Stevens, Director ENVIRONMENT AND NATURAL RESOURCES July 1, 1999 Carteret County DWQ Project #990460 APPROVAL of 401 Water Quality Certification and ADDMONAL CONDITIONS Mr. Wesley and Ms. Carol Long 214 Cedar Lane Newport N.C. 28570 Dear Mr. And Ms Long: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 314 square feet of wetlands acres of wetlands or waters for the purpose of developing a lot at Dill Point Road off of SR1333 as, described in your application dated May 6,1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Digging of ditches in wetlands is not allowed. 3. All rock check dams shall be installed outside of the wetlands and monitored after storms for stability. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant is proposing to construct roads and drainage ditches in conjunction with a 46 lot subdivision. 9. NARRATIVE DESCRIPTION: The applicant's property is a 45-acre tract of land located off of 'Dill Point Road' and adjacent to North Leopard Creek in the community of Otway, in Carteret County. Directions to the site include: from Beaufort travel east on Hwy 70 to the community of Otway, turn right on SR 1325 and go to the stop sign, turn left on SR 1331 and travel approximately .5 mile, turn right on SR 1333 (Crow Hill Road), and travel on the `Crow Hill Road' until you reach `Dill Point Road' where you turn right onto `Dill Point Road'. The site is a mixed wooded areas with some open fields. The applicant cleared and graded much of the wooded area prior to obtaining a permit, which resulted in the issuance of a Notice of Violation. Since there were no wetlands impacted by the clearing and grading operation, the only required restoration was that the applicant receive an approved Sedimentation and Erosion Control Plan. The applicant has since provided this office with a copy of an approved plan. The property is approximately 4.5' above Mean Sea Level. The peninsula-shaped tract is bordered by a 20' to 250' area of Coastal and 404 Wetlands adjacent to the waters of North Leopards Creek. The Creek is a Primary Nursery and the waters are SA and open to the harvesting of shellfish. The project appears to be near known Archaeological sites. The applicant is proposing a 46 lot residential subdivision. The owner proposes to construct the main roads, and a parking area plus add 6 drainage ditches on the property. A gravel parking area measuring 80' long x 60' wide area of high ground would be filled to provide parking for those people using the pier area. The typical drainage ditch would begin landward of all 404 and Coastal Wetlands as a flat grassed swale and would extend approximately 25' before grading down to a depth of a minus 2' deep for the last 50' . The ditch would maintain a 5:1 slope. A rock check dam would be installed near the terminal end of the ditch and the water would then sheet flow into the 404 and Coastal Wetlands. The entrance of `Dill Point Road' would be moved over and replaced with a paved road which will provide better access to the `Crow Hill Road'. The construction of the roads ditches and parking areas would impact approximately 10 acres of high ground, with approximately 0.3 acres being impacted within the Estuarine Shoreline AEC. The existing culvert along the entrance to the new road off `Crow Hill Road' would be replaced by a new culvert resulting in the filling of approximately 314 sq. ft. of Spartina alterniflora. The roads, ditches and parking area would not impact any `404' or Coastal Wetlands. The remainder of the proposed ditches and roads would be located outside any AEC. NOTE: The project site is located in an area having a high probability of containing cultural resources such as artifacts, human remains, etc. If such materials are encountered, the permittee must immediately stop work and notify the District Engineer, Wilmington Corps of Engineers at (919) 251-4629 and the N.C. Division of Coastal Management at (252) 808-2808. 4. NOTE: The permittee and/or his contractor is urged to meet with DCM & COE prior to project initiation. 5. NARRATIVE, D .S RIPTION: Project Setting The applicant owns approximately 0.65 acres of high ground adjacent to Ball Creek (at the junction with Simpson Creek) at 132 Anna Lane in the Florence community of Pamlico County. The lot is approximately 95 feet wide along the shoreline and is approximately 5.5 feet in elevation. The lot is bordered on each side by undeveloped lots. There are no wetlands on or immediately adjacent to the project site. A fringe of coastal marsh is located immediately adjacent to the shoreline. Ball Creek and Simpson Creek are primarily bordered by individually owned residential parcels with individual docking facilities. There is an existing 10 slip commercial dock upstream of this site along Simpson Creek. Ball Creek is approximately 300 feet wide and the water depth at the middle of the creek is approximately -4.0 feet below NWL. Water depths in the immediate project depth range from 1.3 to 3.8 feet. Ball Creek flows into the Bay River and is designated as a Primary Nursery Area. Ball Creek is SA NSW waters and is closed to shell fishing. Project Description The applicant proposes to build a 10 slip community dock for the Bayview Estates Subdivision. Six slips would be located along either side of an 86 ft. pier and the remaining four slips would be waterward of an attached 72 ft. "T" platform - all in Ball Creek. Slips would run approximately 16 ft. wide and 30 ft. in length. Four 8 ft. X 2 ft. finger piers would also be constructed to provide access to the interior slips. Eighteen tie poles (not connected to pier or platform) would also be installed. Anticipated Impacts Approximately 9600 ft' of Public Trust Area of Ball Creek would be usurped by the 10 slips. Of that total, proposed docks and finger piers would shade approximately 1017 ft.2 of shallow estuarine water habitat. The installation of pilings would create some short term, construction related increases in turbidity to the adjacent waters as_ well as some minor impact to the estuarine bottom habitat. The most obvious question of impact lies on what influence will boats docking in 2 ft. to 4 ft. of water have on the primary nursery area. Typically, motor boats, shoal draft sail boats, and retractable keel/centerboard sailboats under 28 ft. in length (appropriate for a 30 ft. slip) draw less than 3 ft. of water. Consequently, boats of this class should present a minimal impact to the resource. Larger or fixed keel vessels may require more draft thus presenting a greater threat to the resource. Based on the proposed structure, there should be no adverse impacts to navigation in the area.
