The site contains wooded land. Structures are not located on the site. The site is located in a residential area of Chapel
Hill, Orange County.

The purpose of the proposed project is to develop the site with a residential sub -division.
3e. Describe the overall project in detail, including the type of equipment to be used:
The overall project consists of development of the site with a residential sub -division. The residential subdivision will
contain single family lots, condo/townhouse buildings, a community center, recreational areas, parking areas and
landscaped areas. In order to develop the site, the site must be cleared and graded. Ginger Road will provide access to
the site. The site includes R-O-W that was obtained to provide municipal sewer service to the site from existing municipal
lines. To facilitate development of the site, it is necessary to impact 3 wetland areas. Clearing and grading the site is
necessary. Graders, haulers, excavators and other heavy equipment will be used during site construction.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The proposed development was re -designed following the stream and wetland delineation to minimize grading limits and the
development footprint to avoid greater impacts to WoUS than those proposed in this application. Initial design plans provided
access from Sunrise Road from the northwestern portion of the site. However, the applicant was able to provide access from
Ginger Road, thus, avoiding impacts to streams and wetlands located on the northwestern portion of the site.
There are approximately 0.62 acres of wetlands and 310 linear feet of stream channel located on the site. The remaining 0.54
acres of wetlands and 361 linear feet of stream channel are being avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence, rock checks or other temporary sediment and erosion control measures will be
located within the most down -gradient area within the impact limits. The sediment and erosion control devices will prevent
sediment from being discharged into down -gradient streams or wetlands. Temporary impacts to wetlands will be restored to
similar pre -construction grades and seeded with low-lying herbaceous vegetation.

Pilot consulted the USFWS List of Protected Species for Orange County. The USFWS identifies the following protected
species in Orange County: Bald Eagle (BPGA), Cape Fear Shiner (E), Dwarf wedgemussel (E), Michaux's sumac (E) and
smooth coneflower (E). We have determined the proposed project is not likely to disturb the bald eagle and that the
proposed project will have no effect on the remaining federally protected species due to absence of suitable habitat within
the proposed impact footprint.

2. THIS DRAWING IS PREPARED FOR WETLAND IMPACT DEFINITION
PURPOSES ONLY. THESE DRAWINGS MAY NOT BE USED FOR
CONSTRUCTION PURPOSES.
3. CONSTRUCTION OF THIS PROJECT WILL REQUIRE A LAND
DISTURBING PERMIT, SEWER PERMITS FROM OWASA AND NC DWR,
APPROVAL OF 401 AND 404 PERMITS AS APPLICABLE, AND RCD
IMPACT/ZCP APPROVALS FROM THE TOWN OF CHAPEL HILL NO
CONSTRUCTION SHALL BEGIN UNTIL ALL NECESSARY PERMITS ARE
SECURED AND A PRE —CONSTRUCTION MEETING IS HELD.
4. CONSTRUCTION TECHNIQUES SHALL BE USED TO MINIMIZE SOIL
DISTURBANCE WITHIN THE WETLAND IMPACT AREAS. THESE
TECHNIQUES SHALL INCLUDE STRICT LIMITATIONS ON WORK LIMITS
AS INDICATED, BOUNDING THE WORK LIMITS WITH TREE
PROTECTION FENCING AND SILT FENCING, USING RUBBER —TIRED
EQUIPMENT AS PRACTICAL FOR EXCAVATION AND BACKFILL,
REMOTE TEMPORARY STOCKPILING OF EXCAVATED SOIL AS NEEDED
DURING SEWER INSTALLATION, AND GRINDING OR LEAVING TREE
STUMPS IN PLACE INSTEAD OF GRUBBING. THE FINAL DESIGN WILL
MAINTAIN THE SEWER DEPTH AS SHALLOW AS PRACTICAL IN
ORDER TO MINIMIZE THE REQUIRED SIZE OF INSTALLATION
EQUIPMENT AND THE LATERAL IMPACT OF TRENCH WORK.
5. CONSTRUCTION WORK SHALL BE COORDINATED AND SEQUENCED
TO AVOID WORKING DURING PERIODS OF RAIN OR UNUSUALLY WET
SOIL CONDITIONS.
6. DISTURBANCE TO THE STREAM CHANNEL, OR DISCHARGE OF SOIL
OR OTHER MATERIALS INTO THE CHANNEL, IS EXPRESSLY
PROHIBITED.
7. THE FOLLOWING GUIDELINES WILL GENERALLY APPLY TO THIS
PROJECT. THESE PROVISIONS SHALL NOT BE CONSTRUED IN A
MANNER THAT WILL PREVENT SUCCESSFUL INSTALLATION OR
ACCEPTANCE OF THE PROPOSED SEWER, BUT WILL BE
INTERPRETED AND APPLIED AS REASONABLY PRACTICAL
a. HEAVY EQUIPMENT SHOULD NOT BE USED IN ZONE ONE OF
THE BUFFER.
b. VEGETATION IN UNDISTURBED AREAS OF THE WETLAND
SHOULD NOT BE COMPROMISED.
c. FELLED TREES SHOULD BE REMOVED BY CHAIN IF NOT
TRANSPORTABLE BY LIGHT EQUIPMENT OR BY HAND.
d. FELLED TREES SHALL NOT BE ALLOWED TO PERMANENTLY
REMAIN, BUT SHALL BE COMPLETELY REMOVED FROM THE
SIZE, EXCEPT AS OTHERWISE REQUIRED REGARDING STUMPS
AND ROOTS.
e. TREE STUMPS AND ROOTS SHALL ONLY BE GRUBBED WHEN
LOCATED WITHIN THE EXCAVATION LIMITS OF THE SEWER
TRENCH. STUMPS IN ALL OTHER LOCATIONS SHALL BE LEFT
INTACT OR REMOVED BY GRINDING.
f. UPON COMPLETION OF SEWER INSTALLATION, DISTURBED
AREAS SHALL BE STABILIZED WITH GRASS.
g. CONSTRUCTION EQUIPMENT WORKING IN JURISDICTIONAL
WETLAND AREAS SHALL UTILIZE MATS IN ORDER TO
MINIMIZE SOIL DISTURBANCE.
h. NO FERTILIZER SHALL BE USED OTHER THAN A ONE—TIME
APPUCATION TO ESTABLISH VEGETATION.

AS PRACTICAL
8. RESTORATION PLANTINGS WILL NOT BE ALLOWED WITHIN THE
