The Division of Water Quality has received your letter and maps concerning hurricane storm
debris removal from the Lumber River in Robeson and Columbus Counties. In October 1996
several resource agencies, including the US Army Corps of Engineers, met with NRCS
representatives to discuss storm debris removal under the Emergency Watershed Protection
Program. At that time the NRCS presented the need to remove debris that may be blocking
stream channels near bridges, roadways, or other structures. Concerns were expressed about
access along the streams and potential impacts to wetlands and the streams themselves. The
NRCS assured the agencies that the work would be conducted by hand or by use of matting
through sensitive wetland areas to minimize impacts. The attached list of conditions was
developed and agreed to by the USACOE, DWQ, and the NRCS to protect environmentally
sensitive areas and exempt the NRCS from the need for permits and certifications to carry out
the work.
The Division requests that you follow these guidelines during the implementation of your
project. The value of wetlands in protecting downstream water quality has been well
documented. In order for most riparian wetlands to provide these water quality benefits, streams
must be allowed to naturally over flow their banks and inundate their floodplains, allowing the
wetlands to filter the water. Stream channelization in the past has removed the water quality
functions of many riparian wetlands. Also, the woody debris within the wetlands and streams of
these areas provides valuable habitat and nutrients for fish and wildlife.

LUMBER RIVER STATE PARK, represented by Mr. James D. Sessoms, Park
Supervisor, POST OFFICE BOX 10, ORRUM, NORTH CAROLINA 28369 has applied for a
Department of the Army (DA) permit TO CLEAR AND SNAG DEBRIS ASSOCIATED WITH
HURRICANE BONNIE FROM THE LUMBER RIVER BETWEEN U.S. HIGHWAY 74 IN ROBESON
COUNTY AND THE NC/SC STATE LINE IN COLUMBUS COUNTY, North Carolina.
The following description of the work is taken from data provided by the
applicant. The work will occur along the Lumber River from U.S. Highway 74
Bridge in Robeson County to the NC/SC state line in Columbus County (see
attached map). Activities will consist of the removal of vegetative,
construction, and residential debris using hydraulic excavators equipped with
mechanical thumbs or grapple attachment, loaders, portable winches or winches
on tracked or rubber tired equipment, mechanical wheel grinders on tracks,
barges, chain saws, and hand tools.
Excavation or deposition of soils,or sediments is expressly prohibited
during this operation. Because of this, a Section 401 Of the Clean Water: Acts
water quality certification wil ,.pot be required for the work from the North
Carolina Division of Water Quaty.
Debris will be disposed of on high ground where practicable. In
wetlands, vegetative debris will be spread and/or anchored so that material
will not be displaced back into the channel or impede lateral flow. Heavy
equipment working in wetlands will be placed on mats, or other measures taken
to minimize soil disturbance. Land equipment will operate adjacent the
channel and not within the channel. Trees may be cut for access to work
sites; however, mechanized landclearing in wetlands will not occur.
If a spill of petroleum products or any other hazardous waste occurs, the
event will be reported to the N.C. Division of Water Quality. The Lumber
River State Park will be responsible for inspection and will ensure compliance
of all conditions for accomplishing this work. The purpose of the work is to
remove flow blockages to allow drainage of surrounding properties and remove
hazards to water traffic. The project is funded from the Natural Resources
Conservation Service's Emergency Watershed Protection program, the state of
North Carolina, and local monies.
The requested Department of the Army (DA) permit will be denied if any
required State or local authorization and/or certification is denied. No DA
permit will be issued until a State coordinated viewpoint is received and
reviewed by this agency. Recipients of this notice are encouraged to furnish
comments on factors of concern represented by the above agencies directly to
the respective agency, with a copy furnished to the Corps of Engineers.
This application is being considered pursuant to Section 10 of the River
and Harbor Act of 1899 (33 U.S.C. 403). Anyone may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.

The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this site is not registered property or property listed as being eligible for
inclusion in the Register. Consultation of the National Register is the
extent of cultural resource investigations by the District Engineer, and he is
otherwise unaware of the presence of such resources. Presently, unknown
archeological, scientific, prehistorical, or historical data may be lost or
destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision, whether to issue a permit, will be based on an evaluation
of the probable impacts, including cumulative impacts, of the proposed
activity and its intended use on the public interest. Evaluation of the
probable impacts that the proposed activity may have on the public interest
requires a careful weighing of all those factors that become relevant in each
particular case. The benefits that may be expected to accrue from the
proposal must be balanced against its foreseeable detriments. The decision
whether to authorize a proposal, and if so the conditions under which it will
be allowed to occur, are therefore decided by the outcome of the general
balancing process. That decision should reflect the national concern for both
protection and use of important resources. All factors that may be relevant
to the proposal must be considered including the cumulative effects of it.
Among those are conservation, economics, aesthetics, general environmental
concerns, wetlands, cultural values, fish and wildlife values, flood hazards
and flood plain values (according to Executive Order 11988), land use,
navigation, shore erosion and accretion, recreation, water supply and
conservation, water quality, energy needs, safety, food and fiber production,
mineral needs, considerations of property ownership, and, in general, the
needs and welfare of the people. For activities involving the placement of
dredged or fill materials in waters of the United States, a permit will be
denied if the discharge that would be authorized would not comply with the
Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the
preceding sentence and any other applicable guidelines or criteria, a permit
will be granted unless the District Engineer decides that it would be contrary
to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties to consider and evaluate the impacts of this proposed activity. Any
comments received will be considered by the Corps of Engineers to decide
whether to issue, modify, condition or deny a permit for this proposal. To
make this decision, comments are used to assess impacts on endangered species,
historic properties, water quality, general environmental effects and the
other public interest factors listed above. Comments are used in the
preparation of an Environmental Assessment (EA) and/or an Environmental Impact
Statement (EIS) pursuant to the National Environmental Policy Act (NEPA).
Comments are also used to decide the need for a public hearing and to decide
the public interest of the proposed activity.
Written comments pertinent to the proposed work, as outlined above, will

SUBJECT: Section 10 Permit Application for Lumber River State Park
Attached for your review and information please find a copy of a US Army Corps of
Engineers Section 10 permit application that the NC Division of Parks and Recreation
is submitting for the clearance of debris from Lumber River State Park. This project
affects approximately 33 miles of the Lumber River in Robeson and Columbus
counties and will clear storm damage caused by Hurricane Bonnie in August 1998.
This project is intended to reopen this section of the river to navigation by canoes and
other small boats.
This project and permit application are essentially identical to a Section 10 permit
issued to the division in 1998 for the removal of storm debris from Hurricane Fran.
This project will follow the same protocols, with removals being done using hand tools
only. No vegetation will be removed within 5 feet of either bank, and all debris will be
placed on high ground or behind standing vegetation in a manner that does not impede
lateral water flow. There will be no filling, excavation, use of machinery, or any other
alterations to wetlands anywhere along the project. We are not aware of any rare
species, water quality issues, or cultural resources that will be affected by this project.
However, we are required by the conditions of the permit to submit a copy of this
application to your agency.

Dear Mr. Jahnke:
Following our telephone discussion on February 22, 1 am enclosing the attached
application for a Section 10 permit to allow the North Carolina Division of Parks and
Recreation to clear and snag storm debris along a 33 mile section of the Lumber River.
This permit is being requested as a result of storm damage that occurred along the
Lumber River State Park in Robeson and Columbus counties during Hurricane Bonnie
in August 1998. The nature of this project is identical to that approved in a previous
Section 10 permit (permit no. 199800101) issued to the division in December 1997.
The 1997 permit was written for storm damage that had occurred along the Lumber
River in Robeson and Scotland counties during Hurricane Fran in 1996. As noted
during our previous discussions, we understand that this permit will not require water
quality certification from the North Carolina Division of Environmental Management.
This request to clear storm damage covers approximately 33 river miles, from the US
Highway 74 crossing south to the state line. As this stretch covers several USGS
quads, I have instead enclosed a county map with the project area highlighted in blue.
This reach is popular with canoeists, and this work will improve staff access and
visitor safety.
This 33 mile reach is included in both the National Wild and Scenic Rivers System and
the North Carolina Natural and Scenic Rivers Act of 1971. With the exception of an
approximately 3-mile section through the town of Fair Bluff, the entire reach is
classified under the federal program as scenic-, the Fair Bluff section is designated
under the federal program as recreational. Under the state program, the sections from
US Highway 74 to the northern limits of the town of Fair Bluff, and from the southern
limits of the town to the state line are designated as natural. As with the federal
program, the section through Fair Bluff is designated by the state as recreational.
All work will be conducted with hand tools by crews working from shallow draft
boats. Access to the river will occur only at areas with established boat ramps-,
motorized equipment will be used only to load and retrieve boats and crews at those
ramps. A 10-foot wide path will be cleared, but no vegetation will be cut within 5 feet
of either bank. Excavation of soils or stumps will not occur, and all debris will be
placed on the nearest high ground where practicable, or wedged behind standing
