This is the only drainage feature that the pond can discharge to on the site. This is the current stormwater conveyance from the site, so no changes
have been made to the drainage patterns.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Large enough equipment will be used such that the disturbance to the wetlands will be minimized during construction and the equipment will be able to
stay away from the wetlands as much as possible. With the exception of burying the inverts on the pipes, no major excavation is proposed within the
wetlands/stream. Appropriate Erosion and Sedimentation control measures will be installed to prevent sedimentation within the stream. The
discharge crosses the wetlands/buffer at approximately a 90 deg. angle to further minimize impacts.

Dear Sir or Madam:
On October 30, 2017, at your request I, along with representatives from NCDEQ, conducted an
on -site determination to review features located on the subject property for applicability to the
Tar -Pam Riparian Area Protection Rules (15A NCAC 2B .02059). The features are labeled as
"PC 17-007" and "PC 17-008" on the attached maps initialed by me on November 3, 2017.
The Pitt County Planning Department has determined that the surface water labeled as
"PC17-007" on the attached map and highlighted in RED is not subject and the surface
water labeled as "PC17-008" highlighted in BLUE is subject to the Tar -Pam Riparian Area
Protection Rules. The owner (or future owners) should notify the DWQ (and other relevant
agencies) of this decision in any future correspondences concerning this property. This on -site
determination shall expire five (5) years from the date of this letter.

That the GRANTOR, for a valuable consideration paid by the GRANTEE, the receipt of which is
hereby acknowledged, has and by these presents does grant, bargain, sell and convey unto the GRANTEE,
his heirs and assigns, in fee simple, all that certain lot or parcel of land situated in Grimesland Township,
Pitt County, North Carolina and more particularly described as follows:
BEING all of TRACT 1, consisting of 67.1901 acres, more or less, as shown on that
certain map of record entitled `BOUNDARY SURVEY FOR UMBERTO G.
FONTANA PROPERTY" prepared by Stroud Engineering, P.A, dated May 1, 2018
and recorded in Map Book 83, Page 48 of the Pitt County Register of Deeds. Said
map is incorporated herein by reference for a more complete and accurate
description.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances
thereto belonging to the GRANTEE, his heirs and assigns, in fee simple forever.
And the GRANTOR covenants with the GRANTEE, that GRANTOR is seized of the premises in
fee simple, has the right to convey the same in fee simple, that title is marketable and free and clear of all
encumbrances, and that GRANTOR will warrant and defend the title against the lawful claims of all persons
whomsoever except for the exceptions hereinafter stated.
The property hereinabove described was .acquired by GRANTOR(s) by instrument recorded in

Title to the property hereinabove described is subject to the following exceptions:
Subject to ad valorem taxes for the current year (prorated through the date of closing);
encroachments or other matters that would be revealed by an accurate survey or personal
observation of the premises; all applicable zoning and land use ordinances, statutes and
regulations; any violation by prior owners of any environmental law or regulation; and to
the provisions of all applicable unviolated restrictive covenants and easements of record.
IN ADDITION, this land is being conveyed subject to certain appurtenant easements, restrictions,
covenants and conditions regarding use thereof, running with and to said land by whomsoever owned, said
easements, restrictions, covenants and conditions which are expressly assented to by GRANTEE, in
accepting this deed, are as follows:
(1) Said property shall be restricted to residential purposes only and no structures shall be
erected, placed or permitted to remain on any lots developed on the property other than one
single-family dwelling that shall contain no less than 1,600 square feet of heated space
(which may include an attached garage or carport) and one detached outbuilding to be
constructed incidental to the residential use of the property and not for business,
manufacturing, commercial purposes with the exception of one model home that the
developer of any subdivision may use temporarily as a sales office. Any residence built on
any lot shall be 'stick built' only. No modular home, mobile home or double -wide shall be
placed on any lot.
(2) Any lot developed shall be a minimum of 12,500 square feet.
(3) GRANTEE shall, at GRANTEE's sole expense, install Green Giant evergreen trees at least
3 feet to 4 feet in height, on GRANTOR's adjoining property 6 feet off of GRANTOR's
property line beginning at the right of way of North Carolina Highway 33 and running
along said GRANTOR's property line every 10 feet to the Tar River. GRANTOR shall be

responsible for the maintenance and or replacement of any trees.
(4) GRANTEE shall allow GRANTOR, its successors and or assigns, guests and invitees, full
use and access to the existing Boat Ramp, Dock and Bulkhead depicted on the survey map
referred to in Exhibit A and or any boat ramp, dock and bulkhead installed in the future for
the use of all owners of lots in any subdivision developed on the property. This use and
access shall be limited to GRANTOR and any future owners who permanently reside in
the home located at 221 Tripp Trail, Grimesland, North Carolina and not any other owner
of property owned by GRANTOR that is not currently developed.
(5) For GRANTOR to access the existing boat ramp, dock and bulkhead above referenced,
GRANTOR, its successors and or assigns, reserves a temporary ingress, egress and regress
access easement over that Gravel Drive depicted on the survey referred to in Exhibit A
commonly known as Tripp Trail that shall remain in full force and effect until such time
that a platted map is recorded for a residential subdivision establishing right-of-ways
sufficient for GRANTOR to have reasonable vehicular access the aforesaid boat ramp,
dock and bulkhead. For further reference and identification, said drive continues onto the
GRANTOR's property currently having Pitt County Tax Parcel No.: 06922. GRANTEE,
its successors and or assigns, shall provide and grant an ingress, egress and regress
easement to GRANTOR as described and limited in paragraph (3) to access any boat ramp,
dock and bulkhead installed in the future for the use of all owners of lots in any subdivision
developed on the property.
(6) GRANTEE, its successors and assigns, shall adequately maintain the ditch depicted on the
Boundary Survey referred to in Exhibit "A" that empties into the Phillippi Branch for the
purposes of allowing the unimpeded flow of water from the retention pond located on
GRANTOR's adjoining property hereinabove referred to. Adequate maintenance is herein
defined as good working condition so that the retention pond overflow performs as
designed.
(7) GRANTOR shall have thirty (30) days to remove personal property from the building and
river house on the property.
(8) The GRANTEE does hereby covenant to carry out the duties specified herein, and these
restrictions shall be covenants and restrictions running with the land.

Location description: This project is located on an undeveloped tract that is east of Greenville off Highway 33,
approximately 1 75 miles past Simpson turnoff, on the left adiacent to Tripp Trail in Grimesland, Pitt County, NC.

resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that
would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary

331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further

SECTION I - The following identifies your rights and options regarding an administrative appeal of the above decision.

A: INITIAL PROFFERED PERMIT: You may accept or object to the permit.
• ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your signature
on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all rights to appeal the
permit, including its terms and conditions, and approved jurisdictional determinations associated with the permit.
• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request that the
permit be modified accordingly. You must complete Section II of this form and return the form to the district engineer. Your
objections must be received by the district engineer within 60 days of the date of this notice, or you will forfeit your right to appeal
the permit in the future. Upon receipt of your letter, the district engineer will evaluate your objections and may: (a) modify the
permit to address all of your concerns, (b) modify the permit to address some of your objections, or (c) not modify the permit
having determined that the permit should be issued as previously written. After evaluating your objections, the district engineer
will send you a proffered permit for your reconsideration, as indicated in Section B below.
B: PROFFERED PERMIT: You may accept or appeal the permit

Appeal Process by completing Section II of this form and sending the form to the division engineer. This form
must be received by the division engineer within 60 days of the date of this notice.
D: APPROVED JURISDICTIONAL DETERMINATION: You may accept or appeal the approved JD or
provide new information.
• ACCEPT: You do not need to notify the Corps to accept an approved JD. Failure to notify the Corps within 60 days of the date of
this notice means that you accept the approved JD in its entirety, and waive all rights to appeal the approved JD.
• APPEAL: If you disagree with the approved JD, you may appeal the approved JD under the Corps of Engineers Administrative
Appeal Process by completing Section 11 of this form and sending the form to the division engineer. This form must be received by

E: PRELIMINARY JURISDICTIONAL DETERMINATION: You do not need to respond to the Corps
regarding the preliminary JD. The Preliminary JD is not appealable. If you wish, you may request an approved
JD (which may be appealed), by contacting the Corps district for further instruction. Also you may provide new
information for further consideration by the Corps to reevaluate the JD.

federally-listgd,spgcies or designated critical habitat may be affected by a proposed project. For

present in the project's Action: Area, then you -may use the Service's Information, Planning, and
Consultation System•(IPaC) website to deterrnine if any Iisted, proposed, or candidate species
may be present in the Action Area and generate a species list. The IPaC website may be viewed
at https:Hecos.fws.gov/ipac/. .The IPaC web site contains a complete and frequently updated list
of all endangered and threatened species protected by the provisions of the Endangered Species
Act of 1973, as amended (16 U.S.C. 1531 et seq.)(Act), a list of federal species of concern' that
are known to occur in each county in North Carolina, and other resources.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the. Service, insure tllat any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to the above -referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally -listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if: (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.
However, the Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down -gradient surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a
copy can be found on our website at (littp:/hv-�vw.fws.gov/raleigli) to address and mitigate
secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.

We recommend that you consider this document in the development of your projects and in
completing an initiation package for consultation (if necessary).
