The NPDES federal regulations actually provide for "automatic transfer" (Transfer Option (b)) if you provide notice 30 days ahead of the transfer with a written agreement containing the following information. If you provide this to us, and then fill out the Name/Ownership transfer on-line form with the final documentation once the sale is completed so DEQ can process a transfer of the COC by modification (Transfer Option (a)), you will cover all your bases during the transition period. I don't think it's absolutely necessary given our process, but we will be happy to include the advance notification with the agreement in the permit file (housed in our public repository) if that serves extra assurance. § 122.61 Transfer of permits (applicable to State programs, see § 123.25). Coats will continue operation from day 1 without interruption. Is there a grace period, or period of time that we will be able to have to run while transferring the stormwater permit? Will a signed copy of a permit transfer agreement as attached suffice as evidence of the sale? Please feel free to contact me to discuss further if needed.
