Re: Cane Creek Umbrella Mitigation Banking Instrument (UMBI)

Credit Release excluding pond footprint — Task 2, 3
Credit Release for Pond Footprint — Task 1,2,3, 7
Dear Mr. Hutton:
On September 11, 2019, the Division of Water Resources (DWR) received documentation from
Wildlands Holdings IV, LLC (Wildlands) that the subject site had been constructed in its entirety and
monitoring plots had been installed. On October 1, 2019, Ms. Merritt, with assistance from staff with
Wildlands, inspected the site and confirmed that the subject site had been completely planted, all
monitoring plots were installed, and all stream restoration and enhancement activities appeared to be
completed with all riparian areas, including the stream banks, seeded and stabilized.
On September 11, 2019, the Division of Water Resources (DWR) received an As -Built Report from
Wildlands for the subject site. According to the As -Built survey submitted with the As -Built Report,
there are slight adjustments in the total amounts of buffer mitigation credits as compared to the Bank
Parcel Development Package. The subject site has generated 266,899.40 ft2 of buffer mitigation
credits. The credits being released have been modified to reflect any changes to the creditable
acreage as proposed in the BPDP.
DWR received a performance bond (#107063173) in the amount of $100,000 issued to Wildlands
from Travelers Casualty and Surety Company of America, to cover monitoring and maintenance at
the subject site. The term of this bond applies beginning September 4, 2019 and ends with DWR
approval of the Year 1 Monitoring Report. Future credit releases will be dependent on both the
renewal of this performance bond and the annual monitoring reports.
In accordance with the UMBI, signed on March 6, 2018, the following Project Milestones have been
met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the Bethel Branch site. Therefore, 30% of your Jordan Lake riparian buffer credits (0.30 x
235,714.40 ft2 = 70,714.32 ft2) plus 4,370.10 ft2 yields 75,084.42 ft2 that are now released.
Additionally, 55% of credits within the pond footprint (0.55 x 31,185 ft2 = 17,151.75 ft2) that are
now released. In total, 92,236.17 ft2 of buffer credits are being released and are now available to sell.
Please note that the riparian buffer credits can only be used to offset impacts located in the
Haw River Sub Watershed of Jordan Lake according to 15A NCAC 0213.0295, which became
