Thank you for the information. I had asked Tony Johnson to submit a request for dormancy status for the site. Vulcan
recently purchased the quarry and the site hasn't been active for a number of years. Vulcan has another mine site in our
region that we granted dormancy status to a few years ago. I will do an inspection after the first of the year and will copy
you and scan to Laserfiche.

ARO, but we wanted to touch base about it. I've copied Shawna since she usually handles the mines in our program.
Currently the NCG02 General Permit provides a process for dormant status requests to go straight to the Regional
Office, but I wanted to go over the specifics for Annette and Danny's benefit. In Part III (SPPP), BMP inspections can be

Currently the NCG02 General Permit provides a process for dormant status requests to go straight to the Regional
Office, but I wanted to go over the specifics for Annette and Danny's benefit. In Part III (SPPP), BMP inspections can be
reduced if approved by the DEMLR RO:
(b) BMP Controls Inspection and Ylaintenmwe. BMPs shall be inspected by or under
the direction of the permittee at ]east once every seven calendar days, unless the
site is inactive. All inspections and BMP repairs shall be documented by written
record.
Reduced BMP Inspections far inactive mimes. Dormant Site Status is available for
inactive mines that have suspended all industrial activities, and if the permittee
has certified to DEM LR's Stormwater Permitting Program that all portions of the site
where clearing, grading, and/or excavation activities have occurred have been
stabilized with vegetation. Under dormant status the permittee may conduct BMP
inspections once amonth. The perrnittee shall send written certification to the
DEMLR Regional 0fScethat the site is inactive, and the Regional Office may grant
reduced B MP inspection frequency on the basis of the permittee's certification. The
permitted site maybe subject to an inspection for verification. The DEMLR Regional
Office will provide confirmation of dormant status and expected BMP inspection
frequency in writing to the permfttee.
This section goes on to say that weekly and monthly BMP inspections can be eliminated during dormant status under
the following conditions, but that the permittee muststill perform an annual inspection:

In addition, also under dormant status but only upon a favorable site
inspection by the Regional Off! ce,the Regional Office Engineer may exempt the
permittee from weekly and monthly BMP inspections in writing if storrnwater
structural B MPs have been removed and the Regional Office determines that
structural BMPs are not necessary because of sufficient site stabilization. However,
the permittee muststill perforui an. annual inspe€Hon as part of the SPPP
Annual Update outlined in 8, of this section. In either case, the permittee shall
notify- the Regional Odice prior to resuming industrial activities at an inactive mine.
In their letter, Vulcan is requesting exemption from the BMP inspections and monitoring. In Part IV, Monitoring
Requirements outline that dormant status can relieve the permittee from analytical and qualitative monitoring:

Reduced monitoring for inactive mines. Dormant Site Status is available for inactive mine sites that
have suspended all industrial activities, and if the permittee has certified in writing to DEMLR's
Stormwater Permitting Program that all portions of the site with clearing, grading, and/or
excavation activities have been stabilized with vegetation. Upon a favorable site inspection by the
Regional Office, the Regional Office Engineer may exemptthe permittee from stnrrnwateranalytical
monitoring, stormwater qualitative monitoring, and wastewater monitoring. The DEMLR letter
granting dormant status must be kept with the S PP P, and availab] a for inspection within a
reasonable time of the Division's request.
I've also attached our Guidance and Delegation information on Dormant Status requests (a bit dated since 2012, but still
applicable). Please note the step to add a Reporting Suspension in BIMS if the request is approved so that the status is
accurately tracked. Any letters that are sent to the permittee in response (or other records generated by ARO that would
belong in the file) should be scanned and put into Laserfiche (Isaiah can help with that if needed, or just email me the
scan).
