Dear Mr. Furness:
You have our approval, in accordance with the attached conditions, to place fill material in 1.150 square feet or
waters for the purpose of stabilizing a shoreline at Phosphate Inc. at SRI 339 on Bath Creek, as you described in your
application dated 18 March, 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and- send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 N. For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Project setting
PCS Phosphate, Inc. (PCS) is a mining and refining industry located near the Town
of Aurora in Beaufort County, North Carolina. PCS has extensive land holdings in this area
of the county bordering the Pamlico River, Bath Creek, South Creek and their tributaries.
Tlne proposed project area involves a 430 acre tract of land off SR 1339 adjacent Bath Crock
and within the ETJ of the "Town of Bath. The project area is approximately 2,550 f'cct of
shoreline at Archbell Point on Bath Creek. The majority of the shoreline is vegetated with
mixed hardwoods (including cypress), shrubs, vines and upland grasses, Several large
agriculture tracts abut this wooded buffer to the creek. In the upper third (north end) of the
project area, a wetland slue intersects the creek and is ± 190' wide. This area is vegetated
with pines, cypress, sex s p. and arrow arum. The downstream end of the project area is
the toe of an existing dike which impounded Archbell Gut when it was constructed prior to
1970. An area of Spartina l?teniflua ± 750 ft2 is present at this area of the project site but
the applicant proposes to construct the bulkhead landward of this marsh.
The area adjacent the downstream (south) end of the project area is bulkheaded and
has a pier, and is vegetated with lawn grass and several hardwoods. The upstream (north)
end of the project area is a gut and on the other side of this gut is a bulkheaded and
developed lot. This area is vegetated with mixed hardwoods, shrubs and vines as well as
several species of wetland vegetation in the gut itself.
The site elevation is ::? 8 to 10 feet above the NWL along this section of Bath Creek.
Bath Creek classified as SB-NSW by the Environmental Management Commission and is
designated as an inland PNA by the Wildlife Resources Commission. Bath Creek is not
open to shell fishing.
Project description
The applicant proposes to construct X2,110 feet of bulkhead along the upland portions
of the project site. The bulkhead will average 1 foot landward of the N1V-L and will project
into the water a maximum of 2 feet. Riprap is proposed along an approximately 190' section
of wooded wetland as well as at the toe of the existing dike road 0250') at the downstream
(south) end of the project site. The riprap will average 2 feet below the NWL and will
project into the water a maximum of2 feet.

The applicant proposes to grade the existing bluff down to the new bulkhead. This
grading activity will disturb an average of width of 30' for a total impact of ±63,300 ft' of
high ground.
Anticipated impacts
The project as proposed will result in the filling of ?L 910 ft' of creek bottom
associated with the placement of the riprap as well as ±240 ftz of creek bottom associated
with the construction of the bulkhead. Approximately 63,300 ft2 of high ground will be
disturbed. The project as proposed will result in localized turbidity as a result of the
construction activities.
