8. PROJECT DESCRIPTION:
The project site is located at 7823 Masonboro Sound Road in New Hanover County. The property is adjacent to
the Atlantic Intracoastal Waterway (AIW W)/Masonboro Sound and is approximately 2.5 miles south of the
mouth of Hewlett's Creek and approximately 0.3 miles north of the mouth of Whiskey Creek. To locate the
property from the Market Street (Highway 17), travel South on College Road towards Monkey Junction. At the
intersection of South College Road and Holly Tree Road turn left. Continue east on Holly Tree Road, and bear
right at the stoplight onto Pine Grove Drive. Continue on Pine Grove Drive, which will converge with Masonboro
Sound Road. Travel on Masonboro Sound Road approximately 2.0 miles until you reach the property of interest
on the left onto an unimproved road that will lead towards the AIW W. The high ground property is
approximately 180' wide by 1,600' deep, or approximately 7 acres. The elevation of the tract averages
approximately 5' above normal high water (NHW). Existing high ground development on the tract includes a
gravel driveway, small storage buildings and a single-family dwelling. High ground vegetation consists of lawn
grasses, hardwoods and other woody species including: oak, pine, dogwood, maple and magnolia. The property
then transitions into a narrow area of high marsh approximately 15' in width, which includes coastal, and §404
type wetlands such as: sea oxeye (Borrichia frutescens), grounsel-bush (Baccharus holimifolia) and black needle
rush (luncus roemarianus).
There is an existing man-made basin at the most eastern portion of the property, measuring approximately 100'
in length by 100' in width and an access channel, measuring approximately 1,000' in length by 50' in width which
connects to the AIWW. The basin and access channel is bordered by low marsh consisting primarily of smooth
cordgrass (Spartina alterniflora). The application states that the applicant has 240 LF of shoreline on the
property.
A previous property owner (T.E. Murrell) received a Dredge and Fill State Permit No. 348 on April 23, 1971 for
the existing basin and access channel, which authorized the dredging limits at 1,000'in length by 50' in width to
a final project depth of-6.0' at mean low water (MLW). The excavated material was deposited on the high
ground portion of the property. In 2008 portions of the basin and access channel were excavated to a depth of
-6.0' at MLW through CAMA General Permit No. 45876 to a subsequent previous property owner (McAllister). In
November 2011, the current property owner was issued CAMA Major Permit 128-11, for the removal of 9250 CY
of bottom sediment in the basin to a depth of -6.0' at MLW. This work necessitated a new major permit as it
included the removal of .03 acres of Spartina alterniflora that had volunteered as a result of sedimentation
during Hurricane Matthew (and the last maintenance event). State Permit 128-11 was renewed for 5 year
maintenance in 2015, and is set to expire on February 27, 2020.
The applicants are currently constructing a fixed pier (6' wide by 45' long), permitted under General Permit
#45876 D (11/6/2019), extending in an easterly direction from the high ground towards the basin (with no boat
slips under the GP). The previous docking facility, destroyed during Hurricane Matthew (2016), had featured a
fixed pier (20' x 6') and a floating dock (73' x 8'). There is also a small boat ramp on the northern side of the
fixed pier, which accesses the basin, which silted over during Hurricane Matthew with approximately 4 inches of
sediment across its surface. Since that time a small band of Coastal Wetlands (spartina alterniflora) has
volunteered, in an area measuring 6.5' long by 12' wide across the boat ramp (- 80 SF). This boat ramp was
identified as existing (and not covered with sediment or Coastal Wetlands) during the review process for State
Permit 128-11, and it was used as the extraction point for the excavation conducted in accordance with that
permit.
The City of Wilmington classifies the area as Residential (R-20). The waters of Masonboro Sound are classified as
SA-ORW by the Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the
Division of Marine Fisheries and is OPEN to the taking of shellfish

9. PROPOSED PROJECT:
The applicant proposes to expand an existing docking facility (4 slips total) and excavate a boat ramp that has
been silted in for access to an existing man-made basin, resulting in the fill of 80 SF of Coastal Wetlands. From
the fixed pier (6' x 45') currently being constructed, the applicant proposes to add a ramp leading in an easterly
direction to a floating dock (6' x 48') extending in an easterly direction, perpendicular to the shoreline and parallel
to the orientation of the pier. Extending from the eastern end of the floating dock, the applicant proposes to
install another ramp leading to a covered gazebo (14' x 14'). This facility would provide dockage for up to four (4)
vessels in an area with water depths of approximately -4' at NLW.
To restore use of the boat ramp silted in during Hurricane Matthew, the applicant is proposing to excavate roughly
four inches of sediment across the entirety of the surface of the boat ramp. This would include a high ground
portion of the boat ramp above NHW (-16' x 12' or 192 SF), and an area of the boat ramp below NHW (14' x 12'
or 168 SF) which also includes an area with a band of Spartina alterniflora (-6.5' x 12' or 80 SF). The application
states that this will be between 3-4 CY below NHW, and 2-3 CY above NHW. The applicant has identified an area
of upland for disposal, on the property, measuring 100' x 300', in which the applicant plans to dewater (with
sediment control) and then thinly disperse the fill material, landward of the 30' Coastal Shorelines buffer from
NHW. No presence of SAV or shellfish was noted in the proposed area to be excavated.
10. ANTICIPATED IMPACTS:
The proposed docking facility would incorporate approximately 574 SF of Estuarine Waters and Public Trust Area.
The reconfigured facility would provide dockage for four (4) vessels in water depths of -4' @NLW. As proposed
the new facility would extend approximately 100' into a water body measuring 1600' across which conforms to
the % width rule. As proposed, this docking facility would not encroach into either neighboring riparian corridor
setback. This new docking facility would incorporate 70 SF less of Estuarine Waters and Public Trust Area than
the facility that was destroyed by Hurricane Matthew.
The proposed excavation (sediment removal) of the existing boat ramp would result in the disturbance of
approximately 168 SF of shallow bottom habitat in Estuarine Waters and Public Trust Area, 192 SF of High Ground
area (upland portion of boat ramp), and 80 SF of Coastal Wetlands (Spartina alterniflora). No SAV or shellfish were
noted in the boat ramp footprint. The applicant proposes to remove approximately 4-7 CY of material, by backhoe
excavator. The spoil would be dewatered on site and used as backfill for the bulkhead, in a 100 LF x 300 LF area.
Minor turbidity increases can be expected during the construction process.

To whom it may concern,
On behalf of Arcadia Properties at 7823 Masonboro Sound Rd, we are
applying for a CAMA Major Permit to construct a new 4-slip dock facility and rehab
their existing concrete boat ramp. Their existing dock facility was destroyed during
Hurricane Matthew (2016) and the boat ramp has been silted over in the
subsequent years.
We are proposing to uncover the concrete ramp and make necessary repairs
to restore it to working condition. Also, we are proposing to install a 6'x48', 4-slip,
Floating dock system and a 14'x14' platform and gazebo. Currently, we have a
permit to build a 6'x45' access pier (GP 74777D). All work is outlined in the
attached drawings and forms.

The Division of Coastal Management hereby acknowledges receipt of your application, on behalf of
Arcadia Properties LLC, for State approval for development of the subject property located at 7823
Masonboro Sound Road in Wilmington, New Hanover County. It was received as complete on November
8, 2019 and appears to be adequate for processing at this time. The projected deadline for making a
decision January 22, 2020. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from November 8, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss
the status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted atthe location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
