4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The project area contains a forested area along the northern boundary, part of a parking lot and Baxter Road in the north and west portions and overhead electric utility easements that
run north -south through the eastern part of the project area and east -west through the center of the site; most of the site consists of regularly maintained herbaceous vegetation and
walking paths associated with the existing park. Areas adjacent to the stream channel contain unmaintained scrub/shrub vegetation. The subject property vicinity contains commercial,
office and residential uses. Please refer to the attached USGS Location Map (Figure 1), Mecklenburg County Soil Survey Map (Figure 2) and Subject Property Aerial Map (Figure 3) for
more information on the project setting.

4h. Explain the purpose of the proposed project:*
The purpose of the project is to renovate the existing Pearl Street Park by adding a basketball court, restroom facilities, picnic areas, pedestrian paths, utilities and stormwater treatment
facilities. The proposed renovations also include enhancement of the perennial tributary to Little Sugar Creek that traverses the site. The purpose of the stream enhancement is to
stabilize and modify the stream banks to allowflood flows to access the floodplain more frequently thus reducing the energy and velocity in the channel and reduce erosion.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The City of Charlotte proposes to renovate the existing Pearl Street Park by adding a basketball court, restroom facilities, picnic areas, pedestrian paths, utilities and stormwater
treatment facilities within the 11-acre project area. The proposed renovations also include enhancement of the perennial tributary to Little Sugar Creek that traverses the site. The
project reach is approximately 700 linear feet and is located at Pearl Street Park in Charlotte, NC. Over time the reach has been modified, straightened, and dredged, resulting in a
highly disturbed and incised channel with little to no riparian vegetation on the stream banks. Although the channel is incised, it does not appear to be degrading or aggrading.
Therefore, it is proposed to enhance the stream through several natural channel design techniques. First, it is proposed to excavate a floodplain bench at the bankfull elevation along
the left bank of the stream. This will allowflood flows to access the floodplain more frequently thus reducing the energy and velocity in the channel. The floodplain bench will be planted
with native riparian vegetation that tolerates occasional inundation. Second, the right bank will be laid back at a more stable slope to reduce the potential for future bank erosion. The
right bank will also be vegetated with riparian vegetation as a means of stabilization. Third, rock cross vanes will be constructed in the channel to increase aquatic habitat diversity, help
to re -oxygenate the water, and reduce near -bank stress. Lastly, the enhancement is proposed to remove the non-native invasive species population that currently existing along the
stream reach and replace with native riparian vegetation. Heavy equipment typical for utility installation and grading will be used to construct the proposed project such as track hoes,
bulldozers, dump trucks and graders.

1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The project is designed to result in a net increase of aquatic functions and services. Installation of the proposed boulder structures will be conducted
in the wet. We believe that this is preferable to working in the dry for the following reasons:
-As the project largely involves bank stabilization and the installation of three boulder structures, disturbance to the channel will be minimal;
-It is more efficient and effective to install boulder structures in the wet as it is immediately noticeable howthe structure will function hydraulically and
adjustments can be made during initial installation as needed to achieve optimum performance. When working in the dry, there is no way of knowing
how the structure will function until the channel is re -activated, and adjustments to the structure can't be made until after the installation is complete;
and
-The risk of harming the existing aquatic life in the stream by working in the dry outweighs the risk of impacting the receiving waters with the minimal
amount of sediment that would be transported downstream during construction.

A Sediment and Erosion Control Plan for the project will be developed and approved by Mecklenburg County, and the project will comply with the
supplementary NPDES Construction Stormwater Permit (NCG010000).

located at the corner of Pearl Park Way and Kenilworth Avenue in Charlotte, Mecklenburg County, North Carolina
(hereinafter referred to as the project area). The 11-acre project area includes three parcels owned by Mecklenburg
County (Mecklenburg County PINS 12520148, 12520161 and 12520153). The subject property is shown on the
attached U.S. Geological Survey (USGS) 7.5-minute Charlotte East, NC topographic quadrangle (Figure 1). The subject
property vicinity contains commercial, office and residential uses. The proposed project is a renovation of an existing
park.

Figure 2 depicts the subject property on an aerial photograph of the area. The project area contains a forested area
along the northern boundary, a construction area in the southern portion, part of a parking lot and Baxter Road in the
north and west portions and overhead electric utility easements that run north -south through the eastern part of the
project area and east -west through the center of the site; most of the site consists of regularly maintained herbaceous
vegetation and walking paths associated with the existing park. Based on a field reconnaissance of the project area,
there are no existing structures present on the property.
