The applicant requests a conditional 401 WQC pending obtaining a Jordan Buffer Authorization as necessary. D. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The proposed development was re -designed following the stream and wetland delineation to minimize grading limits and the development footprint to avoid greater impacts to WoUS than those proposed in this application. Initial design plans provided access from Sunrise Road from the northwestern portion of the site. However, the applicant was able to provide access from Ginger Road, thus, avoiding impacts to streams and wetlands located on the northwestern portion of the site. There are approximately 0.62 acres of wetlands and 310 linear feet of stream channel located on the site. The remaining 0.54 acres of wetlands and 361 linear feet of stream channel are being avoided. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and silt fence, rock checks or other temporary sediment and erosion control measures will be located within the most down -gradient area within the impact limits. The sediment and erosion control devices will prevent sediment from being discharged into down -gradient streams or wetlands. Temporary impacts to wetlands will be restored to similar pre -construction grades and seeded with low-lying herbaceous vegetation. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. If you answered "yes" to the above, has the document review been finalized by the State Clearing House? (If so, attach a copy of the NEPA or SEPA final approval ❑ Yes ® No letter.) Comments: A NEPA or SEPA is not required as part of this project. 2. Violations (DWQ Requirement) 2a. Is the site in violation of DWQ Wetland Rules (15A NCAC 2H .0500), Isolated Wetland Rules (15A NCAC 2H .1300), DWQ Surface Water or Wetland Standards, ❑ Yes ® No or Riparian Buffer Rules (15A NCAC 2B .0200)? 2b. Is this an after -the -fact permit application? ❑ Yes ® No 2c. If you answered "yes" to one or both of the above questions, provide an explanation of the violation(s): 3. Have you checked with the USFWS concerning Endangered Species Act ❑ Yes ® No impacts? ❑ Raleigh 5c. If yes, indicate the USFWS Field Office you have contacted. ❑ Asheville 5d. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? Pilot consulted the USFWS List of Protected Species for Orange County. The USFWS identifies the following protected species in Orange County: Bald Eagle (BPGA), Cape Fear Shiner (E), Dwarf wedgemussel (E), Michaux's sumac (E) and smooth coneflower (E). We have determined the proposed project is not likely to disturb the bald eagle and that the proposed project will have no effect on the remaining federally protected species due to absence of suitable habitat within the proposed impact footprint. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as essential fish habitat? ❑ Yes ® No 6b. What data sources did you use to determine whether your site would impact Essential Fish Habitat? Based on our knowledge of the site, the site is not located in or near an area designated as essential fish habitat. Best management practices and the use of temporary sediment and erosion control devices will prevent sediment from entering down -gradient waterbodies which may contain fish. 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation ❑ Yes ® No status (e.g., National Historic Trust designation or properties significant in North Carolina history and archaeology)? 7b. What data sources did you use to determine whether your site would impact historic or archeological resources? According to the NC SHPO Historic Properties website (attached), eligible or listed resources are not located within the proposed project area. 8. Flood Zone Designation (Corps Requirement) 8a. Will this project occur in a FEMA-designated 100-year floodplain? ❑ Yes ® No 8b. If yes, explain how project meets FEMA requirements: 8c.
