiinge of coastal wetlands
occurs along the shoreline except where a peninsula of high ground protrudes into the AIWW.
Upland areas provide deer, rabbit, opposum, squirrel, and songbird habitat. Coastal wetlands
provide habitat for red wing blackbird, wading birds, waterfowl, fiddler crab and other
invertebrates, and juvenile fish of various species. We observed oysters attached to riprap during
our site visit. Area waters are classified SA-Outstanding Resource Water (ORW) and are open to
shellfish harvest.

The EA has gone to some length to justify why the project should be constructed on an
ORW. Wetland impacts are to be avoided, no dredging is proposed, the marina is to be limited to

24 ft. boats without heads or cabins, and no fuel, marine services, transient dockage, or sale of
marine supplies would be provided. However, we think there is a good possibility that shoaling
would eventually occur around the docks and prompt future requests to dredge in an ORW.
Jetting of pilings into substrates could elevate turbidities, perhaps to the point of stressing
estuarine organisms in an ORW. We also question the EA's contention that no shellfish closure
would occur. This should be substantiated by Shellfish Sanitation. The development would
increase stormwater runoff into an ORW and diminish the site's forest habitat component. A non-
water dependent gazebo would be constructed over sensitive estuarine waters and an
undetermined quantity of public trust waters would be incorporated. Finally, navigational safety
in this section of the AIWW may be compromised if the project extends beyond the established
pier head line.
For these reasons, we prefer alternative B. (a subdivision without a marina). We believe a
0 subdivision with a pedestrian walkway and/or common area along the shoreline would provide the
owners with a reasonable return on their investment and minimise impacts to sensitive estuarine
waters. However, if alternative B. is not possible, we can concur with the EA under the following
conditions.
. 1. A binding agreement will be reached prohibiting current or future dredging at the
project site
2. Dock and pier pilings will not be jetted in place to minimise adverse turbidity impacts
in an ORW.
3. Enough shoreline exists for the proposed marina area per CAMA rules.
4. Shellfish Sanitation confirms that no shellfish closure will occur.
5. All of the more stringent water quality regulations for ORWs (particularly stormwater)
regarding setbacks from shoreline, impervious surfaces, etc. are strictly adhered to.

6. Forested habitat will be preserved wherever possible.
7. The non-water dependent gazebo will be relocated to high ground.
8. Docks, including occupied boat slips, shall not extend beyond the established pier head
line.

Response to Wildlife Resources Commission comments:
The WRC stated that if alternative B (construction of a development without a marina) were not
possible that they can concur with the EA under their eight listed conditions:
A binding agreement will be reached prohibiting current or future dredging at the
project site.
Dredging is not part of the current project and no dredging will certainly be a
specific condition of the CAMA Major Permit. if dredging were to be requested
in the future, the minimum ofaMajorModification to the LAMA permit would be
required with full multi-agency review and the likelihood of the requirement for
the preparation and review of a new Environmental Assessment. With the certainty
0 of full regulatory review for any proposed future dredging, a separate binding
agreement beyond the permit conditions for this project is unnecessary.
2. Dock and pier pilings will not be jetted in place to minimize adverse turbidity
impacts in an ORW.

Pilings are routinely jetted in place for most piers and docks in all area waters
including Outstanding Resource Waters. Even if pile driving techniques were
utilized, there would still be an uncertain amount of temporary turbidity increase.
DCM rules do not prohibit piling jetting in any classification of coastal waters.

3. Enough shoreline exists for the proposed marina per CAMA rules.
Coastal Management rules (T15A: 07H. 0200) state that "Marinas to be
developed in waters subject to public trust rights (other than those created by
dredging upland basins or canals) for the purpose of providing docking for
residential developments shall be allowed no more than 27 square feet of public
trust area for every one linear foot of shoreline adjacent to these public trust
areas for construction of docks and mooring facilities. " The subject property has
a shoreline length of 775' as measured at mean high water. This shoreline length
allows the use of up to a total of 20,925 square feet ofpublic trust area for the
community marina. The proposed marina as measured by applicable DCM
definition will occupy a total of 9,990 square feet of public trust area. This

shoreline measurement at mean high water has been confirmed in consultation
with the Major Permit Coordinator.

4. Shellfish Sanitation confirms that no shellfish closure will occur.
Environmental Health rules (T15A: 18A.0911) state that "All waters within the
immediate vicinity of a marina shall be classified as prohibited to the harvesting
of shel#ish for human consumption. Excluded from this classification are marinas
with less than 30 slips, having no boats over 24 feet in length, no boats with heads
and no boats with cabins. " The planned marina falls within the limits of this
exclusion and this will verified by the Shelffish Sanitation Office during permit
application review.
5. All of the more stringent water quality regulations for ORWs (particularly
stormwater) regarding setbacks from shoreline, impervious surfaces, etc. are
strictly adhered to.
A stormwater management plan was submitted to the Division of Water Quality
on 11/11198 for review and approval as required. Total impervious surfaces
within the 575' ORW Estuarine Shoreline AEC will be less than 25% for the
planned road and future homesites. Impervious surface limitations may also be
listed as a condition of the CAMA permit.
0 6. Forested habitat will be preserved wherever possible.
Many of the mature pines and hardwood trees on the tract were either damaged
or destroyed during hurricanes Bertha, Fran and Bonnie in recent years.
Desirable, healthy remaining trees not within planned work areas for the project
and future home construction will be preserved.

7. The non-water dependent gazebo will be relocated to high ground.
Though the gazebo is non-water dependent, DCM has consistently allowed
gazebos over water. In this particular instance, if the gazebo were relocated to the
narrow high ground peninsula, it would tend to shade nearby areas of coastal
marsh. The planned open water position avoids this minor impact.

The closest private pier to the south and the concrete end of the marina to the
north extend approximately 113 the distance across the waterbody as formerly
allowed by DCMrules. The proposed community marina will only extend 114 the
distance across the waterbody as allowed under current DCM rules and will not
r surpass the pierhead line created by the two nearest structures.

marina will be made to accommodate deeper draft boats (especially sailboats without swing up
keels) who wish to depart/return from the floating marina during times of low tide. The 401 will be
issued prohibiting dredging in this SA ORW water. Please elaborate on the belief that the 2.5' to
3.5'mlw depths will be sufficient without dredging.

DWQ stated that "The 401 will be issued prohibiting dredging in this SA ORW water.
Please elaborate on the belief that 2.5' to 3.5 depths will be sufficient without dredging."
Since no dredging or filling of wetlands or waters is currently proposed in association
with this project, it is possible that no 401 Water Quality Certification is required. It is
understood that DWQ will review the project with respect to consistency with state water
quality standards.
According to current DCM rules (T15A: 07H . 0208), structures cannot extend beyond 114
of the waterbody width. This limitation places the proposed community marina in depths
of 2.5'to 3.5' mlw. Boats occupying the marina will not exceed 24' in length and most will
be shorter. The planned boat lifts on the landward side of the marina are narrower and
will contain the smaller boats (with less draft) occupying the facility. The smaller boats
should be able to enter and leave their slips without problem. The other boats (up to 249
occupying the outer slips will have the deeper water to assist them. Deep draft fixed keel
sailboats are unlikely to utilize the marina due to the presence of the boat lift cradle cross
beams. Community residents who plan to moor their boats at the marina will be fully
aware of the slip sizes and depth limitations of the facility. Additionally, the planned boat
lifts can allow for the timing of boat trips to benefit navigation.,

My main concern is the excessive use of public trust areas.
1. The linear feet of 775 feet includes a narrow finger along the shoreline. The shoreline should only include
the three waterfront lots which total 360.64 feet. Accordingly, the maximum square footage of public trust
areas that could be used should be 9,737.28 square feet. The proposed project will occupy and/or control
25,345 square feet.
2. The statement that this marina will eliminate the need for lot owners to construct a pier is true. However,
this does not prevent lot owners to construct piers off of lot 19, 20, and 21.
3. The door is open for other than lot owners to use and occupy boat slips. It is possible to reduce the size
of this marina and the impacts on the public trust areas. Not all lot owners want boat slips or own boats.

2. The statement that this marina will eliminate the need for lot owners to construct
a pier is true. However, this does not prevent lot owners to construct piers off of
lots 19, 20 and 21.
New Hanover County has taken the position that an existing special use permit
(which is in hand) for a community boating facility implicitly excludes other piers,
boat ramps and related water access structures. This was directly discussed with
the county Planning Director recently. Therefore, the placement of private piers
for these lot is prohibited unless the special use permit can be revised. Unless that
were to be accomplished, private piers would also be inconsistent with local land
use planning.
3. The door is open for other than lot owners to use and occupy boat slips. It is
possible to reduce the size of this marina and the impacts on the public trust areas.
Not all lot owners want boat slips or own boats.
New Hanover County zoning provisions require the slips to be owned solely and
exclusively by individuals owning a lot or lots in the subdivision. There are no
exceptions. Limiting slip numbers to less than the number of actual lots would
unfairly restrict the development potential allowed under the rules. Impacts from
this planned community marina are minimal in its current configuration.

8. PROJECT SUMMARY: The applicant proposes to develop a 26 lot, single family residential
subdivision with a 26 slip community marina for the property owners of the subdivision.

9. PROJECT DESCRIPTION:
The project site is a 16.5 acre tract of land located at the intersection of Mason Landing Road
(NCSR 1401) and Middle Sound Loop Road (NCSR 1403) in New Hanover County. The
property is located adjacent to the Atlantic Intracoastal Waterway (AIWW) and is approximately
2,000 feet south of the mouth of Pages Creek. To find the property, starting in Ogden at the
intersection of US Highway 17 and Middle Sound Loop Road, one would travel east on middle
Sound Loop Road approximately 2.8 miles. The entrance to the property will be on the left at
1821 Middle Sound Loop Road. The existing gravel driveway (approximately 900' long) ends
at the Register house.
The 16.5 acre tract is approximately 350' wide by approximately 2,200' deep and has
approximately 300' of frontage on the AIWW (Middle Sound). Near the middle of the property's
waterfront is an approximately 30' wide high ground peninsula which extends an additional 230'
into the waters of Middle Sound. Moving west from the Middle Sound Shoreline, the tract rises
sharply for the next 170' to an elevation of approximately 26' above mean sea level. The
remainder of the tract is relatively flat with the exception of a drainage feature which runs
eastward along the southern property boundary for approximately 600' before entering Middle
Sound. Existing high ground development on the tract includes a single family dwelling (the
Register house), a garage and a shed. The three structures lie at the top of the slope overlooking
the AIWW. The existing house is served by a private well and septic tank. Vegetation on the tract
in the area between the existing structures and Middle Sound consists primarily of lawn grasses,
ornamental shrubs, Pecan (Carya illinoensis), Laural Oak (Quercus laurifolia), Magnolia
(Magnolia grandi; flora), a few scattered Live Oaks (Quercus virginiana) and several pine species.
The remainder of the tract to the west is more heavily wooded and is dominated by Loblolly Pine
(Pinus taeda), Sweet Gum (Liquidambar styraciflua), Red Maple (Acer rubrum) and Wax Myrtle
(Myrica cerifera). The applicant states that a professional archaeological assessment has not been
done for the tract.
Extending from the edge of high ground waterward is a border of Smooth Cordgrass Marsh
(Spartina altendflora). This marsh area is approximately 150' wide at the northern property
boundary and approximately 300' wide along the southern property boundary. Extending through
this marsh border is the high ground peninsula which terminates approximately 30' waterward of
the outer edge of marsh. The perimeter of the peninsula has been stabilized over the years with
broken concrete, asphalt and bricks. Along the slope of the peninsula is a border of Sea Ox-eye
(Borrichia frutescens). Coastal wetland species present along the slope of the peninsula include
Salt Meadow Grass (Spartina patens) and Salt Grass (Distichlis spicata). On the northern side of
the peninsula, near the high ground, the marsh area is interrupted with an area of open water
approximately 30' X 90', which is probably a remnant of past dredging events during the creation
of the peninsula.
The open water portion of the AIWW adjacent to the property measures approximately 550'
across. Existing water depths range from approximately -2.0' MLW near the end of the peninsula
to approximately -13' MLW at the near-bottom edge of the federal channel approximately 285'
to the east.

The Wilmington-New Hanover County Land Use Plan classifies the area within the 100-year
floodplain as Conservation. The remainder of the high ground area is classified as Resource
Protection. The waters of Middle Sound and the AIWW are classified SA - Outstanding Resource
Waters (ORW) by the Division of Water Quality. The area is not designated as a Primary
Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish.
The applicant is proposing the development of Register Place Estates, a 26 lot, single family,
residential subdivision. Development will include the initial grading and filling of approximately
10 acres of the tract for road construction, utility installation, and building lot preparation.
Individual lots will range in size from 20,000 to 32,000 sq. ft.. Two entrance roads, one off
Mason's Landing Road and one off Middle Sound Loop Road, and three cul-de-sacs would
provide vehicular access to the proposed building lots. No direct vehicular access to the lots
would be available from the existing public roads. The subdivision's sanitary sewer system is to
be connected to the New Hanover County system once the County has provided service to the
Middle Sound area. The applicant states that construction of the Middle Sound sewer system is
expected to begin this year. No on site sewer systems are currently proposed. Potable water
service is to be supplied by a community water system by Carolina Utilities.
The applicant also proposes the construction of a 26 slip residential marina to provide water access
for the lot owners of the subdivision. The docking system for the marina would consist of a 8'
wide x 185' long floating dock connected to (13) 4.5' x 24' and 5' x 24' floating finger piers,
each serving two boat slips. Each boat slip would contain a boat lift capable of lifting up to a 24'
vessel. The applicant states that only open run-about type boats, 24' in length or less, with no
cabins or heads, would be allowed at the marina. Water depths at the waterward end of the
marina would be approximately -3.3' at MLW. Access to the marina will be provided by a 6'
wide x 70' long elevated wooden pier extending from the end of the high ground peninsula.
Along the pier, at a point approximately 35' from the end of the peninsula, a 16' x 16' gazebo
is proposed. High ground access to the community marina would be by way of a 6' wide elevated
wooden cart path beginning at the common area adjacent to lot 19, then running along the
southern property boundary for lot 19, along the water frontage of lots 19 and 20 to a point
approximately 100' out onto the peninsula. The original plans (dated October 22, 1998) submitted
with this application show the cart path extending the full length of the peninsula as well as a golf
cart parking area. A revised plan (dated April 28, 1999) showing the current cart path proposal
and cross section is attached with this report.

10. ANTICIPATEn EUPACIS
The construction of the proposed roadways and utilities would disturb approximately one acre of
high ground area. Future lot clearing/grading will disturb an additional nine acres of high ground
area. The applicant states that 5 % of the 575' ORW Estuarine Shoreline Area of Environmental
Concern (AEC) would be covered by proposed roadways and that less than 20% of the AEC
would be covered by built upon area for future lot development. Total built-upon area within the
AEC would be less than 25 %. The applicant has submitted an application for a State Stormwater
Permit which is currently, under review by the Division of Water Quality. The proposed
community marina would incorporate approximately 10,616 sq. ft. of Public Trust Area. The
structure would extend approximately 137' into a 550' wide body of water and would terminate
approximately 150' from the near-bottom edge of the federally maintained channel. Short term
increases in turbidity can be expected during piling placement.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and,
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
