The purpose of this letter is to request the use Nationwide permits 12 & 26 for the f {?e
proposed Ballentine Farms Subdivision located east of Sunset Lake Road (NCSR 1 a n
Terrible Creek, Fuquay-Varina, NC (see attached USGS site vicinity map). Propo to wetlands
for the construction of the residential subdivision will total 1.249 acres [0.815 (NW26 & 0.434 (NW12)].
S&EC, Inc. believes that no mitigation will be required for this project. The total permanent impacts
under Nationwide Permit # 26 equal 0.815 acres (i.e., less than 1 acre) and the total linear feet of impacts
to streams potentially containing "importance" to significant aquatic function equal 128.2 feet. All other
impacts will be temporary under Nationwide Permit # 12. If for some reason wetland mitigation is
required, our client proposes payment into the North Carolina Wetland Restoration Fund.
The extent of the wetlands on the property have been confirmed by Mr. Todd Tugwell of the US Army
Corps of Engineers (USACOE). Construction of the subdivision will comply with the general conditions
stated within Nationwide Permits 12 & 26.
The surface waters subject to the Neuse River Buffer regulations (15A NCAC 2B .0233) were determined
by Mr. Steve Mitchell of the NC Division of Water Quality (DWQ). The proposed impacts are allowed
under the current Neuse River Buffer regulations without requiring a variance from the Environmental
Management Commission. Proposed impacts to the buffers have been limited to three road crossings and
two sanitary sewer crossings.
Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form,
(3) USGS Site Vicinity Map, (3) Construction Plans, (4) DWQ Neuse River Buffer confirmation letter, (5)
Wetland Delineation Forms and (6) a check for $475.00 to cover the permit application fee.

* In addition to the four road crossings of the secondary "intermittent" stream channels, Terrible
Creek will be crossed with a sanitary sewer line in two locations to connect to an existing sanitary
sewer line. The creek is approximately 10 feet wide in these locations and the proposed linear feet
of impact for both crossings will be less than a total of 80 feet. The crossings will comply with all
the General Conditions stated within Nationwide Permit #12.

The proposed work will include impacts to wetlands and waters for the purpose of
constructing a residential subdivision. Nationwide Permit 12 will be used for the installation
of a sanitary sewer line and Nationwide Permit 26 will be used for lot fill and road
construction.

14. State reasons why it is believed that this activity must be carried out in wetlands (include
any measures taken to minimize wetland impacts): (SEE ATTACHED PLANS)
AREAS 1. 2, 6, 7 & 10 - These areas include proposed impacts to both wetlands and waters for the
construction of roads.
Areas 1 & 7 will be crossing a stream channel determined as not "important" to significant aquatic
function by the USACOE. The road crossing indicated in Area 7 was curved to the south in an effort to
avoid impacts to the Neuse River Buffers. The location for the road crossing indicated in Area 1 was
required to connect to Sunset Lake Road at a point determined by the NC Division of Transportation. It
was determined that this connection point would allow for safe traffic flow into and out of the site, given
the curvature of Sunset Lake Road.
The original plan only called for a single road crossing of the stream located in the northeast comer of
the property. Unfortunately this would have resulted in a cul-de-sac longer than the 800 feet maximum
amount allowed by the town (see the attached comments from the Town of Fuguay-Varina). The plan
therefore had to be modified to confirm to the town's requirements. This modification resulted in having
to cross the stream in two locations as depicted in Areas 2 & 10.
No stream channel exists in Area 6. Impacts to wetlands in this area are required to provide for ease of
traffic flow within the subdivision.
AREAS 3, 4 & 5 - Impacts depicted in these areas will result in filling of wetland areas required to create
buildable single family home lots. The wetlands within Area 4 consist of a recently breached farm pond.
Only the perimeter of the original pond bottom will be impacted. The naturally forming stream channel
within the original pond bottom will not be impacted. No buffers are required for this channel section
under the Neuse River Buffer regulations (see attached DWQ letter.) However, since no impacts are
proposed within this area, vegetated buffers will form naturally along this channel section.
AREAS 8 & 9 - These areas consist of two sanitary sewer connectors to provide site access to the Town
of Fuquay-Varina sanitary sewer system. The number of connectors were limited to the greatest extent
possible in an effort to limit the amount of temporary disturbance to Terrible Creek and its associated
wetlands. The line will comply with all the General Conditions stated within Nationwide Permit #12.

Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for
listing endangered or threatened species or critical habitat in the permit area that may be affected by the

Dear Mr. Zarzacki:
On January 25, 1999 I met with you at the subject property to conduct a site visit for the above referenced
project. This project is referenced by the Raleigh Regional Office as NBRRO 99-009. It was determined
that there are several features on site that are at least intermittent streams and therefore subject to the Neuse
River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing
Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233).
The streams (features) have been delineated on the map received by this Office January 26, 1999 and the
areas applicable to protection under the Neuse Buffer Rules are as follows:
From Flag NBR 01 beginning at the edge of the property along the 1400 series flags to the eastern
property line;
From flag NBR 02 beginning at the stream channel split in the upper pond near flags 317 and 318
continuing south to the end of the forested vegetation;
From the end of the tree line to the second dam, there is no protection afforded to the stream because
there is no forested vegetation to protect;
Fifty feet from the breach in the dam south to the property line along the 1000 series flags;
and, the impounded water along the 1300 series flags at the southeast corner of the property.

9.y Show typical detail of round a bout. This can be very general but it needs to
express to the Board what it will look like and how it will function.
10 Include a 100-scale plan of the proposed development (the utility plan will do). It
is too hard to read the street sections and utilities at 200 scale. The remaining
sheets can be 200 scale.
711. Label the 30 feet buffer along the south property line from Sunset Lake Road to
the first "Pedestrian/Equestrian trail" as "Public Greenway and sewer easements"
and "public greenway easement" along the southern property line from the
southeast corner west to the first "Pedestrian/Equestrian Trail".
Two (2) of the cul-de-sacs appear to be longer than the maximum 800 feet
ninn needs to be revised to meet the maximum 800 feet length.
J 14. The requirement for fire hydrant separation is a maximum of 500 feet. Some
hydrants are spaced more than 500 feet. Also some FH need to be relocated. F-
H's need to also be shown along Sunset Lake Road at 500 feet intervals. The
